The Grand Bay-Westfield Planning Advisory Committee met for a regular meeting on Monday, December 1, 2003 at 8:02 p.m. in the Multi-Purpose Room, 609 River Valley Drive with Chairman, Larry Chapman presiding.

DEVELOPMENT OFFICER’S REPORT DATED NOVEMBER 24, 2003 RE: APPLICATION FOR VARIANCE ROBIN & KIMBERLEY COSMAN – 20 BEVERLEY HILLS DRIVE
(A) LETTER FROM K. M. GOODWIN DATED NOVEMBER 24, 2003
(B) LETTER FROM ERIC & LOUISE JOHNSON DATED NOVEMBER 24, 2003
(C) LETTER FROM GREG & LISA COLLETTE RECEIVED NOVEMBER 27. 2003
Three letters were received from neighbouring property owners as follows:

(A)

K. M. Goodwin – letter of opposition to this proposal as the structure will reduce the value of his property and other properties in the neighbourhood.
(B)
.
Eric & Louise Johnson – letter of opposition to the location of the shed, as they feel it will take away from the continuity of the street and could become a factor at a later date with regard to the sale of their property.
(C)
.
Greg & Lisa Collette – letter of opposition having concerns that leaving the building in place will result in continued untidiness of the property.

Applicant, Robin Cosman was present to speak to the Committee but offered no further details or plan to illustrate his application.
Due to the fact that Questions #10 and #11 were not filled in on the Application for Variance Form, the Chairman asked Mr.Cosman if he wouldn’t mind answering them for the Committee.

  • Question 10 – Explain why you cannot carry out your proposal without obtaining a Variance.
  • He feels he does not have the room to place the building any where else on the lot,
  • He cannot place it at the back of his property as he has only 12 ft. from the foundation to the drop off at the back;
  • In order to place the building at the side of his property, more fill would be required and he would not be able to walk between the house and the building;
  • The building is 10 ft. x 12 ft. and positioned with the 12 ft. side facing the street.
  • Question 11 – How do you think your proposal will affect other properties?
  • He feels it will not affect other property owners as he has painted the building to match his house;
  • there are large pine trees at the back of the shed, planted on the adjacent property;
  • he plans to erect a small retaining wall and plant shrubs in front of the shed to hide the view from the street.

There was no one else present speaking in favor of this Proposal.

Mr. K. Goodwin was present to speak in opposition to this Proposal, for reasons referenced in his letter dated November 24, 2003.  He also added that he does not see any physical reason why the shed could not be located in the rear yard and offered the use of his own driveway to give better access in re-locating the shed.
The following motion was then made:
“…moved by James Evans that the Planning Advisory Committee Deny Request for Variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 101, for the development of an accessory building at 20 Beverley Hills Drive,  PID No. 30085013 within the required front yard and side yard setbacks….”
Motion seconded by Ralph Stevens.  Carried.
9. ADJOURNMENT
