Council Minutes – December 8, 2014

1. CALL TO ORDER – 7:33 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, December 8, 2014 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE

Deputy Mayor Likely, Councillor Calvin, Councillor Evans and Councillor Snodgrass were in attendance.

Councillor Day was absent.

Councillor Calvin moved to pay Councillor Day in her absence.

Seconded by Councillor Evans.  Carried.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Evans moved to approve the agenda of December 8, 2014 with the following additions:

22. a) Transfer to Reserve Fund
22. b) Award of Municipal Insurance.

Seconded by Deputy Mayor Likely.  Carried unanimously.

Cst. McKinnon responded to inquiries from elected officials.

Councillor Calvin moved to receive and file the RCMP Report for November 2014.

6.2    PRESENTATION BY SAINT JOHN THEATRE COMPANY RE:  REQUEST FOR FINANCIAL SUPPORT – STEPHEN TOBIAS, EXECUTIVE DIRECTOR PRESENTER

Councillor Calvin moved to refer the information from the Saint John Theatre Company Re:  Request for Financial Support to 2015 budget deliberations.

Seconded by Councillor Snodgrass.  Carried.

7.1 MINUTES OF REGULAR COUNCIL MEETING OF NOVEMBER 24, 2014

Councillor Snodgrass moved to adopt the Minutes of the Regular Council Meeting of November 24, 2014 as presented.

Seconded by Councillor Evans.  Carried.

7.2 MINUTES OF ECONOMIC DEVELOPMENT ADVISORY COMMITTEE OF OCTOBER 22, 2014

Councillor Snodgrass moved to receive and file the Minutes of Economic Development Advisory Committee of October 22, 2014.

Seconded by Deputy Mayor Likely.  Carried.

7.3 EMAIL POLL OF DECEMBER 1, 2014 RE:  CANADA NEW BRUNSWICK AGREEMENT ON THE GAS TAX FUND

Councillor Snodgrass moved to authorize the appropriate signatures for the Canada New Brunswick Agreement on the Gas Tax Fund with Local Governments dated November 25, 2014 per correspondence of November 25, 2014 from the Department of Environment and Local Government.

Seconded by Deputy Mayor Likely.  Carried.

8. BILLS FOR PAYMENT

Councillor Snodgrass moved to pay Bills for Payment for $112,994.25 and Bills for Ratification for $69,821.84 for a total of $182,816.09.

16. TOWN MANAGER’S REPORT OF DECEMBER 1, 2014 RE:  EVALUATION OF RFP – RVCC/CLUSTER-OP-REV-14.

Councillor Snodgrass moved to award RFP-RVCC/Cluster-OP-REV-14 to Health Systems Group per their submission dated November 10, 2014 subject to all terms and conditions of RFP-RVCC/Cluster-OP-REV-14 for a Voluntary Operational Review of the River Valley Community Center to commence January 10, 2015.

17. DEVELOPMENT OFFICER’S REPORT OF DECEMBER 3, 2014 RE:  VALLEYVIEW ESTATES SUBDIVISION, PHASE 10, (EMMA AVENUE) – FINAL RELEASE OF SECURITY FOR WARRANTEE

Councillor Snodgrass moved to accept the recommendation of Dillon Consulting Ltd., to RELEASE the Security held by the Town, in the amount of $18,750.00, as held under the Valleyview Estates, Phase 10 Subdivision Developer’s Agreement as security held under Warrantee for work now completed on EMMA AVENUE.

18. LETTER OF NOVEMBER 5, 2014 FROM TIM PETERSEN, CPA, CA, ACTING VICE-PRESIDENT, CORPORATE SERVICES, WORKSAFE NB RE:  ASSESSMENT RATE UNDER THE FIREFIGHTERS’ COMPENSATION ACT

Councillor Snodgrass moved to receive and file the Letter of November 5, 2014 from Tim Petersen, CPA, CA, Acting Vice-President, Corporate Services, WorkSafe NB Re:  Assessment Rate Under the Firefighters’ Compensation Act.

19. ADDITIONAL BANK OF NOVA SCOTIA BUSINESS ACCOUNT FORM RE:  GAS TAX FUND – AUTHORIZATION FOR APPROPRIATE SIGNATURES REQUESTED

Councillor Evans moved to authorize opening an additional Bank of Nova Scotia Business Account Re:  Gas Tax Fund with authorization for appropriate signatures.

20. EMAIL OF DECEMBER 3, 2014 FROM SAINT JOHN REGION CHAMBER OF COMMERCE RE:  MEMBERSHIP RENEWAL INVOICE

Councillor Snodgrass moved to approve the renewal of a one year membership to the Saint John Region Chamber of Commerce in the amount of $120.00 plus HST.

21. DEVELOPMENT OFFICER’S REPORT OF DECEMBER 3, 2014 RE:  2015 EXCAVATION PERMIT – KEEL CONSTRUCTION LTD., BALLENTINE PIT, PID NOS. 00093088, 00227546, 00227595, 30042899

Councillor Evans moved to approve the Rehabilitation Plan as presented by Hobart Realty Ltd. dated May 15, 1998 and revised May 16, 2006 by Murdock Lingley Ltd. as it relates to the 2015 Excavation Permit for excavation of material from Ballentine Pit, lands identified by PID  Nos. 00093088, 00227546, 00227595, 30042899,

and further to approve the Bond of Indemnity Bond #HM0003001013, Endorsement #20, in the amount of $50,000.00 issued by the Guarantee Company of North America, to be held as security for the Rehabilitation of the Ballentine Pit, located at lands identified by PID Nos. 00093088, 00227546, 00227595, 30042899 for the 2015 Excavation Permit, being effective from December 31, 2014 to December 31, 2016 inclusive,

and further to approve conditions for the operation of the 2015 Excavation Permit as set out in section 16.9 of the Town’s Zoning By-law No. 112, with additional requirements to provide street sweeping on Ballentine Place, once per week during the months of June through October, and provide to the Town within 5 working days of the end of each month written records of the dust control measures undertaken; additional dust control measures may be requested by the Building Inspector as required, subject to special and or unreasonable dust conditions.

22. FIRE CHIEF’S REPORT OF DECEMBER 5, 2014 RE:  REPLACEMENT OF FIRE DEPARTMENT VEHICLE

Deputy Mayor Likely moved to authorize Staff to proceed with the ordering and purchasing of a 2015 Dodge Ram 2500 as quoted from Summerside Chrysler Dodge at a cash purchase price of $40,311.00 plus applicable taxes and fees plus associated equipment transfer costs of $2,500,

and further moved to sell the existing Dodge Ram 1500 to same dealer for cash price of $16,000.00.

22.a)  TRANSFER TO RESERVE FUND

Councillor Snodgrass moved to transfer $140,000.00 from the General Revenue Operating Fund to the General Capital Reserve Fund.

Seconded by Councillor Calvin.  Carried.

23.b)  AWARD OF MUNICIPAL INSURANCE COVERAGE

Councillor Calvin moved to accept a one year renewal of Municipal Insurance coverage from BFL Canada for a maximum premium of $104,515.00.

Seconded by Councillor Evans.  Carried.
