Council Minutes – NOVEMBER 23, 2015

1. CALL TO ORDER – 7:35 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on     Monday, November 23, 2015 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE

Councillor Calvin, Councillor Evans, Councillor Day, Councillor Snodgrass, and Deputy Mayor Likely were in attendance.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Day moved to approve the agenda of November 23, 2015 as presented.

Seconded by Councillor Evans.  Carried.

6.1 PRESENTATION RE:  IMPERIAL THEATRE UPDATE FOR 2014 – 2015 – BARBARA KEIR, TOWN REPRESENTATIVE PRESENTER

Barbara Keir provided information regarding Imperial Theatre operations and responded to inquiries from Elected Officials.

Councillor Evans moved to receive and file the Presentation Re:  Imperial Theatre Update for 2014 – 2015 presented by Barbara Keir, Town Representative.

Seconded by Councillor Snodgrass.  Carried.

6.2 PRESENTATION RE:  ACHIEVE LITERACY, GREATER SAINT JOHN – DEBORAH FISHER, PARTNERS ASSISTING LOCAL SCHOOLS (PALS) COORDINATOR AND SUZANNE LEBLANC HEALEY, ACTING DIRECTOR OF CURRICULUM AND INSTRUCTION, ASD-S PRESENTERS

Councillor Day moved to table the Presentation Re:  Achieve Literacy, Greater Saint John – Deborah Fisher, Partners Assisting Local Schools (Pals) Coordinator and Suzanne LeBlanc Healey, Acting Director of Curriculum and Instruction, ASD-S Presenters to the December 14, 2015 agenda.

Seconded by Councillor Snodgrass.  Carried.

6.3    PRESENTATION RE:  GRAND BAY-WESTFIELD ACTIVE TRANSPORTATION PLAN – JIM SCOTT, CSLA PRESENTER

Jim Scott provided information regarding the Active Transportation Plan process and responded to inquiries from Elected Officials

Councillor Snodgrass moved to receive and file the Presentation Re:  Grand Bay-Westfield Active Transportation Plan presented by Jim Scott, CSLA.

7.1 MINUTES OF REGULAR COUNCIL MEETING OF MONDAY NOVEMBER 9, 2015

Councillor Snodgrass moved to adopt the Minutes of Regular Council Meeting of Monday November 9, 2015 as presented.

Seconded by Councillor Calvin.  Carried.

7.2 EMAIL POLL OF NOVEMBER 16, 2015 RE:  SALE OF 1999 GMC TOPKICK 8500

Councillor Day moved to authorize the sale of the 1999 GMC Topkick 8500 for $15,000 plus HST to Universal Truck & Trailer.

Seconded by Deputy Mayor Likely.  Carried.

7.3 TENDER NOTES OF NOVEMBER 18, 2015 RE:  WINTER MAINTENANCE SERVICES

Councillor Snodgrass moved to receive and file the Tender Notes of November 18, 2015 Re:  Winter Maintenance Services.

Seconded by Councillor Calvin.  Carried.

Councillor Day moved to pay Bills for Payment for $90,752.59 and Bills for Ratification for $94,973.35 for a total of $185,725.94.

Councillor Day moved to refer the Letter of October 30, 2015 from Steve Carson, CEO, Enterprise Saint John Re:  Request for Funding to 2016 budget deliberations.

17.    LETTER OF NOVEMBER 5, 2015 FROM BLISS HANSON, PRINCIPAL, WOODLAWN LEARNING CENTRE RE:  TOWN OF GRAND BAY-WESTFIELD BURSARY FUND

Councillor Snodgrass moved to receive and file the Letter of November 5, 2015 from Bliss Hanson, Principal, Woodlawn Learning Centre Re:  Town of Grand Bay-Westfield Bursary Fund.

18.    REQUEST RECEIVED NOVEMBER 17, 2015 FROM GRAND BAY-WESTFIELD ALLERGIC REACTION COMMITTEE RE:  AUTO-INJECTOR PROGRAM

Councillor Day moved to refer the Request Received November 17, 2015 from Grand Bay-Westfield Allergic Reaction Committee Re:  Auto-injector Program to 2016 budget deliberations.

19.    TOWN MANAGER’S REPORT OF NOVEMBER 17, 2015 RE:  APPOINTMENT OF LEAD PERSON FOR 2016 SCULPTURE PROJECT

Councillor Evans moved to appoint Maureen Boone as Lead Person for the 2016 Sculpture Project.

Seconded by Councillor Day.  Carried.

20.     DEVELOPMENT OFFICER’S REPORT OF NOVEMBER 18, 2015 RE:  DANGEROUS OR UNSIGHTLY PREMISES BY-LAW VIOLATION, 57 PAMDENEC ROAD, PID NO. 226589

Councillor Day moved WHEREAS John E. Lee resident of Saint John, N.B. being the owner of the property located at 57 Pamdenec Road, Grand-Bay Westfield, N.B. (PID #226589);

AND WHEREAS the condition of the building contravenes subsections 190.01(1), 190.01(1.1) and 190.01(2) of the Municipalities Act, as adopted by the Dangerous and Unsightly Premises By-Law No.115;

AND WHEREAS, in compliance with section 190.01(3) of the Municipalities Act, David Taylor, Development Officer for the Town of Grand Bay-Westfield, issued a letter by mail and by Registered mail, as well as causing the Notice to be hand delivered on October 7, 2015, advising the owner to have the dilapidated deck and stair demolished and remaining debris removed along with the Blue Buick vehicle Plate no. BZP O87 (EXPIRED STICKERS) to be removed within 30 days;

AND WHEREAS the Notice to Comply (Form 1) was served on the owner of the property on October 7, 2015, but the owner has failed to voluntarily resolve the situation;

AND WHEREAS the owner failed to observe the Notice to Comply, and did not request an appeal of the contents of the Notice within the specified time frame, being 14 days;

AND WHEREAS the owner failed to effect the remedy sought in the Notice to Comply within the 30 days specified for doing so;
AND WHEREAS on November 9, 2015, the Department of Finance was notified the Town of Grand Bay-Westfield intends to undertake the cost of demolishing the deck and stair and removal of the vehicle located at 57 Pamdenec Road, and will make a claim against the owner to recover the expense, confirmation by the Department of Finance has been received on November 13, 2015:

IT IS HEREBY RESOLVED AS FOLLOWS:

The Town of Grand Bay-Westfield authorizes Paul’s Trucking & Demolition Ltd. to proceed with the demolition and removal of the dilapidated stair and deck along with the removal of the blue Buick vehicle, Plate no. BZP O87 (EXPIRED STICKERS) located at 57 Pamdenec Road, PID No. 226589, for the amount of $1,450.00 plus HST, pursuant to sections 190.04(1)(a), 190.04(1)(a.1) and 190.04(1)(b) of the Municipalities Act.

21.    WORKS COMMISSIONER’S REPORT OF NOVEMBER 19, 2015 RE:  2016-2021 SNOW & ICE CONTROL TENDER AWARD

Councillor Snodgrass moved that Council award the tender for Snow & Ice Control and Other Winter Maintenance Services to AVL Construction Group Inc. as the low bidder for 5 (five) winter seasons 2016 to 2021 at the tendered price of $3,055,500.00 plus HST and to authorize Staff to execute a formal agreement with AVL within the required time frame.
