Council Minutes – JUNE 8, 2015

1. CALL TO ORDER – 7:32 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, June 8, 2015 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE

Councillor Calvin, Councillor Evans, Councillor Day, Councillor Snodgrass, and Deputy Mayor Likely were in attendance.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Calvin and Councillor Snodgrass departed the meeting – introduction of item #18.a – conflict of interest.

Councillor Day moved to approve the agenda of June 8, 2015 as presented with the following addition:

18. a) Disposition of Property:  Identification Number 00221838.

Seconded by Deputy Mayor Likely.  Carried unanimously.

Councillor Calvin and Councillor Snodgrass rejoined the meeting.

4. DISCLOSURE OF CONFLICT OF INTEREST

Councillor Calvin and Councillor Snodgrass – conflict of interest with Item Number 18.a – Disposition of Property:  Identification Number 00221838.

6.1 PRESENTATION OF RCMP REPORT FOR MAY 2015 – RCMP REPRESENTATIVE ATTENDING

Sgt. Alain Desrosiers provided information on policing operations and responded to inquiries from Elected Officials.

Councillor Evans moved to receive and file the Presentation of RCMP Report for May 2015.

6.2    LETTER OF JUNE 3, 2015 FROM JOLANTA KLIWER RE:  BEAUTIFYING NEIGHBOURHOODS WITH RELATED CORRESPONDENCE AND DATA FROM MS. KLIWER/DEVELOPMENT OFFICER’S REPORT OF JUNE 3, 2015 – MS. KLIWER PRESENTER

Councillor Day moved to refer the Letter of June 3, 2015 from Jolanta     Kliwer Re:  Beautifying Neighbourhoods with Related Correspondence     and Data from Ms. Kliwer/Development Officer’s Report of June 3,     2015 to Development Officer to return to Council.

Councillor Calvin moved to adopt the Minutes of the Regular Council Meeting of May 25, 2015 as presented.

7.2    MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF     APRIL 20, 2015

Deputy Mayor Likely moved to receive and file the Minutes of     Planning Advisory Committee Meeting of April 20, 2015.

Seconded by Councillor Day.  Carried.

8.    BILLS FOR PAYMENT

Councillor Day moved to pay Bills for Payment for $3,698.87 and Bills for Ratification for $30,091.17 for a total of $33,790.04.

Seconded by Councillor Evans.  Carried.

16.    TOWN MANAGER’S REPORT OF JUNE 3, 2015 RE:  RENEWAL OF LEASE – TOWN OF GRAND BAY-WESTFIELD AND NB EMS INC.

Councillor Day moved to renew the lease with NB EMS Inc. for use of a portion of Town premises located at 293 Nerepis Road as outlined in the draft lease and as described in Schedule “A”, copy attached to the Town Manager’s report of June 3, 2015, to extend the lease for the period November 1, 2014 – October 31, 2017 with rental fees set at $1,700 per month with authorization for appropriate Town signatures.

17.    WORKS COMMISSIONER’S REPORT OF JUNE 4, 2015 RE:  TENDER AWARD 004T-2015 – LOADER/BACKHOE

Deputy Mayor Likely moved to award Tender 004T-15 for a Loader/Backhoe Extended Boom to Wajax Equipment with the low bid of $135,317.50 including HST for a 2015 JCB 3CX-14 Super loader/backhoe.

Seconded by Councillor Evans.  Carried.

18.    DEVELOPMENT OFFICER’S REPORT OF JUNE 3, 2015 RE:  INSPECTIONS, APPOINTMENT OF ACTING BUILDING INSPECTOR, DEVELOPMENT OFFICER, AND BY-LAW ENFORCEMENT OFFICER

Deputy Mayor Likely moved to appoint Brian Shannon as Acting Building Inspector, Acting Development Officer, and Acting By-law Enforcement Officer to cover periods of absence by the Town’s Building Inspector, Development Officer, and By-law Enforcement Officer, with a compensation rate of $65.00/hr. and a vehicle use rate of $0.40/km for the year 2015.

Seconded by Councillor Day.  Carried.

18. a) DISPOSITION OF PID NO. 00221838

Councillor Calvin and Councillor Snodgrass departed the meeting regarding a conflict of interest.

Councillor Day moved whereas it appears that active construction of a new house (the “Development”) is taking place on property bearing PID 00221838 (the “Property”), which is owned by Lucy Blanche Harrigan;

And whereas the person in charge of carrying out the Development appears to be Paul Fox;

And whereas in addition to the Development, a trailer has been permanently located on the Property and there has been construction of fences, decks and outbuildings;

And whereas the Property is located within an area around Round Lake within the limits of a provincially designated water shed protected area and it appears the Development and additional construction is in violation of the Clean Water Act;

And whereas no building permit has been applied for or granted for the Development or any of the construction on the Property as referenced above;

Now Therefore, BE IT RESOLVED that Council does hereby authorize and direct Sandra Gautreau, Town Manager and David Taylor, Development Officer, to take all steps they deem necessary to enforce compliance with By-law No. 112, Town of Grand Bay-Westfield Zoning By-law and amendments thereto and By-law No. 114, Town of Grand Bay-Westfield Building By-law, including the laying of charges or the obtaining of an injunction or a mandatory order against Lucy Blanche Harrigan and Paul Fox as provided for in the Community Planning Act.
