Council Minutes – January 26, 2015

 1. CALL TO ORDER – 7:38 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, January 26, 2015 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE

Deputy Mayor Likely, Councillor Day, Councillor Calvin, Councillor Evans, and Councillor Snodgrass were in attendance.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Snodgrass moved to approve the agenda of January 26, 2015 as presented with the following addition:

22.a)    Comex Fares -Increase

Seconded by Councillor Day.  Carried unanimously.

4. DISCLOSURE OF CONFLICT OF INTEREST

Councillor Calvin declared a conflict of interest with item #52 on Bills for Payment for Home of the Chicken Man for $162.84.

Councillor Day declared a conflict of interest with item #33 on Bills for Payment for Beverley Day for $33.89.

Lynn Campbell declared a conflict of interest with item #23 on Bills for Payment for Lynn Campbell for $931.99.

6. PUBLIC PRESENTATIONS

6.1    PRESENTATION BY THE RIVER VALLEY SENIOR CITIZENS CLUB TO THE TOWN OF GRAND BAY-WESTFIELD RE:  ANNUAL DONATION – COUNCILLOR CALVIN, LIAISON PRESENTER

Councillor Calvin as Liaison to the River Valley Senior Citizens Club presented Council, on behalf of the Club, a cheque in the amount of $500.00 towards their use of the Senior’s Lounge.

Councillor Snodgrass moved to receive and spend the donation from the River Valley Senior Citizens Club.

Seconded by Councillor Evans.  Carried.

It was noted a letter of thanks would be sent to the River Valley Senior Citizens Club.

7.    MINUTES

7.1    MINUTES OF REGULAR COUNCIL MEETING OF JANUARY 12, 2015

Councillor Day moved to adopt the Minutes of the Regular Council Meeting of January 12, 2015 as presented.

Seconded by Councillor Snodgrass.  Carried.

7.2    MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF NOVEMBER 17, 2014

Councillor Day moved to receive and file the Minutes of the Planning Advisory Committee Meeting of November 17, 2014.

Seconded by Councillor Snodgrass.  Carried.

7.3    MINUTES OF EMERGENCY MEASURES ORGANIZATION (EMO) MEETING OF NOVEMBER 18, 2014/EMO TRAINING MEETING OF NOVEMBER 18, 2014

Councillor Day moved to receive and file the Minutes of the Emergency Measures Organization (EMO) Meeting of November 18, 2014/EMO Training Meeting of November 18, 2014.

Seconded by Councillor Calvin.  Carried.

8.    BILLS FOR PAYMENT

Assistant Clerk Lynn Campbell departed the meeting due to a stated conflict of interest with item #23 on Bills for Payment.

Councillor Snodgrass moved to pay item #23 on Bills for Payment in the amount of $931.99 to Lynn Campbell.

Seconded by Councillor Calvin.  Carried.

Assistant Clerk Lynn Campbell rejoined the meeting.

Councillor Day departed the meeting due to a stated conflict of interest with item #33 on Bills for Payment.

Councillor Snodgrass moved to pay item #33 on Bills for Payment in the amount of $33.89 to Beverley Day.

Seconded by Councillor Evans.  Carried.

Councillor Day rejoined the meeting.

Councillor Calvin departed the meeting due to a stated conflict of interest with item #52 on Bills for Payment.

Councillor Snodgrass moved to pay item #52 on Bills for Payment in the amount of $162.84 to Home of the Chicken Man.

Seconded by Councillor Evans.  Carried.

Councillor Calvin rejoined the meeting.

Councillor Day moved to pay Bills for Payment for $1,581.98 and Bills for Ratification for $291,440.90 for a total of $293,022.88.

Seconded by Councillor Evans.  Carried.

Councillor Day moved to receive and file the Facsimile of January 16, 2015 from Rob Frenette, O.N.B. Bullying Canada Inc. Re:  Funding Request.

17.     LETTER OF JANUARY 5, 2015 FROM KURTIS SISK, CHIEF EXECUTIVE OFFICER, HEART AND STROKE FOUNDATION OF NEW BRUNSWICK RE:  FEBRUARY IS HEART AND STROKE MONTH

Councillor Day moved to receive and file the Letter of January 5, 2015 from Kurtis Sisk, Chief Executive Officer, Heart and Stroke Foundation of New Brunswick Re:  February is Heart and Stroke Month.

Seconded by Councillor Evans.  Carried.

It was also noted that Grand Bay-Westfield residents would be made aware that there will be volunteers canvassing for the Heart and Stroke Foundation in February.

18.    PLANNING ADVISORY COMMITTEE (PAC) MEMORANDUM OF JANUARY 21, 2015 RE:  INDEX LIST OF PAC ITEMS FOR 2014

Councillor Snodgrass moved to receive and file the Planning Advisory Committee (PAC) Memorandum of January 21, 2015 Re:  Index List of PAC Items for 2014.

Seconded by Deputy Mayor Likely.  Carried.

19.    PLANNING ADVISORY COMMITTEE MEMORANDUM OF JANUARY 21, 2015 RE:  ELECTION OF OFFICERS FOR 2015

Deputy Mayor Likely moved to receive and file the Planning Advisory Committee Memorandum of January 21, 2015 Re:  Election of Officers for 2015.

It was noted Ralph Stevens was elected Chair and Chyann Kirby was elected Vice-Chair of PAC.

Seconded by Councillor Day.  Carried.

20.    DEVELOPMENT OFFICER’S REPORT OF JANUARY 21, 2015 RE:  ANDREW ROGERS/PIERSIDE MARINE, REQUEST FOR MUNICIPAL PLAN BY-LAW, AMENDMENT AND RE-ZONING OF A PORTION OF PID NO. 210476, NEREPIS ROAD

Deputy Mayor Likely moved to table for additional information the Development Officer’s Report of January 21, 2015 Re:  Andrew Rogers/Pierside Marine, Request for Municipal Plan By-law, Amendment and Re-Zoning of a portion of PID No. 210476, Nerepis Road and that the Development Officer be directed to receive from the applicant information including, but not limited to, permission from NB Southern Railway for access, approval from the Department of Environment, and all other relevant information.

21.    TOWN MANAGER’S REPORT OF JANUARY 21, 2015 RE:  2015 SEWERAGE REVENUE FUND OPERATING BUDGET – REVISED

Councillor Snodgrass moved to adopt the revised 2015 Sewerage Revenue Fund Operating Budget as per documents attached to the Town Manager’s report of January 21, 2015 reflecting total revenues of $473,355 and total expenditures of $473,355, the sewerage user fee shall be $270.00 per user unit effective January 1, 2015 with a $15.00 discount for residential units only, if full payment is received by the Town Office by 5:00 p.m. on Wednesday, April 1, 2015; discount applicable where there are no arrears or penalties payable in respect of the annual user charge

22.    TOWN MANAGER’S REPORT OF JANUARY 22, 2015 RE:  RESTRICTIONS ON TENDERS, QUOTATIONS, AND SUPPLY OF SERVICES

Councillor Evans moved that no tenders, quotations or supply of services shall be considered from any Tenderer, or its principals, engaged in litigation against the Town of Grand Bay-Westfield in relation to work being tendered.

The following exceptions will apply:

a) Where there is only one (1) supplier available, with the approval of the Town Manager
b) Where there is a legal obligation to do such as a current contract
c) Where the product or service is exclusively supplied by either license, patent or regulation
d) In the case of emergency where it is in the best interest to health and safety or if preservation of municipal infrastructures is at risk
e) Where it is prevented by funding agencies
f) Where it is approved by Council,

and further moved that upon the initiation of litigation, the Town Manager shall notify the contractor or supplier of services of this policy.

22.a) COMEX FARES – INCREASE

Councillor Snodgrass moved to adopt an increase to Comex fares effective February 1, 2015 as follows:

$125.00 for a monthly pass
$4.00 per ride
$38.00 for 10 rides
$68.00 for 20 rides

Seconded by Councillor Day.  Carried.

23.    ADJOURNMENT

Councillor Calvin moved adjournment.
