The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, November 25, 2013 with Mayor Losier presiding.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Day moved to approve the agenda of November 25, 2013 as presented.

6.1 PRESENTATION BY SAINT JOHN AIRPORT COMMISSION RE:  MARKETING PLAN 2014 – REQUEST FOR FUNDING – DAVID ALLEN, PRESIDENT AND CHIEF EXECUTIVE OFFICER PRESENTER

David Allen, President and CEO, Saint John Airport Commission and Angela McKay, Marketing Director provided information to Council Re:  Marketing Plan 2014 and Request for Funding.

Councillor Day moved to refer the Funding Request from the Saint John Airport Commission to the 2014 Budget Process.

Seconded by Councillor Evans.  Carried.

Phillip Reid, Area Representative on the Saint John Airport Commission was also present.

Councillor Calvin moved to adopt the minutes of the Regular Council Meeting of Tuesday November 12, 2013 as presented.

7.2 MINUTES OF EMERGENCY MEASURES ORGANIZATION (EMO) MEETINGS OF JUNE 18, 2013 AND SEPTEMBER 17, 2013/EMO TRAINING MEETINGS OF JUNE 18, 2013 AND SEPTEMBER 17, 2013

Councillor Snodgrass moved to receive and file minutes of Emergency Measures Organization (EMO) Meetings of June 18, 2013 and September 17, 2013/EMO Training Meetings of June 18, 2013 and September 17, 2013.

Councillor Day moved to pay Bills for Payment in the amount of $6,875.75 and Bills for Ratification in the amount of $76,974.70 Grand Total of $83,850.45.

Councillor Snodgrass moved to receive and have read letter of November 8, 2013 from Linda J. Scott, 2nd Vice President/Membership/Bursary Committee, Bayview Branch # 22 RCL Re:  Clearing of the Cenotaph.

17. EMAIL OF NOVEMBER 20, 2013 FROM FRANK MCCAREY, SAINT JOHN TRANSIT COMMISSION RE:  MATTER 211 – SAINT JOHN TRANSIT COMMISSION – SEEKING EXEMPTION

Councillor Snodgrass moved to receive and file email of November 20, 2013 from Frank McCarey, Saint John Transit Commission Re:  Matter 211 – Saint John Transit Commission – Seeking Exemption.

18. FIRE CHIEF’S REPORT OF NOVEMBER 20, 2013 RE:  WESTFIELD CRESCENT LICENSE AGREEMENT

Councillor Day moved to authorize appropriate signatures to renew the land license agreement between the Town and the Roman Catholic Bishop of Saint John.

19. DEVELOPMENT OFFICER’S REPORT OF NOVEMBER 20, 2013 RE:  DANGEROUS OR UNSIGHTLY PREMISES BY-LAW VIOLATION, 60 YOUNG STREET, PID NO. 00219113

Councillor Evans moved WHEREAS Kenneth Woodcock of Rothesay, N.B. is the owner of the property located at 60 Young Street, Grand-Bay Westfield, N.B. (PID #219113);

AND WHEREAS the Town is in receipt of a report from Legault Sabean Engineering Ltd. stating repair of the structure located at 60 Young Street is not practicable, and recommending demolition of same;

AND WHEREAS the condition of the building contravenes subsections 190.01(1), 190.01(1.1) and 190.01(2) of the Municipalities Act, as adopted by the Dangerous and Unsightly Premises By-Law No.115;

AND WHEREAS, in compliance with section 190.01(3) of the Municipalities Act, David Taylor, Development Officer for the Town of Grand Bay-Westfield, issued a letter on September 9, 2013, advising the owner to have the building demolished and remaining debris removed within 30 days;

AND WHEREAS the letter was served on the owner on September 11, 2013, but he failed to voluntarily resolve the situation;

AND WHEREAS the owner was served with a Notice to Comply (Form 1) on October 16, 2013;

AND WHEREAS the owner failed to observe the Notice to Comply, and did not request an appeal of the contents of the Notice within the specified time frame, being 14 days;

AND WHEREAS the owner failed to effect the remedy sought in the Notice to Comply within the 30 days specified for doing so;

AND WHEREAS on October 15, 2013, the Department of Finance was notified the Town of Grand Bay-Westfield intends to undertake the cost of demolishing the building located at 60 Young Street, and will make a claim against the owner to recover the expense:

IT IS HEREBY RESOLVED AS FOLLOWS:

The Town of Grand Bay-Westfield authorizes Maguire Excavation Ltd. to proceed with the demolition and removal of all debris from the dilapidated building located at 60 Young Street, PID No. 00219113, for the amount of $3,875 plus HST, pursuant to section 190.04(1)(b) of the Municipalities Act subject to one final notice being served on the property owner.

20. FIRE CHIEF’S REPORT OF NOVEMBER 21, 2013 RE:  RADIO EQUIPMENT SHED VANDALISM PROTECTION

Councillor Snodgrass moved to authorize staff to proceed with the installation of Kevlar Panels in the Radio Equipment Shed located on Ridge Way at a cost not to exceed $8,100.

Seconded by Councillor Day.  Carried.
