PAC Minutes – August 4, 2005

1. CALL TO ORDER
The Town of Grand Bay-Westfield Planning Advisory Committee met for a Special Meeting meeting on Thursday, August 4, 2005 at 8:06 p.m., with Chairman, Larry Chapman presiding.
2. RECORD OF ATTENDANCE
All Members were present.  Works Commissioner, Bruce Gault was present, filling in for vacationing Development Officer, David Taylor.
3. PLANNING ADVISORY COMMITTEE MINUTES OF JULY 18, 2005

4. REGULAR COUNCIL MINUTES OF JUNE 27, 2005
“…moved by Ralph Stevens to receive and file the Regular Council Minutes of  June 27, 2005 ….”
Seconded by Jim Burke.  Carried.
5. CHAIRMAN’S REMARKS
The Chairman advised that the Committee is in receipt of a letter from Member, James Evans dated July 18, 2005, requesting an extended leave of absence for meetings scheduled for September and October, 2005.

7. APPLICATION FOR VARIANCE RE: SAM MAGUIRE –   FLORENCE DRIVE
(A) DEVELOPMENT OFFICER’S REPORT DATED JULY 26, 2005
There was no one present speaking in favor of or against this Application.
“…moved by Ralph Stevens that the Planning Advisory Committee grant the following variance to the Town on Grand Bay-Westfield Zoning By-law, By-law No. 101, for the development of a single family dwelling to be located on existing PID no 00220913:
i) under section 8.2.2.3(b), grant a variance of 3 m to reduce the minimum lot frontage from 23 m to 20 m;
subject to:
a) the proposed building to be located so as to sufficiently meet all minimum set back requirements on the proposed Lot E-5, as shown on the Tentative Subdivision Plan prepared by Kierstead, Quigley & Roberts Ltd. dated May 9, 2005, without further variances being required after the subdivision is registered to create the lot;
b) approval by the Department of Health for construction of a dwelling without septic tank and field with the consideration that sanitary sewer services will be provided prior to occupancy of the dwelling …”

DEVELOPMENT OFFICER’S MEMO DATED JULY 26, 2005 RE: TENTATIVE SUBDIVISION APPROVAL  PANORAMIC ESTATES SUBDIVISION, PHASE 3
“…moved by Ralph Stevens to grant approvals as previously granted by the Committee on and recommend to Council to reconsider the previous recommendations provided from the Planning Advisory Committee concerning street design and Land for Public Purposes for Tentative Subdivision Plan, Panoramic Estates Subdivision, Phase 3, as prepared by Kierstead Quigley& Roberts Ltd., plan dated May 9, 2005….”
Seconded by James Evans.  Carried.
9. APPLICATION FOR TENTATIVE SUBDIVISION APPROVAL RE: WILLIAM & SHIRLEY SILLIPHANT LOT 2005-2 – 289 INGLEWOOD DRIVE
(A) DEVELOPMENT OFFICER’S REPORT DATED JULY 28, 2005
(B) LETTER DATED JULY 28, 2005 FROM JAMES ELGEE & JENNIFER DAY-ELGEE
Concerned property owner, James Elgee was present, speaking against the above mentioned Application.  Mr. Elgee again reiterated his concerns addressed in his July 28, 2005 letter, in particular the possible effects to the water table in that area should this variance be granted.
The Chairman thanked Mr. Elgee for attending and expressing his concerns, however advised that the Applicant is adhering to the present Provincial Standards with regard to ground water.
1. “…moved by Jim Burke that the Planning Advisory Committee grant the following Variances to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law 101, for the creation of one new building lot out of PID No. 30224026 located at 289 Inglewood Drive as shown on the Tentative Subdivision Plan, William & Shirley Silliphant Subdivision, Lot 2005-2 as prepared by DeSaulniers Surveys Inc. dated July 8, 2005:
a) under Section 8.2.1.3(b) grant a variance of 10.75m to reduce the minimum lot frontage on lot 2005-2 from 23.0m to 12.25m….”
2. “…moved that the Planning Advisory Committee recommend to Council the acceptance of $625.48 money in lieu of Land for Public Purposes (cash, money order, or certified cheque) for the purposes of creating one new building lot as shown on the Tentative Subdivision Plan, William & Shirley Silliphant Subdivision, Lot 2005-2 as prepared by DeSaulniers Surveys Inc. dated July 8, 2005, with approval of final Subdivision Plan to be subject to:
a) payment of $625.48 (cash, money order, or certified cheque);
b) any utility easements as required by NB Power & NB Tel for servicing lot to be recorded on the Final Plan…..”
Seconded by Ralph Sevens.  Carried.
