PAC Minutes – August 8, 2000

The regular meeting of the Town of Grand Bay-Westfield Planning Advisory Committee was held Tuesday, August 8, 2000 at 7:00 p.m. in Room “A”.  Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:07 p.m.
1. RECORD OF ATTENDANCE
All Members were present with the exception of Bill McCann.
2.  P.A.C. MINUTES OF JULY 17, 2000
“…it was moved by Mel Steffens and seconded by Jim Evans to accept as presented the July 17, 2000 P.A.C.  Minutes….”
Motion carried.
3. REGULAR COUNCIL MINUTES OF JUNE 26, 2000
“…it was moved by Ralph Stevens and seconded by Deputy Mayor Black to receive and file the June 26, 2000 Regular Council Minutes….”
Motion carried.
4. CHAIRMAN’S REMARKS
No remarks.
5. DECLARATION OF CONFLICT OF INTEREST
No Conflict of Interest declared.
6.  DEVELOPMENT OFFICER’S REPORT DATED AUGUST 1, 2000 RE: REQUEST FOR TEMPORARY USE PERMIT FOR SIGNAGE NEREPIS WOMEN’S INSTITUTE – 655 NEREPIS ROAD
During the Closed Session discussion, the Committee concurred with the Development Officer’s recommendations found in his report.
There was no representation from the Nerepis Women’s Institute during the Open Session when the following motion was made:
“…moved by Deputy Mayor Black that P.A.C. Grant a Temporary Use Permit for the Nerepis Women’s Institute to place a T-1 temporary low level sign on property located at 655 Nerepis Road, NBGIC No. 00215020, subject to:
a) conditions set out under Section 70 of the Town’s Zoning By-law, Division I;
b) approval by the Development Officer for each application for such signage.
Pursuant to Section 4(2), of the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division II, authorization for the development described above (temporary signage) is hereby granted for a maximum of 6 applications for up to 14 days duration, throughout the period beginning August 9, 2000, expiring December 31, 2000. At the end of the authorized period, you (Nerepis Women’s Institute) are hereby required to terminate or remove the development (temporary signage) hereby authorized….”    Motion seconded by Ralph Stevens.  Motion carried.
7.  DEVELOPMENT OFFICER’S REPORT DATED JULY 31, 2000 RE: REQUEST FOR VARIANCE TERRY & NICOLE MILLER – 22 THOMPSON ROAD
A Closed Session discussion was held regarding the above Request for Variance to permit the continued use of the top portion of the accessory building as a single family dwelling, requiring variances on the use of an accessory building and size of dwelling.  The Committee did not concur with the Development Officer’s recommendations found in his report.
Applicant, Terry Miller was present during the Open Session.  There was no one present in support of or objecting to the application when the following motion was made:
“…moved by Deputy Mayor Black and seconded by Jim Evans to deny the Variances….”
Motion carried.
8. DEVELOPMENT OFFICER’S REPORT DATED JULY 24, 2000 RE: REQUEST FOR VARIANCE MAURICE BROOKS – 3 WILLOW LANE
A Closed Session discussion was held regarding the above Request for Variance to permit the construction of a new garage, requiring a variance on the front yard set back.  The Members concurred with the Development Officer’s recommendations found in his report, however, wished to add a stipulation regarding the type of exterior finish and time line for completion of the garage.
Applicant, Maurice Brooks was present during the Open Session.  There was no one present in support of or objecting to the application when the following motion was made:
“…moved by Jim Evans that P.A.C. grant a Variance of 2.3 metres to reduce the front yard set back from 7.5 metres to 5.2 metres, as set out in Section 15(b)(1) of the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division 1, for the development of a detached garage, to be located at 3 Willow Lane, NBGIC No. 00466763, subject to:
(a) the garage to be finished with vinyl siding within one year from obtaining a Building Permit….”
Motion seconded by Mel Steffens. Carried.
9. DEVELOPMENT OFFICER’S REPORT DATED AUGUST 1, 2000 RE: REQUEST FOR VARIANCE JEFF TRACY – 8 HILLSIDE ROAD
A Closed Session discussion was held regarding the above Request for Variance to permit the construction of a new single family dwelling with foundation below center line of street, requiring a variance on the elevation of a new residential structure.  The Committee concurred with the Development Officer’s recommendations found in his report.
Applicant, Jeff Tracy was not present during the Open Session.  However, the following two surrounding property owners were present:

  • Robert McLaughlin of 9 Hillside Road –

Mr. McLaughlin spoke in favor of the proposal and is happy with what Mr. Tracy is doing with the property.

  • Robert Dryden of 2 Points Road –

Mr. Dryden advised that he is also in favor of the proposal and wants the Variance granted, as he feels if not granted will decrease the value of property.
The following motion was then made:
“…moved by Mel Steffens that P.A.C. grant the following Variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division I, for the development proposed for 8 Hillside Road, NBGIC No. 00227405, as follows:
1. grant a Variance to Section 80 of 2.55 metres, to allow the construction of a single Family Residence, to have the top of the foundation wall set 1.8 metres below center line elevation of the street, subject to:
a) positive slope of grade and drainage away from the foundation and well to prevent water build up or penetration into basement level of the home within 6 metres of the building;
b) the property owner be responsible to connect to the Municipal   Sewer System on Hillside Road by gravity or lift pump in the future if  a problem occurs with the sewer lateral at the rear of the property;
c) sanitary sewer connection shall be allowed on existing lateral, however, should the need arise, connection by gravity or a pump to   Hillside Road will be the responsibility of the property owner….”
Motion seconded by Ralph Stevens.  Carried.
10. FOR INFORMATION AND DISCUSSION MEMO FROM DEVELOPMENT OFFICER DATED JULY 18, 2000 RE: RULES OF PROCEDURE
Following a brief discussion, the following motion was made:
“…moved by Ralph Stevens and seconded by Jim Evans to receive and file the above memo….”
Motion carried.
11.  FOR INFORMATION AND DISCUSSION MEMO FROM DEVELOPMENT OFFICER DATED JULY 27, 2000 RE: MUNICIPAL PLAN REPEALED 1984
Following a brief discussion, the following motion was made:
“…moved by Jim Evans and seconded by Mel Steffens to receive and file the above memo….”
Motion carried.
12.  FOR INFORMATION AND  DISCUSSION RE: LETTER TO DEVELOPMENT OFFICER DATED JULY 31, 2000 FROM PROVINCE, MAINTENANCE & TRAFFIC BRANCH
Following a brief discussion, the following motion was made:
“…moved by Mel Steffens and seconded by Deputy Mayor Black to receive and file the above information.
Motion carried.
