PAC Minutes – December 16, 2002

The regular meeting of the Grand Bay-Westfield Planning Advisory Committee was held Monday, December 16, 2002 in Room “A”, 609 River Valley Drive.   Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:10 p.m.
1. RECORD OF ATTENDANCE
All Members were present with the exception of Andrew Shaw.
2. PLANNING ADVISORY COMMITTEE MINUTES OF DECEMBER2, 2002
“…moved by Ralph Stevens to accept as presented the December 2, 2002 Planning Advisory Committee Minutes….”
Motion seconded by Cllr. Little.  Carried.
3. REGULAR COUNCIL MINUTES OF NOVEMBER 25, 2002
“…moved by Mel Steffens to receive and file the Regular Council Minutes of November 25, 2002….”
Motion seconded by Cllr. Little.  Carried.
4. CHAIRMAN’S REMARKS

  • The Chairman thanked the Committee for the honor of serving as Chairman for the past 12 months and requested that the Secretary put the Election of Officers on the January 6, 2003 meeting Agenda after Declaration of Conflict of Interest.
  • By Resolution of Council December 9, 2002, Larry Chapman and Jim Burke have been appointed to the Planning Advisory Committee for 3-year terms, commencing January 1, 2003.

5. DECLARATION OF CONFLICT OF INTEREST
No conflicts declared.
6. DEVELOPMENT OFFICER’S REPORT DATED DECEMBER 12, 2002  RE: APPLICATION FOR VARIANCE – ART LEGACY – 215 HIGHLAND ROAD
A discussion was held during Closed Session regarding Application for Variance to construct an attached garage, requiring a variance on the side yard set back.
The Secretary advised that the Applicant would not be attending this evening.
There were no presentations made in favor of or against this Application.
The following motion was made:
“…moved by Ralph Stevens that the Planning Advisory Committee grant the following variance for the development of an attached garage for the single family residence located at 215 Highland Road, identified by PID No. 00472852;
a)  under section 13(b) of the Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division 1, grant a variance of 1.0 m, reducing the side yard setback requirements from 3.5 m to 2.5 m….”
Motion seconded by Mel Steffens.  Carried.
7.  DEVELOPMENT OFFICER’S REPORT DATED DECEMBER 12, 2002  RE:  APPLICATION FOR VARIANCE – ALLAN TROTT – 178 RIVER VALLEY DRIVE
(A) LETTER FROM SANDRA PARKER SHORT DATED DECEMBER 12, 2002
A discussion was held in Closed Session regarding Application for Variance to construct an accessory building, requiring a variance to the set back from the side yard property line for an accessory building.
Applicant, Allan Trott was present during the Open Session and advised the Committee of the following:

  • he has talked to his neighbour Leslie Short and advised him that he does not anticipate any change in the flow of water along the property line;
  • he plans on bringing in up to 4 ft. of fill to raise the garage to driveway level;
  • proposes concrete slab on top of the compacted fill;
  • the building is planned to be constructed to the rear of the existing retaining wall.

Neighbours, Leslie and Sandra Short of 174 River Valley Drive were in attendance and gave the following presentation:

  • they are not against the garage, but concerned by the close proximity to their property;
  • they have drain pipes along the property line (covered with rocks) that may be affected/disturbed;
  • concerned with amount of water that may be directed towards their property.

The following motion was then made:
…moved by Ralph Stevens that the Planning Advisory Committee grant the following request for variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division I, for the proposed construction of an accessory building on the property located at 178 River Valley Drive, PID No. 00219147;
a)   under section 42(b)(ii), grant a variance of 0.5 m to reduce the minimum setback from the property line from 1.5 m to 1.0 m… ”
Motion seconded by James Evans.  Carried.
8. ADJOURNMENT
Ralph Stevens moved to adjourn at 7:45 p.m.
Motion seconded by Cllr. Little.  Carried.
