PAC Minutes – February 5, 2001

The regular meeting of the Grand Bay-Westfield Planning Advisory Committee was held  February 5, 2001 in Room “A”, 609 River Valley Drive.  Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:00 p.m.
1. RECORD OF ATTENDANCE
All Members were present.
2. P.A.C. MINUTES OF JANUARY 15, 2001 MEETING
An amendment was made to the January 15, 2001 Minutes and the following motion was made:
“…moved by Bill McCann to accept as amended the January 15, 2001 P.A.C. Minutes….”  Motion seconded by Deputy Mayor Black.  Carried.
3. REGULAR COUNCIL MINUTES OF JANUARY 8, 2001 MEETING
The following motion was made:
“…moved by Ralph Stevens to receive and file the January 8, 2001 Regular Council Minutes….”  Motion seconded by James Evans.  Carried.
4. CHAIRMAN’S REMARKS
The Chairman inquired on how James Evans’ presentation to Council was received with regard to his Draft Proposal, Highland Road Access Study, “Option No. 2”.  Mr. Evans reported that he felt it went well, and that a motion was made to forward the information on to the Municipal Plan By-law and Zoning By-law Review.  Deputy Mayor Black remarked that the presentation was appreciated by Council.
Upon Bill McCann’s request, a brief discussion was held with regard to various temporary signs erected in the Town.  The Development Officer reported on the status of the signs in question.
5. DECLARATION OF CONFLICT OF INTEREST
No conflict of interest declared.
6. DEVELOPMENT OFFICER’S MEMO DATED JANUARY 30, 2001 RE: REQUEST FOR VARIANCE WILLIAM MCKEOWN – 469 NEREPIS ROAD
A Closed Session discussion was held regarding the above Application to develop a single family residence, requiring Variances on the lot width and lot access, and recommendation to Council for development.
A copy of a letter received from Applicant, Bill McKeown dated February 4, 2001, making a formal Variance Application was given out to each Member.  The Development Officer explained that initially, he did not see this as being a Variance Application but rather a recommendation to Council on approval of street access to the lot.  The Development Officer advised that the owner of 465 Nerepis Road, Brent Graham, reviewed the Proposal by phone and did not have concerns to bring to the Committee.
The Committee had the following concerns:

  • Discrepancy as to ownership of the land in question – The Development Officer advised that at the time of the Registered Plan back in 1971, it was Stanley Lingley.
  • Ownership of the Reserve Road – The Development Officer advised that this is on the property owned by James Snodgrass and Tanya Savoy, 461 Nerepis Road and is privately maintained by Mr. McKeown and Brent Graham.
  • Physical location of the existing houses – The Development Officer indicated the location of the three existing homes.  In addition, he reviewed differences between maps, stating that the computer map from NBGIC is not shown correctly as it has been mapped improperly.

Applicant, William McKeown was present during the Open Session.  No presentations were made in favor or against the Proposal.  The Committee questioned Mr. McKeown as to the following:

  • Area of his lot – Mr. McKeown advised he has 53 1/2 acres.  The Development Officer informed the Committee that no lot is being created, as this is an existing lot.
  • Ownership of  66 foot Right of Way – Mr. McKeown advised that all the properties adjacent to the Reserve Road have the right of way indicated in their deeds.

The following motion was made:
“…moved by Bill McCann to have:
1.   the Planning Advisory Committee grant the following variances for the development of a single family dwelling on a parcel of land identified by NBGIC No. 00210443:
i) under section 10 (2) (a) (i) of the Town of Grand Bay-Westfield By-law No. 16, Division 2, a variance of 34 m, reducing the lot width from 54 m to 20 m, subject to approval by the Department of Health for a variance to the regulations under the Health Act;
ii) under section 45 of the Town of Grand Bay-Westfield By-law No. 16, Division 2, a variance to allow permitted uses on the said  lot abutting an access other than a street, subject to Council accepting the recommendation from the Planning Advisory Committee to approve the private access under section 3 (1) of the Town of Grand Bay-Westfield By-law No. 16, Division 2;
subject further to:
a) restriction of development of any dwelling or structure located within a 9 m set back south of a prolongation of the 20 m right of way, for at least the depth of the lot identified by NBGIC no. 00462002.
2. The Planning Advisory Committee recommends to Council to approve the private access under section 3 (1) of the Town of Grand Bay-Westfield By-law No. 16, Division 2, by way of an existing 20 m wide right of way for the development of a single family dwelling on a parcel of land identified by NBGIC No. 00210443….”
Motion seconded by Ralph Stevens.  Carried.
The Chairman thanked Mr. McKeown for attending, stating that he will receive a letter from P.A.C. within a few days depicting the motion made, and that the item most likely will be on the next Council Meeting Agenda.  However, it was recommended to him that he contact the Town Office to confirm this.
7.  DEVELOPMENT OFFICER’S MEMO DATED JANUARY 30, 2001 RE: DEVELOPMENT STANDARDS RE REFERENCE TO 100   BRANDY POINT ROAD AT P.A.C. MEETING OF JANUARY 15, 2001
The Development Officer reviewed with the Committee the information contained in his memo and gave a history of the property in question.
The following motion was made:
“…moved by Bill McCann to receive and file the Development Officer’s Memo Dated January 30, 2001, Re: Development Standards to 100 Brandy Point Road….”  Motion seconded by Ralph Stevens.  Carried.
8. ADJOURNMENT
Ralph Stevens moved to adjourn at 7:40 p.m.
