Council Minutes – November 14, 2016

 

 

1.   CALL TO ORDER – 7:30 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, November 14, 2016 with Mayor Losier presiding.

2.   RECORD OF ATTENDANCE

Deputy Mayor Likely, Councillor Balemans, Councillor Day, Councillor Evans, and Councillor Snodgrass were in attendance.

3.   APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Snodgrass moved to approve the agenda of October 24, 2016 as presented.

Seconded by Councillor Evans.  Carried.

4.   DISCLOSURE OF CONFLICT OF INTEREST

Mayor Losier declared a conflict of interest with Item #6.5:  Presentation Re:  Fourth Street/Related Facts – Robert MacKenzie Presenter.

6.   PUBLIC PRESENTATIONS

6.1   PRESENTATION RE:  KEEL CONSTRUCTION GRAVEL PIT – MARK GILLAN, PRESENTER

Mark Gillan and Maryanne Gillan provided a presentation regarding the Keel Gravel Pit and the recent blasting event.

Councillor Evans moved to receive and refer the Presentation Re:  Keel Construction Gravel Pit per Mark Gillan to Town Staff for a report to Council to include historical information regarding operations of the Keel Gravel Pit.

Seconded by Councillor Day.  Carried.

6.2   PRESENTATION RE:  BLAST VIBRATION MONITORING – BLAST REPORT – KEEL GRAVEL PIT – ROBERT CYR OF CONQUEST ENGINEERING PRESENTER

Robert Cyr of Conquest Engineering and Paul Hobart of Keel Construction provided information to Council on the recent blasting event at the Keel Gravel Pit.

Deputy Mayor Likely moved to receive and refer the Presentation Re:  Blast Vibration Monitoring – Blast Report – Keel Gravel Pit per Robert Cyr of Conquest Engineering to Town Staff for a report to Council.

Seconded by Councillor Snodgrass.  Carried.

6.3   RCMP REPORT FOR OCTOBER 2016 – RCMP REPRESENTATIVE ATTENDING

Councillor Day moved to defer the RCMP Report for October 2016 – RCMP Representative Attending to the end of the Agenda as RCMP Representative was not in attendance.

Seconded by Councillor Evans.  Carried.

6.4   PRESENTATION RE:  CONDITION OF BRANDY POINT ROAD – LAURIE MELANSON PRESENTER

Laurie Melanson provided a presentation outlining his concerns regarding the condition of Brandy Point Road.

Councillor Day moved to receive and file the Presentation Re:  Condition of Brandy Point Road – Laurie Melanson Presenter.

Seconded by Councillor Balemans.  Carried.

It was noted Town Staff would provide Mr. Melanson copies of letters sent to Brandy Point Road residents and a concept plan for Brandy Point Road.

6.5   PRESENTATION RE:  FOURTH STREET/RELATED FACTS – ROBERT MACKENZIE PRESENTER

Mayor Losier departed the meeting due to a stated conflict of interest.

Deputy Mayor Likely assumed the Chair.

Robert MacKenzie provided a presentation to Council indicating his research has determined the land from the end of pavement on Fourth Street to the water is privately owned.  Members of Council advised that the Town has a legal opinion that it does not own the land in question and the Town considers the matter concluded and a civil matter.

Councillor Evans moved to receive and file the Presentation Re:  Fourth Street/Related Facts per Robert MacKenzie.

Seconded by Councillor Snodgrass.  Carried.*

Mayor Losier rejoined the meeting.

Mayor Losier resumed the chair.

7.1    MINUTES OF REGULAR COUNCIL MEETING OF OCTOBER 24, 2016 WITH ATTACHMENT – VARIOUS FEES

Councillor Snodgrass moved to adopt the Minutes of Regular Council     Meeting of October 24, 2016 with Attachment – Various Fees, as     presented.

Seconded by Councillor Day.  Carried.

8.   BILLS FOR PAYMENT

Councillor Day moved to pay Bills for Payment as presented for $43,023.29 and Bills for Ratification for $64,917.13 for a total of $107,940.42.

Seconded by Councillor Evans.  Carried.

13.1   READING IN ITS ENTIRETY OF BY-LAW NO. 118, TOWN OF GRAND BAY-WESTFIELD BY-LAW RESPECTING THE VOLUNTEER FIRE-RESCUE DEPARTMENT

Councillor Day moved the Reading in its Entirety of By-law No. 118, Town of Grand Bay-Westfield By-law Respecting the Volunteer Fire-Rescue Department.

Seconded by Councillor Evans.  Carried.

By-law No. 118, Town of Grand Bay-Westfield By-law Respecting the Volunteer Fire-Rescue Department was read in its Entirety.

13.2   THIRD READING, BY TITLE AND ENACTMENT OF BY-LAW NO. 118, TOWN OF GRAND BAY-WESTFIELD BY-LAW RESPECTING THE GRAND BAY-WESTFIELD VOLUNTEER FIRE DEPARTMENT

Councillor Day moved the Third Reading, by Title and Enactment of By-law No. 118, Town of Grand Bay-Westfield By-law Respecting the Grand Bay-Westfield Volunteer Fire Department.

Seconded by Councillor Evans.  Carried.

By-law No. 118, Town of Grand Bay-Westfield By-law Respecting the Grand Bay-Westfield Volunteer Fire Department was read a Third time by Title.

16.   LETTER OF OCTOBER 24, 2016 FROM HON. SERGE ROUSSELLE, Q.C. R, MINISTER RE:  CLEAN WATER AND WASTEWATER FUND (“CWWF”) FUNDING CONTRIBUTION AGREEMENT, REFERENCE NO. 6990-1128

Councillor Day moved to approve appropriate signatures on the Clean     Water and Wastewater Fund (“CWWF”) Funding Contribution     Agreement, Reference No. 6990-1128, as per the Letter of October 24,     2016 from Hon. Serge Rousselle, Q.C. R, Minister.

Seconded by Councillor Snodgrass.  Carried.
 
17.   MEMORANDUM OF OCTOBER 25, 2016 FROM FCM RE: JOIN THE NATION-WIDE NETWORK:  CANADA 150 COMMUNITY LEADERS

Councillor Snodgrass moved to receive and file the Memorandum of October 25, 2016 from FCM Re: Join the Nation-Wide Network:  Canada 150 Community Leaders.

18.   LETTER OF OCTOBER 31, 2016 FROM BILL MACMACKIN, SAINT JOHN FIELDHOUSE RE:  PROPOSED FUNDING OPTION

Councillor Day moved to forward the Letter of October 31, 2016 from Bill MacMackin, Saint John Fieldhouse Re:  Proposed Funding Option to 2017 Budget deliberations.

Seconded by Councillor Evans.  Carried.

19.   EMAIL FROM DOUGLAS HARTFORD, DILLON CONSULTING LIMITED RE: REVISED FORM FOR SCF APPLICATION INTAKE/DEADLINE NOVEMBER 15, 2016

Councillor Day moved to authorize Staff to make the application under the second intake to the New Build Canada Fund (Small Communities Fund) for:

the design and construction of a community Water Play (Splash Pad);
and further moved to advise the New Build Canada Fund that this application is to take priority over any previous unsuccessful applications on file for the Town.

Seconded by Councillor Evans.  Carried.

20.   TOWN MANAGER’S REPORT OF NOVEMBER 7, 2016 RE:  SECOND COUNCIL MEETING FOR DECEMBER 2016

Councillor Day moved to cancel the second regular Council meeting of Tuesday December 27, 2016 with a Special Meeting(s) to be called as required.

Seconded by Deputy Mayor Likely.  Carried.
