APPLICATION FOR TEMPORARY USE PERMIT (GARDEN CENTRE) RE:  GRAND BAY HOME HARDWARE – 277 RIVER VALLEY DRIVE   (A)    DEVELOPMENT OFFICER’S REPORT DATED MARCH 3, 2011
There was no one present speaking in favor of or against this Application.
“… moved by Linda Estabrooks that the Planning Advisory Committee grant a Temporary Use Permit to Donald G. Myles Ltd., to operate a seasonal Garden Centre permitting a temporary structure to be used as a Garden Centre between April 1, 2011 and September 31, 2011 to be located in the parking lot located at 277/279 River Valley Drive, PID No. 00090258, subject to:
a)the area proposed for the Temporary Use is to be limited to a total of 65m² (700 sf); b)no more than four permanent parking spaces are to be lost in the location of the Temporary Use;
c)pursuant to Section 2.9 of the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 101, authorization for the development described above (Garden Centre) is hereby granted for the temporary period beginning April 1, 2011 and expiring on September 31, 2011.  At the end of the authorized period, you (Donald G. Myles Ltd.) are hereby required to terminate or remove the development hereby authorized….”

APPLICATION FOR VARIANCE (ACCESSORY BUILDINGS) RE: PAUL & KAREN HOBART – 497 NEREPIS ROAD
(A) DEVELOPMENT OFFICER’S REPORT DATED MARCH 3, 2011
(B) LETTER FROM RICHARD & HEATHER WALLACE RECEIVED FEBRUARY 25, 2011
(C) LETTER FROM PEREGRINE RILEY RECEIVED MARCH 3, 2011
Applicants, Paul and Karen Hobart were present.  Mr. Hobart addressed the Committee as follows:
His Application is to build a stable (40 ft x 60 ft) and a riding arena (50 ft x 100 ft) behind his home for six horses, four of which are his and one each belonging to his sister and niece; the stable would include a heated tack room, wash stall for the horses and washroom facilities, including a washer and dryer; with regard to water, he will either be using the existing well for his home or may need to drill another well; the stable will only be used for their personal use and is not intended for equestrian events; he plans to use the manure for fertilizer to clear more ground or mix with soil for compost and then sell; he would like to have the stable up by the fall and plans to erect a temporary structure  to house the horses until that time; he is presently awaiting a Report from the Department of Health.
Mr. Hobart further advised that subsequently speaking with the Development Officer and being made aware of the Town’s legal advise, he realizes that his Variance Request is very excessive and perhaps beyond the scope of  the PAC, and is now looking for recommendations from the Committee as to how to proceed and what he can build.
The Chairman stated to Mr. Hobart that the PAC are willing to assist him in any way possible, however, the Committee would need to peruse the Report from the Department of Health prior to a decision being made.
The letter received from Richard & Heather Wallace stated no objection to this Application.
There was no one present speaking in favor of this Application.
Speaking against this Application was Peregrine Riley of 501 Nerepis Road.  Mr. Riley addressed the Committee and advised the following:
he has concerns regarding water supply, proposed use, and size and location of the proposed stable and riding arena;
due to the fact that the proposed location of the stable is at the highest and steepest point on the property, his main concern is possible threats to the groundwater in the area;
he has a spring fed water source located near the south western corner of his property, directly downhill from the marked location of the stable.
Mr. Hobart responded to Mr. Riley’s water concerns stating that he has every intention in keeping the water supply safe, following guidelines from the Department of Health.  Due to the fact that there is distance and vegetation between the two properties, he believes that there should not be a problem. Mr. Hobart did note that, since Mr. Riley’s water supply is spring fed, it is not protected by provincially recommended casings and that natural contamination is always a possibility.
The Committee questioned him as to whether or not he could somehow scale down the size of the structure.  To which he replied, that if necessary, he could scale it down.
