DEVELOPMENT OFFICER’S REPORT DATED MARCH 11, 2010 RE:  TEMPORARY USE PERMIT (GARDEN CENTRE) GRAND BAY HOME HARDWARE, 277/279 RIVER VALLEY DR.

“… moved by Linda Estabrooks that the Planning Advisory Committee APPROVE the request for Temporary Use Permit to Donald G. Myles Ltd., to remove 4 required parking spaces in order to operate a seasonal Garden Centre, permitting a temporary structure to be used as a Garden Centre between April 1, 2010 and August 31, 2010, to be located in the parking lot located at 277/279 River Valley Drive, PID No. 00090258/00090266, subject to:
a)the area proposed for the Temporary Use is to be limited to a total of 65m² (700 sf);
b)no more than four permanent parking spaces are to be lost in the location of the Temporary Use;
c)pursuant to Section 2.9 of the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 112, authorization for the development described above (Garden Centre) is hereby granted for the temporary period beginning April 1, 2010 and expiring on August 31, 2010.  At the end of the authorized period, you (Donald G. Myles Ltd.) are hereby required to terminate or remove the development hereby authorized….”

DEVELOPMENT OFFICER’S REPORT DATED MARCH 11, 2010 RE: APPLICATION FOR VARIANCE MATTHEW LOCKHART – 2 RAINBOW CRESCENT
(a) E-MAIL FROM BOB DUPLISEA DATED MARCH 8, 2010
Applicant, Matthew Lockhart and partner,  Amy Making were  present regarding Application for Variance for the construction of a new accessory building, with a request to exceed the maximum area allowed under the Zoning By-law by 8.6 m².
E-Mail dated March 8, 2010 received from Bob Duplisea stated he was not opposed to the building of a garage, only that it exceeds the maximum allowable limit, and due to the tight space between the lots, he feels it should be built attached to the house.  He also has concerns regarding water run off and future resale value of his property.
Mr. Lockhart made a presentation to the Committee noting:
he cannot attach the garage to the house due to the location of the well;  he feels that his proposal will not affect Mr. Duplisea’s property  with excess runoff, as he plans to re-grade the entire lot, including providing new drain tiles to direct water to the front of his property; he is of the opinion that his request is not excessive, as he has 5 vehicles in the yard including an ATV and dirt bike. he feels the new garage will improve the look of his property by removing an old existing shed.
The Committee informed Mr. Lockhart that although the request for larger accessory buildings may be a relatively common request, the Committee has tried to consistently maintain the maximum 800 sq. ft., area limit under the by-law except for very exceptional circumstances.
