PAC Minutes – July 3, 2001

The regular meeting of the Grand Bay-Westfield Planning Advisory Committee was held Tuesday, July 3, 2001 in Room “A”, 609 River Valley Drive.   Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:04 p.m.
1. RECORD OF ATTENDANCE
All Members were present with the exception of Bill McCann and Michael Hare.
2. PLANNING ADVISORY COMMITTEE MINUTES OF JUNE 18, 2001
“…moved by Mel Steffens to accept as presented the June 18, 2001 Planning Advisory Committee Minutes….”
Motion seconded by Ralph Stevens.  Carried.
3. REGULAR COUNCIL MEETING MINUTES OF JUNE 11, 2001
“…moved by Ralph Stevens to receive and file the June 11, 2001  Council Minutes….”
Motion seconded by James Evans.  Carried.
4. CHAIRMAN’S REMARKS
The Chairman welcomed Ralph Stevens back to P.A.C.
5. DECLARATION OF CONFLICT OF INTEREST
Chairman, Larry Chapman declared a Conflict of Interest on Item No. 7 Re:  Request for Variance – Earl Hart & Olive Curtis, 440 Woolastook Drive.
6. ITEM TABLED JUNE 18, 2001 MEETING RE:   REQUEST FOR VARIANCE PAUL LYNCH – 29 RIDGE WAY
A Closed Session discussion was held regarding a Request for Variance to locate a detached garage, requiring a variance on the front yard set back.
Applicant, Paul Lynch was present during the Open Session and advised the Committee that he cannot make amendments to his proposal due to the following:

  • this is a corner lot and he only has so much room to work with;
  • due to the grade, he cannot move the garage over another 10 feet,  as it would be too costly to fill in;
  • could possibly build the garage perpendicular to the future street to meet the set back, however, he could not access from the future street as it is not built yet;
  • feels his request for variance is not as excessive as what the previous owner had proposed;

There were no other presentations made in favor of or against this proposal.
The following motion was then made:
“…moved by Mel Steffens that the Planning Advisory Committee grant the following variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law 16, Division 1, for the development of an accessory building at the property identified as 29 Ridge Way, NBGIC No. 30132373;
a)  under section 15 (b) (i), grant  a variance  of  2.93 m to reduce the set back from the street from 7.5 m to 4.57 m….”
Motion seconded by Ralph Stevens.  Carried with one Nay Vote.
7. DEVELOPMENT OFFICER’S  REPORT DATED JUNE 28, 2001 RE: RECOMMENDATION TO COUNCIL FOR LAND FOR PUBLIC PURPOSES – HUGHES SURVEYS & CONSULTANTS LTD./PAUL CHASE – TENTATIVE PLAN, HILLSIDE SUBDIVISION, POINTS ROAD
A Closed Session discussion was held regarding a Recommendation to Council for Land for Public Purposes to create one new building lot.
The Development Officer advised that this is a large waterfront lot with two small cottages existing on the lot.    He also explained the formula for calculating Money in Lieu of Land for Public Purposes set out under the Community Planning Act.
Present during the Open Session was Rick Turner of Hughes Surveys & Consultants Ltd., representing the Owner, Paul Chase.  Mr. Turner advised that his client has no objection with regard to the amount of money involved for Land for Public Purposes.
There were no other presentations made in favor of or against this proposal.
The following motion was then made:
“…moved by James Evans that the Planning Advisory Committee recommend to Council to accept the amount of $1,128.00 for money in lieu of Land for Public Purposes for the creation of one building lot out of land identified by NBGIC # 00226613 identified on the Tentative Subdivision Plan, Hillside Subdivision, Points Road, Town of Grand Bay-Westfield, Parish of Westfield, Kings County, New Brunswick dated June 5, 2001 as prepared by Hughes Surveys & Consultants Ltd. prior to Tentative Approval by the Development Officer; Final Approval by the Development Officer to be subject to the receipt of the money in lieu of Land for Public Purposes ….”
Motion seconded by Mel Steffens.  Motion carried.
8. DEVELOPMENT OFFICER’S REPORT DATED JUNE 27, 2001 RE: REQUEST FOR VARIANCE – EARL HART & OLIVE CURTIS – 440 WOOLASTOOK DRIVE
Due to the fact Chairman, Larry Chapman declared a Conflict of Interest on this item, a Quorum did not exist, therefore, the Committee could not deal with this matter at this time.
The Secretary immediately called the Applicants to inform them.
The following motion was then made:
“…moved by Mel Steffens that the Planning Advisory Committee Table this item until the next meeting….”
Motion seconded by Ralph Stevens.  Carried.
9. DEVELOPMENT OFFICER’S REPORT DATED JUNE 28, 2001 RE: REQUEST FOR VARIANCE KEVIN & CAROLE BREEN – 21 BAYCREST DRIVE
A Closed Session was held regarding the above Request for Variance Application to construct an attached garage, requiring a variance on the side yard set back.
Applicant’s, Kevin and Carole Breen were present during the Open Session, with no presentation given.
There were no other presentations made in favor of or against this proposal.
The following motion was then made:
“…moved by Ralph Stevens that the Planning Advisory Committee grant the following variance for the development of an attached garage for the single family residence located at property identified by NBGIC No. 30076228
a) under section 13(b) of the Zoning By-law, of the Town of Grand Bay-Westfield By-law No. 16, Division 1, grant a variance of 1.75 m, reducing the side yard setback requirements from 3.5 m to 1.75 m, subject to:
i) exterior cladding to match or complement the main dwelling…”
Motion seconded by James Evans.  Carried.
10. DEVELOPMENT OFFICER’S MEMO DATED JUNE 25, 2001 LIST OF PAC ITEMS TO DATE FOR 2001
The Committee commended the Development Officer for the well compiled list.  The following motion was then made:
“…moved by Ralph Stevens  to receive and file the Development Officer’s List of PAC Items to date for 2001, with a copy forwarded on to Council for their reference….”
Motion seconded by Mel Steffens.  Carried.
11. DEVELOPMENT OFFICER’S MEMO DATED JUNE 28, 2001 RE:   VARIANCE APPLICATIONS
The Development Officer informed the Committee that this amended  Variance Application came about due to a recent complaint made through a  Jurisdiction Appeal held by the Provincial Planning Appeal  Board, where the Applicant claimed that he was not aware of the time frame involved in which to make an appeal.
The Development Officer was thanked once again for a job well done and the following motion was made:
“…moved by Ralph Stevens to receive and file the Development Officer’s Memo Re:  Variance Applications….”
Motion seconded by James Evans.  Carried.
