PAC Minutes – June 4, 2001

The regular meeting of the Grand Bay-Westfield Planning Advisory Committee was held Monday, June 4, 2001 in Room “A”, 609 River Valley Drive.   Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:03 p.m.
1. RECORD OF ATTENDANCE
All Members were present with the exception of Ralph Stevens.
2. PLANNING ADVISORY COMMITTEE MINUTES OF MAY 22, 2001
“…Michael Hare moved to accept as presented the May 22, 2001 Planning Advisory Committee Minutes….”
Motion seconded by Bill McCann.  Carried.
3. (A) REGULAR COUNCIL MEETING MINUTES OF APRIL 23, 2001
(B) SPECIAL COUNCIL MEETING MINUTES OF MAY 17, 2001
“…moved by Mel Steffens to receive and file the above Council Minutes….”
Motion seconded by James Evans.  Carried.
4. CHAIRMAN’S REMARKS
The Chairman welcomed Cllr. Ashley Little to the Committee as Council Liaison.
Request to have additions added to Agenda.

5. DECLARATION OF CONFLICT OF INTEREST
No conflict of interest declared.
6.  ITEM TABLED MAY 22, 2001 MEETINGS RE:   REQUEST FOR VARIANCE DONALD CRUIKSHANK – 565 RIVER VALLEY DRIVE
A reply from Mr. Cruikshank in response to P.A.C.’s motion was added to this item, requesting a withdrawal of his application. The Development Officer advised he has met with Mr. Cruikshank on June 1, 2001 to discuss P.A.C.’s motion.
The following motion was made:

7. DEVELOPMENT OFFICER’S  REPORT DATED MAY 18, 2001 RE: REQUEST FOR VARIANCE DARRELL MOORE – 5 MARALYN COURT
A Closed Session discussion was held regarding the above Request for Variance Application to construct a newly detached garage, requiring a variance on the maximum area.  The Development Officer advised that there has been no response from the surrounding property owners.
Mr. and Mrs. Darrell Moore were present during the Open Session and were commended on the time and effort that went into their excellent application documents.
There were no presentations made in favor of or against this application.
The following was then made:
“…moved by Bill McCann that the Planning Advisory Committee grant the following variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division I, for the development of a detached garage, to be located at 5 Maralyn Court, NBGIC No. 00079541:
a) under to Section 15 (c), grant a variance of  7.63 m² to exceed the maximum area of 60 m² to a total of 67.63 m²;
subject to:
1. exterior cladding to match or complement the main dwelling;
2. no commercial activity to be conducted on the premises….”
Motion seconded by Michael Hare.  Carried.
8. DEVELOPMENT OFFICER’S REPORT DATED MAY 31, 2001 RE:   REQUEST FOR VARIANCE JAMES DENTON – 105 SHANNON ROAD
A Closed Session discussion was held regarding the above Request for Variance Application to develop a deck, requiring a variance on the side yard set back.
The Development Officer reported that the Variance Request was made after the fact, as the Applicant started construction prior to obtaining a Building Permit, and is now trying to legitimize the situation. He advised that the deck is built 2 ft. from the property line and not the required 6 ft.
The Committee had concerns, and upon reviewing the list of reasons for granting a variance, it was consensus of the Committee that the variance requested was excessive.
Applicant, James Denton was present during the Open Session.  Also present were adjacent property owners, Ross and Janet Reid, who advised they are strongly opposed to this proposal, for reasons which were stated in their letter dated May 28, 2001.
There were no other presentations made in favor of or against this application.
The following motion was then made:

Motion seconded by James Evans.  Carried.
9. DEVELOPMENT OFFICER’S REPORT DATED MAY 31, 2001 RE: REQUEST FOR VARIANCE RAY WILLIAMS – RIVER BEND COURT
A Closed Session was held regarding the above Request for Variance Application to develop a single family residence, requiring a variance on the lot width front on a street.
Added to this item, was a copy of a sample letter sent to surrounding property owners.  The Development Officer advised that the Applicant is now completing the final phase of consolidating the lots and has paid for all of the fees involved in closing the street to public use.
It was noted that clarification needs to be made as to the name of the street, i.e:   Prosser Street as opposed to Prosser Court.
Applicant, Ray Williams was present during the Open Session.  No presentations were made in favor of or against this application.
The following motions were made:
1.   “… moved by Bill McCann that the Planning Advisory Committee grant the following variance for the development of a single family dwelling on a parcel of land identified by Lot 2001-1, Tentative Plan, Amending Subdivision Plan, Marykknoll Subdivision dated April 17, 2001.
i) under section 10 (a)(i) of the Town of Grand Bay-Westfield By-law No. 16, Division 2, a variance of 34.27m, reducing the lot width fronting on the street from 54m to 19.73m,
subject to:
a) approval by the Department of Health for a variance to the regulations under the Health Act;
b) approval by Council for the 8m wide service easement;
c) Tentative and Final Approval by the Development Officer…”
AND
“…the Planning Advisory Committee recommends to Council to approve the 8m wide municipal service easement as shown on Lot 2001-1 for Tentative Approval of Tentative Plan, Amending Subdivision Plan, MaryKnoll Heights Subdivision dated April 17, 2001…”
Motions seconded by Mel Steffens.  Carried.
10.  DEVELOPMENT OFFICER’S MEMO DATED MAY 31, 2001 RE: MUNICIPAL PLAN BY-LAW & ZONING BY-LAW REVIEW
Added to this item, was a copy of the Town’s Web Page on The Development of Grand Bay-Westfield.
The Development Officer gave a brief review of the meeting the SGE Group Inc. held on May 28, 2001 with three P.A.C. Members present.  He also advised that P.A.C. is invited to attend a Public Meeting which the Consultants have scheduled for Monday, June 25, 2001.  He also reviewed with the Committee, the planned mass mail titled “Planning Update” as part of the Media Program.
The following motion was then made:
“…moved by Bill McCann to receive and file the Development Officer’s Memo Dated May 31, 2001 Re:  Municipal Plan By-law and Zoning By-law Review….”
Motion seconded by Michael Hare.  Carried.
