PAC Minutes – July 15, 2002

The regular meeting of the Grand Bay-Westfield Planning Advisory Committee was held Monday, July 15, 2002 in Room “A”, 609 River Valley Drive.   Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:06 p.m.
1. RECORD OF ATTENDANCE
All Members were present, with the exception of Andrew Shaw.
2.  PLANNING ADVISORY COMMITTEE MINUTES OF JULY 2/02

Motion seconded by  Michael Hare.  Carried.
3. CHAIRMAN’S REMARKS
Two cards of sympathy were passed around for the Members to sign to be sent to the family of the late Cllr. Everett Calvin, and also to his brother, David Calvin and family.
4. DECLARATION OF CONFLICT OF INTEREST
Chairman, Larry Chapman declared a conflict of interest Re:  Item No. 5 – Application for Tentative Subdivision Approval – Robert & Joy MacKinnon, Country Club Drive.
5. REVISED RULES OF PROCEDURE OF THE PLANNING ADVISORY COMMITTEE AND APPLICATION FOR VARIANCE
“…moved by Ralph Stevens to adopt the revised Rules of Procedure of the Planning Advisory Committee and Application for Variance….”
Motion seconded by Michael Hare.  Carried.
6. DEVELOPMENT OFFICER’S REPORT DATED JULY 11, 2002 RE:   APPLICATION FOR TENTATIVE SUBDIVISION APPROVAL – ROBERT & JOY MACKINNON, COUNTRY CLUB DRIVE – PID NOS. 00227702 / 30188734
Chairman, Larry Chapman departed the meeting room during the Closed Session discussion and Vice-Chairman, Ralph Stevens assumed the chair for the remainder of the meeting.
The Development Officer reported that this Application is for reconfiguration of two existing lots and the creation of one new lot, requiring variances  to all lot frontages and also recommendation to Council for Land for Public Purposes for the creation of one new building lot.
Applicant, Robert MacKinnon was present during the Open Session and advised the Committee of the following:

  • The tentative drawing does not show a 5 metre treed buffer zone to be maintained along the edge of the property line, which he has discussed with the surrounding property owners;
  • he is keeping the large lot for himself;
  • the name of the subdivision is to be “MacKinnon Subdivision”.

The following property owners gave presentation in favor of the Proposal:

  • Larry Chapman – 19 Country Club Drive
  • Ruth Anne Phinney – 17 Country Club Drive
  • Roy Morris – 16 Country Club Drive

There were no presentations made against this Proposal.
The following motions were then made:

  1. “…moved by Michael Hare that the Planning Advisory Committee grant the following variances to the Grand Bay-Westfield Zoning By-law, By-law No. 16, Division 2, for Tentative Subdivision Plan, Westfield Country Estates Subdivision, Phase 2, Lot 2002-1 and Lot 2002-2, Country Club Drive, Town of Grand Bay Westfield, Kings County, New Brunswick, as prepared by DeSaulniers Surveys Inc., dated

July 2, 2002:
i) under section 10(2)(a)(i), grant a variance of 21.46 m for Lot 2002-2 to reduce the minimum calculated lot width from 54 m to 32.54 m;
ii) under section 10(2)(a)(i), grant a variance of  24.92 m for Lot 2002-1 to reduce the minimum calculated lot width from 54 m to 29.08 m;
iii) under section 10(2)(a)(i), grant a variance of  31.12 m to remnant lot PID No. 00227702, to reduce the minimum calculated lot width from 54 m to 22.88 m;
subject to:
(a) the Final Plan to be referred to as the “Mackinnon      Subdivision”;
(b) the Final Plan to record NB Tel and NB Power Easements as required;
(c) completion of land aquisition from Town as per approved conditional offer in response to Proposal Call 2002-01;
(d) noted on plan the provision of a 5 m wide development restriction to act as a buffer to be maintained on the eastern property line between the present lot PID # 30188734 and lot identified by PID # 30188726;
(e) noted on plan the provision of a 5 m wide development restriction to act as a buffer to be maintained on the southern property line between the present lot PID # 30188734 and lot identified by PID #00210773;
(f) noted on plan the provision of a 5 m wide development restriction to act as a buffer to be maintained on the southern property line between the present lot PID # 00227702 and existing lot identified by PID # 30100770;
(g) noted on plan the provision of a 5 m wide development restriction to act as a buffer to be maintained on the eastern property line between the present lot PID # 00227702 and existing lot identified by PID # 30100754;
(h) acceptance by Council of money in lieu of Land for Public Purposes.
AND
“…move that the Planning Advisory Committee recommend to Council to accept the amount of $59.88 (cash, money order or certified cheque) for money in lieu of Land for Public Purposes for the creation of one new Building lot as shown on Tentative Subdivision Plan, Westfield Country Estates Subdivision, Phase 2, Lot 2002-1 and Lot 2002-2, Country Club Drive, Town of Grand Bay Westfield, Kings County, New Brunswick, as prepared by DeSaulniers Surveys Inc., dated July 2, 2002;
Tentative Approval shall be granted by the Development Officer subject to Council’s approval of the $59.88 (cash, money order or certified cheque) as money in lieu of Land for Public Purposes; and
Final Approval of the Subdivision Plan may be granted by the Development Officer,
subject to:
a) the completion of the terms of Proposal Call 2002-01 for the sale of PID # 30188734, with all applicable documents registered to the satisfaction of the Town Solicitor;
b) the receipt of the $59.88 (cash, money order or certified cheque) in lieu of Land for Public Purposes ….”
Motions seconded by Mel Steffens.  Carried.
