1.…. CALL TO ORDER – 7:30 PMThe Town of Grand Bay-Westfield Council met in a Regular Session on Monday, May 13, 2013 with Mayor Losier presiding.
2. RECORD OF ATTENDANCEDeputy Mayor Likely, Councillor Calvin, Councillor Day, Councillor Evans, and Councillor Snodgrass were present.
3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONSCouncillor Day moved to approve the agenda of May 13, 2013 as presented with the addition of Item No. 30.a – Letter of May 10, 2013 from Douglas Hartford, P. Eng., of Dillon Consulting Re:  Street Resurfacing 2013 – Beverley Hills Drive, Frederick Street, Garden Road, Brookdale Avenue, Nelson Street, Meadowbrook Drive, Fourth Street, Grand Bay-Westfield, NB, Project No. 13-7676.Seconded by Councillor Evans.  Carried unanimously.

5. PUBLIC HEARINGS
5.1 PUBLIC HEARING RE:  PROPOSED BY-LAW NO. 117, TOWN OF GRAND BAY-WESTFIELD BY-LAW TO CLOSE CERTAIN PUBLIC STREETS AND RIGHTS OF WAYMayor Losier called three times for persons to speak in opposition to proposed By-law No. 117.  No one spoke in opposition to the proposed by-law.Mayor Losier called three times for persons to speak in favour of proposed By-law No. 117.  No one spoke in favour of the proposed by-law.

Councillor Day moved to bring forward first and second readings of proposed By-law No. 117 to the next Council meeting of May 27, 2013.

Seconded by Councillor Snodgrass.  Carried.

  PUBLIC PRESENTATIONS
6.1 PRESENTATION OF RCMP STATISTICAL REPORT FOR APRIL 2013 – RCMP REPRESENTATIVE ATTENDINGSgt. Bernard provided information to Council regarding the RCMP Statistical Report for April, 2013.Councillor Calvin moved to receive and file the RCMP Statistical Report for April, 2103.

Seconded by Councillor Evans.  Carried.

Sgt. Bernard noted he would be pleased to meet with the Town Bike/Skateboard Park Group in support of the proposed project and advise of any available funding through RCMP programs.

Sgt. Bernard requested the installation of additional speed limit signs on Woolastook Drive and possibly the installation of temporary speed bumps.  He noted he would look into obtaining the flashing rate of speed sign for Woolastook Drive.

6.2 PRESENTATION RE:  CANADA DAY 10 MILER 10K AND 5K – ALEX COFFIN, EVENT ORGANIZER PRESENTER/RECREATION DIRECTOR’S REPORT OF MAY 8, 2013Alex Coffin provided information to Council regarding the Canada Day 20 Miler 10K and 5K noting that this is the 12th year for the race and that the Westfield Scouts will again be receiving funds from the Race.Councillor Day moved to approve the proposed Canada Day 10 miler, 10 K  & 5K to be held on Monday, July 1, 2013 under provisions set out in the Town’s Traffic By-law No. 80, section 6(1) as permission and conditions of the Team Leader of the RCMP and the District Engineer of the New Brunswick Department of Transportation have been received for the proposed route along River Valley Drive and further move to sponsor a mile marker for the 10 Miler, 10K & 5K for a cost of $100.

7.1 MINUTES OF REGULAR COUNCIL MEETING OF APRIL 22, 2013Councillor Snodgrass moved to adopt the minutes of the Regular Council Meeting of April 22, 2013 as presented.Seconded by Deputy Mayor Likely.  Carried.
7.2 MINUTES OF REGIONAL SERVICE COMMISSION 9 BOARD OF DIRECTORS MEETING OF JANUARY 15, 2013/MINUTES OF FUNDY REGIONAL SERVICE COMMISSION OF FEBRUARY 13, 2013 AND MARCH 14, 2013Councillor Snodgrass moved to receive and file Minutes of Regional Service Commission 9 Board of Directors Meeting of January 15, 2013/Minutes of Fundy Regional Service Commission of February 13, 2013 and March 14, 2013.Seconded by Councillor Day.  Carried.
7.3 TENDER NOTES OF APRIL 25, 2013 RE:  LAWN MOWING TENDER NO. 13L – 2013Councillor Day moved to receive and file Tender Notes of April 25, 2013 Re:  Lawn Mowing Tender No. 13L-2013.Seconded by Councillor Snodgrass.  Carried.
7.4 MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF TUESDAY, APRIL 2, 2013Councillor Snodgrass moved to receive and file minutes of Planning Advisory Committee Meeting of April 2, 2013.Seconded by Councillor Evans.  Carried.
8. BILLS FOR PAYMENTCouncillor Day moved to pay Bills for Payment in the amount of $6,621.00 and Bills for Ratification in the amount of $211,533.19; Grand Total of $218,154.19.Seconded by Councillor Snodgrass.  Carried.

20. LETTER OF APRIL 19, 2013 FROM HON. CLAUDE WILLIAMS, MINISTER OF TRANSPORTATION AND INFRASTRUCTURE RE:  DESIGNATED HIGHWAYS PROGRAM FOR 2013Councillor Day moved to receive and file letter of April 19, 2013 from Hon. Claude Williams, Minister of Transportation and Infrastructure Re:  Designated Highways Program for 2013.Seconded by Councillor Snodgrass.  Carried.

It was noted Mr. Edward Stephenson will be notified that funding was not approved for the Town under the 2013 Designated Highway Program.

21. RECREATION DIRECTOR’S REPORT OF APRIL 26, 2013 RE:  LAWN MOWING SERVICES TENDER NO. 13L-2013Councillor Day moved to award the contract for Lawn Mowing Services to the low bidder Squeaky Kleen for the amount of $16,774.14 HST included per period, for a three year period May 2013 to October 2015 with an option to renew for an additional six (6) month period based upon mutual consent and agreement of the Town and Vendor as per Tender Number 13L-2013.Seconded by Councillor Snodgrass.  Carried.
22. FACSIMILE OF MAY 1, 2013 FROM NB MEPP PENSION BOARD RE:  SHARED RISK PLANS IN NEW BRUNSWICKCouncillor Snodgrass moved to receive and file facsimile of May 1, 2013 from NB MEPP Pension Board Re:  Shared Risk Plans in New Brunswick.Seconded by Councillor Evans. Carried.
23. TOWN MANAGER’S REPORT OF APRIL 24, 2013 RE:  STONEHAMMER GEOPARK FUNDING REQUESTCouncillor Snodgrass moved to bring forward the Geopark Funding Request of April 22, 2013 to the 2014 General Operating Fund Budget for favourable consideration of a onetime donation of $2,600.Seconded by Councillor Calvin.  Carried.

25. DEVELOPMENT OFFICER’S REPORT OF MAY 1, 2013 RE:  RIVER VALLEY MIDDLE SCHOOL RAVE RUN, 5 KM ROAD RACE AND 1 KM BEGINNERS RUNCouncillor Day moved to approve the proposed “River Valley Middle School Rave Run” to be held on Saturday June 1, 2013, beginning at the school at 11:00 am and following a course along Epworth Park Road, Inglewood Drive, and River Valley Drive as per letter received from David Shiels dated April 30, 2013, subject to permission of the Team Leader of the RCMP and the District Engineer of the New Brunswick Department of Transportation and to provide support for the event as a Kilometer Sponsor in the form of a $100.00 donation.Seconded by Councillor Snodgrass.  Carried.
26. TOWN MANAGER’S REPORT OF MAY 2, 2013 RE:  APPOINTMENT OF TOURISM COMMITTEE MEMBERDeputy Mayor Likely moved to appoint Mark Poole as a voting member of the Town Tourism Committee, effective immediately.Seconded by Councillor Evans.  Carried.
27. TOWN MANAGER’S REPORT OF MAY 2, 2013 RE:  APPOINTMENT OF AQUATIC CENTRE BOARD MEMBERCouncillor Day moved to extend the appointment of Mary Reeves as the Town’s Representative on the Aquatic Centre Board to May 31, 2013 and further moved to appoint Erin Lukie as the Town’s representative on the Aquatic Centre Board for a term effective June 1, 2013 to expire April 2016.Seconded by Councillor Snodgrass.  Carried.

MEMORANDUM OF MAY 8, 2013 FROM PLANNING ADVISORY COMMITTEE RE:  RECOMMENDATION TO COUNCIL RE:  TENTATIVE SUBDIVISION PLANS – GRAND WEST HOLDINGS LTD. – MYLES TERRACE/DEVELOPMENT OFFICER’S REPORT OF MAY 8, 2013Councillor Evans moved to accept $1,659.12 Money in Lieu of Land for Public Purposes (cash, money order, certified cheque or debit) for the purposes of creating four new building lots out of PID No. 00211870 on Myles Terrace, as shown on the Tentative Subdivision Plan, Chestnut Hills Estates Subdivision, Phase 3, as prepared by Kierstead Quigley and Roberts Ltd. dated April 26, 2013, with approval of Final Subdivision Plan to be subject to:a)payment of $1,659.12 (cash, money order, certified cheque or debit);

OF DILLON CONSULTING RE:  STREET RESURFACING 2013 – BEVERLEY HILLS DRIVE, FREDERICK STREET, GARDEN ROAD, BROOKDALE AVENUE, NELSON STREET, MEADOWBROOK DRIVE, AND FOURTH STREET, GRAND BAY-WESTFIELD, NB PROJECT NO.13-7676Councillor Day moved to award the Street Resurfacing 2013 Contract – Beverley Hills Drive, Frederick Street, Garden Road, Brookdale Avenue, Nelson Street, Meadowbrook Drive, and Fourth Street, Grand Bay-Westfield, NB Project No.13-7676 to NRB Construction Company Limited for the low tender price of $382,400.38 and to add resurfacing of Baysong Bluff to the Project subject to the Project coming in on budget.Seconded by Councillor Evans.  Carried..
