Council Minutes – April 10, 2017

1.    CALL TO ORDER – 7:30 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, April 10, 2017 with Mayor Losier presiding.

2.    RECORD OF ATTENDANCE

Councillor Balemans, Councillor Day and Councillor Snodgrass were in     attendance.  Deputy Mayor Likely and Councillor Evans were absent.

3.    APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Day moved to approve the agenda of April 10, 2017 with the addition of Item 32. a – Completion of Certificate #5 – TerraEx Inc.

Councillor Snodgrass moved to receive and file the Presentation Re:  Financial Donation – Colleen Quigg Presenter.

Mayor Losier was presented a plaque from Colleen Quigg of the Saint John & Grand Bay-Westfield Crime Stoppers for the Town’s financial donation.

Councillor Snodgrass moved to table the RCMP Report for March 2017 to the April 24, 2017 Regular Town Council Meeting.

Councillor Snodgrass moved to ratify the Email Poll of March 24, 2017 in that the Council Meeting of Monday, March 27, 2017 was cancelled.

Councillor Day moved to receive and file the Letter of March 14, 2017 from Canadian Red Cross Re:  Support for Families Impacted by Major Ice Storms Across New Brunswick.

18.    LETTER OF MARCH 17, 2017 FROM CLARK SOMERVILLE, PRESIDENT OF FEDERATION OF CANADIAN MUNICIPALITIES RE:  LEGAL DEFENSE FUND

Councillor Snodgrass moved to authorize payment to the Federation of Canadian Municipalities as per the Letter of March 17, 2017 from Clark Somerville, President of Federation of Canadian Municipalities Re:  Legal Defense Fund, subject to use of the current census figures.

Councillor Day moved to receive and file the Letter of March 20, 2017 from Richelle Martin, Stewardship Coordinator – Nature Trust of New Brunswick Re:  Blueberry Hill Nature Preserve.

It was noted that the Town would advertise for volunteers and direct them to the Nature Trust of New Brunswick website.

21    .LETTER OF MARCH 28, 2017 FROM HON. BILL FRASER, MINISTER – TRANSPORTATION AND INFRASTRUCTURE RE:  RTE. 177, 6 TIMBER CROSS CULVERT REPLACEMENTS – DESIGNATED HIGHWAY FUNDING

Councillor Snodgrass moved to receive and file the Letter of March 28, 2017 from Hon. Bill Fraser, Minister – Transportation and Infrastructure Re:  Rte. 177, 6 Timber Cross Culvert Replacements – Designated Highway Funding and further moved to forward the letter to Dillon Consulting Ltd. advising them to proceed with the Project.

22.    TOWN MANAGER’S REPORT OF MARCH 30, 2017 RE:  MINISTERIAL APPROVAL NO. 17-0012 (SEWERAGE SYSTEM UPGRADES – LAGOON UPGRADES) – DEMAND LOAN

Councillor Day moved to grant authorization for a Demand Loan at the Bank of Nova Scotia regarding Ministerial Approval No. 17-0012 concerning 2017 Sewerage Capital Borrowing Re:  Environmental Health Services – Sewerage System Upgrades with the Loan not to exceed $368,802 for a term of three years.

23.    LETTER OF MARCH 28, 2017 FROM LAURIE FLOOD, EXECUTIVE DIRECTOR, ST. JOSEPH’S HOSPITAL FOUNDATION RE:  SUPPORT FOR EYE CLINIC AND URGENT CARE

Councillor Snodgrass moved to receive and file the Letter of March 28, 2017 from Laurie Flood, Executive Director, St. Joseph’s Hospital Foundation Re:  Support for Eye Clinic and Urgent Care.

24.    RECREATION DIRECTOR’S REPORT OF MARCH 30, 2017 RE:  BALL FIELD MAINTENANCE LINING AND DRAGGING QUOTATION NO. BFM-17-2017

Councillor Snodgrass moved to approve the low quotation bid from Squeaky Kleen Lawn Care for Ball Field Maintenance Lining and Dragging for the amount of $30.00/hour plus applicable taxes, for a three year period of May 2017 to October 2019 with an option to renew for an additional six (6) month period based upon mutual consent and agreement of the Town and Vendor as per Quotation Number BFM-17-2017.

25.    LETTER FROM FRANCOIS CHOQUETTE, MEMBER OF PARLIAMENT (DRUMMOND) RE:  BILL C-203, AN ACT TO AMEND THE SUPREME COURT ACT

Councillor Day moved to receive and file the Letter from Francois Choquette, Member of Parliament (Drummond) Re:  Bill C-203, An Act to Amend the Supreme Court Act.

Councillor Snodgrass moved to table the Letter of March 2017 from Susan Harley, Chair – Foundation Advancement Committee, NB Medical Education Foundation Inc. Re:  Donation to Support Program to a future Regular Town Council Meeting for further information.

27.    DEVELOPMENT OFFICER’S REPORT OF APRIL 5, 2017 RE:  TRANSFER OF GREEN AREA (PID NO. 458976 OFF GARY COURT IN EXCHANGE FOR LAND TO BE CONVEYED AS PUBLIC STREET OUT OF PID NO. 458505

Councillor Snodgrass moved under section 56(1) of the Community Planning Act, assent to the Plan for vesting the 324 m2 parcel identified as Public Streets, as shown on Amending Subdivision Plan, Sunny Side Subdivision, Lot 2017-8, prepared by DeSaulniers Surveys Inc., dated March 23, 2017, out of property identified by PID No. 00458505;

And further moved to convey ownership of PID No. 458976 to Carol Lee and James Nelson Carnell of 22 Gary Court, in exchange for the Public Street, with related costs to be covered by the Town.

28.    MEMORANDUM OF APRIL 5, 2017 FROM PLANNING ADVISORY COMMITTEE RE:  RECOMMENDATION TO COUNCIL, TENTATIVE SUBDIVISION APPROVAL, BRYCE WARD – SHANNON ROAD/DEVELOPMENT OFFICER’S REPORT OF APRIL 5, 2017

Councillor Day moved to accept of $ 823.22 money in lieu of Land for Public Purposes (cash, money order, certified cheque or debit) for the purposes of creating three new building lots out of PID Nos. 219279 and 30207559 on Shannon Road, as shown on the Tentative Subdivision Plan, Shannon Subdivision, as prepared by Kierstead Quigley and Roberts Ltd. dated March 27, 2017, with approval of Final Subdivision Plan to be subject to:

i)payment of $ 823.22 (cash, money order, certified cheque or debit);

ii)recording of civic numbers on the Final Subdivision Plan, showing Lot 17-1 as civic no. 66, Lot 17-2 as civic no. 70, Lot 17-3 as civic no. 76, Lot 17-4 as civic no. 82 and Lot 17-5 as civic no. 92;

iii)recording of 5 m wide Utilities Easement to follow the frontage of the existing lot PID #219279, (Lots 17-1, 17-2, 17-3, and 17-4) along Shannon Road, as required by NB Power and Aliant;

iv)recording of notes on the Plan as directed from the City of Saint John concerning Lots 17-4 and 17-5;

with future Development subject to all Municipal By-law requirements including: driveway access and sanitary waste water sewer connection approval by the Works Commissioner; and confirmation that the top of foundation elevation meets the minimum required 750mm above the centreline grade of the street.

29.    LETTER OF APRIL 6, 2017 FROM TOWN MANAGER/CLERK RE: PURCHASE OF PROPERTY

Councillor Snodgrass moved to direct the Town Solicitor to move forward with the purchase of the Gaunce property, 37 Epworth Park Road with the closing to be at the earliest possible date.

30.    FIRE CHIEF’S REPORT OF APRIL 7, 2017 RE: TRAINING ROOM SOUND WALL

Councillor Day moved to authorize staff to engage Power-Built Construction to construct new sound dampening wall between the Fire Training Room and Room A as per supplied quote.

31.    FIRE CHIEF’S REPORT OF APRIL 7, 2017 RE:  FIREFIGHTERS LOUNGE

Councillor Day moved to authorize staff to engage Westoak Design Build to supply and install new flooring, interior doors, trim and painting of the Station # 1 Firefighters Lounge as per supplied quote.

32.    LETTER OF MARCH 29, 2017 FROM DOUGLAS HARTFORD, P. ENG., DILLON CONSULTING RE:  WASTEWATER SYSTEM IMPROVEMENTS GP & SL STATIONS, PROJECT 163317A, INTERIM CERTIFICATE NO. 4, COMPLETION CERTIFICATE

Councillor Snodgrass moved to pay TerraEx Inc. the amount of $33,678.56 as per the Letter of March 29, 2017 from Douglas Hartford, P. Eng., Dillon Consulting Re:  Wastewater System Improvements GP & SL Stations, Project 163317A, Interim Certificate No. 4, Completion Certificate.
