PAC Minutes – April 3, 2000

The regular meeting of the Town of Grand Bay-Westfield Planning Advisory Committee was held Monday, April 3, 2000 at 7:00 p.m. in Room “A”.  Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:00 p.m.
1. RECORD OF ATTENDANCE
All Members were present.
2.  P.A.C. MINUTES OF MARCH 20, 2000
“…it was moved by Bill McCann and seconded by Michael Hare to accept as presented the March 20, 2000 P.A.C.  Minutes….”
Motion carried.
3.  REGULAR COUNCIL MINUTES OF MARCH 13, 2000
“…it was moved by Ralph Stevens and seconded by Mel Steffens to receive and file the March 13, 2000 Regular Council Minutes….”
Motion carried.
4. CHAIRMAN’S REMARKS
No remarks.
5. (A)   DISCLOSURE OF INTEREST FORMS
The Members filled out their Disclosure of Interest Forms.  The Secretary is to forward these forms on to the Town Manager to be put on file.
.   DECLARATION OF CONFLICT OF INTEREST
Chairman, Larry Chapman Declared a Conflict of Interest on Item # 5 Re Westfield Country Estates Subdivision and departed the meeting room.
6. DEVELOPMENT OFFICER’S REPORT DATED MARCH 30, 2000 RE: BOB DARLING – TENTATIVE SUBDIVISION APPROVAL WESTFIELD COUNTRY ESTATES SUBDIVISION, PHASE 2 SUBDIVISION PLAN DATED MARCH 29, 2000
Vice-Chairman, Ralph Stevens conducted the meeting during the Closed Session discussion.
Development Officer, David Taylor informed the Committee that the Applicant, Bob Darling has a conditional offer of sale, however, he should present a letter stating he would be representing owner, Peter Auvinen.  David also stated letters have not been forwarded to the adjacent property owners as yet, and there are areas of the revised proposal that must be considered further.  The Committee concurred with his recommendation to Table discussion on this item.
Chairman, Larry Chapman returned to the meeting room and sat in the seating area as an interested party during the Open Session.  Applicant, Bob Darling and Surveyor, Ed DeSaulniers were present for the Open Session.
Some questions were put to Mr. Darling, in particular ownership of this property.  He informed the Committee that he has made a conditional offer to purchase the property from its present owner, however, he was advised by the Committee that he requires a letter from the present owner, Peter Auvinen/Country Club Estates, in order for the Committee to consider this Proposal.  Ed DeSaluniers then gave a brief presentation to the Committee of this Proposal.
The following motion was then made:
“…it was moved by Mel Steffens and seconded by Bill McCann that P.A.C. Table this item to the next meeting, April 17th, in order to obtain further details….”
Motion carried.
Applicant, Bob Darling then requested if it was possible for him to obtain a Building Permit the next day in order to build one home on Block “A”.  Following a brief discussion, he was advised that he could make Application.
Chairman, Larry Chapman then resumed the Chair for the remainder of the meeting.
7.  DEVELOPMENT OFFICER’S REPORT DATED MARCH 27, 2000 RE: REQUEST FOR TEMPORARY SIGNAGE WESTFIELD UNITED CHURCH – 133 NEREPIS ROAD
A discussion was held in Closed Session regarding the above Request for Temporary Signage to be erected on the above Town property to advertise fund raising events.  The Chairman brought to the Committee’s attention the fact that the Development Officer’s recommendation in his Report did not have the proper wording as set out in P.A.C.’s Policy.  It was the consensus of the Committee that the proper wording be used.
The development Officer informed the Committee that there would be no representation from the Westfield United Church this evening.  The following motion was then made:
“…it was moved by Bill McCann and seconded by Ralph Stevens that P.A.C. grant a Temporary Use Permit for the Westfield United Church to place T-1 temporary low level signs on property located at 133 Nerepis Road, NBGIC No. 00229187 subject to:
1. conditions set out under section 70 of the Town’s Zoning By-law, Division I and approved by the Development Officer for each application for such signage;
2. the termination of the development (temporary signage) is required after a maximum of 14 days for each signage permit that is issued, to a maximum of 6 times during the year 2000.
Pursuant to Section 4(2), Division II of the Town’s By-law No. 16, Town of Grand Bay-Westfield Zoning By-law, authoriztion for the development described above (temporary signage) is hereby granted for the temporary period of April 3, 2000, expiring on December 31, 2000.  At the end of the authorized period, you  (Westfield United Church) are hereby required to terminate or remove the development (temporary signage) hereby authorized….”
Motion carried.
8. DEVELOPMENT OFFICER’S REPORT DATED MARCH 27, 2000 RE: REQUEST FOR TEMPORARY SIGNAGE THE NEIGHBOURHOOD THEATRE COMPANY – 150 NEREPIS ROAD
A Closed Session discussion was held regarding the above Request for Temporary Signage to be erected on Town property advertising Theatre Productions. It was the consensus of the Committee that the same wording be used as in Item  No. 6.
There was no one present from the Theatre Company during the Open Session when the following motion was made:
“…it was moved by Bill McCann and seconded by Ralph Stevens that P.A.C. grant a Temporary Use Permit, for The Neighbourhood Theatre Company to place T-1 temporary low level signs on Town owned property located at 150 Nerepis Road, NBGIC No. 00211805, subject to:
1. conditions set out under Section 70 of the Town’s Zoning By-law, Division I, and approval by the Development Officer for each application for each signage;
2. the termination of the development (temporary signage) is required after a maximum of 14 days for each signage permit issued, to a maximum of 5 times during the year 2000.
Pursuant to Section 4(2), Division II of the Town’s By-law No. 16, Town of Grand Bay-Westfield Zoning By-law, authorization for the development described above (temporary signage) is hereby granted for the temporary period of April 3, 2000, expiring on December 31, 2000.  At the end of the authorized period, you (The Neighbourhood Theatre Company) are hereby required to terminate or remove the development (temporary signage) hereby authorized….”  Motion carried.
9. DEVELOPMENT OFFICER’S REPORT DATED MARCH 17, 2000 RE: REPORT ON DEVELOPMENT CONCERNS
The Development Officer advised that this Report is for those Committee Members who were not present during the informal meeting with the Developers on March 28, 2000.
“…it was moved by Ralph Stevens and seconded by Deputy Mayor Black to receive and file the above Report….”  Motion carried.
10. DEVELOPMENT OFFICER’S MEMO DATED MARCH 29, 2000 RE: INFORMAL MEETING WITH DEVELOPERS, MARCH 29, 2000
The Development Officer advised that this item is in conjunction with Item No. 8.
“…it was moved by Ralph Stevens and seconded by Mel Steffens to receive and file the above memo….”
Motion carried.
11. DEVELOPMENT OFFICER’S MEMO DATED MARCH 30, 2000 RE: CALCULATION OF GRADES ON BUILDING HEIGHTS & LOT AREA
A brief discussion was held regarding a point raised by Mel Steffens regarding the effects of grades on development of land.  The Development Officer reported that the new by-law will address this matter by restricting the creation of a building lot not suitable for building.

12.  LETTER FROM  MICHAEL G. HARE TO LARRY CHAPMAN DATED MARCH 20, 2000  RE PROPOSED AMENDMENT TO BY-LAW NO. 6
A group discussion was held regarding Michael’s recommendation in his letter regarding a proposed amendment to By-law No. 6(b), amendment to By-law No. 6, Respecting Disturbance By Noise to include snow blowers.
The following motion was then  made:
“…it was moved by Ralph Stevens and seconded by James Evans that this item be Tabled until such time the Development Officer researchs other By-laws….”
Motion carried.
13. ADJOURNMENT
Ralph Stevens moved to adjourn at 8:50 p.m.
