The Town of Grand Bay-Westfield Planning Advisory Committee met for a regular meeting on Monday, April 2, 2012 at 8:04 p.m. with Chair, Ralph Stevens presiding.

APPLICATION FOR VARIANCE RE: STEVE LAVOIE – 41 RIDGE WAY
(A) DEVELOPMENT OFFICER’S REPORT DATED MARCH 2, 2012
Applicant, Steve Lavoie was present and addressed the Committee as follows:
His Application for Variance is to decrease the minimum side yard setback to construct a 16 ft. wide garage; the design layout of the lot is on a diagonal, as the front is 17 ft. to 18 ft. wider than the back, so that the garage would be less than 5 ft. from the property line; there is no objection from his neighbours, as the side yard setback is on the driveway side of the lot shared with the Wesleyan Church, which is separated by a tree line; he has spoken with Pastor Dave McElhinney of the Wesleyan Church, who stated that he has no objection to this Application.
The Committee questioned Mr. Lavoie with regard to constructing the garage closer to the street and what his plans were regarding the existing shed. Also, it was stated to Mr. Lavoie the possibility of a  legal aspect with regard to having only (1) ft. at the back for maintenance purposes.
Mr. Lavoie replied that he did not wish to construct the garage up toward the street, as this would affect his driveway which is now relatively flat, and that he plans on moving the existing shed further back on the lot. With regard to maintenance at the very back, he advised that he will not be able to use his mower but that he does not foresee any problem as it is such a small area, and also due to the tree line separating the properties, which is maintained by the Church.
There was no one present speaking in favor of or against this Application.
“… moved by Ron Daigle that the Planning Advisory Committee approve the following Variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 112, for the construction of a detached garage, to be located at 41 Ridgeway, PID No. 30132468:
a)under Section 5.1.3 (b), grant a Variance of 1.2 m to decrease the minimum side yard setback of 1.5 m to 0.3 m at the rear corner of the proposed accessory building, as per submitted site plan….”
Seconded by Chyann Kirby.  Carried.
