PAC Minutes – May 1, 2000

The regular meeting of the Town of Grand Bay-Westfield Planning Advisory Committee was held Monday, May 1, 2000 at 7:00 p.m. in Room “A”.  Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:02 p.m.

All Members were present.
2. P.A.C. MINUTES OF APRIL 17, 2000
“…it was moved by Mel Steffens and seconded by Bill McCann to accept as amended the April 17, 2000 P.A.C.  Minutes….”  Motion carried.
3. REGULAR COUNCIL MINUTES OF APRIL 10, 2000
“…it was moved by Ralph Stevens and seconded by Deputy Mayor Black to receive and file the April 10, 2000 Regular Council Minutes….”  Motion carried.
4. CHAIRMAN’S REMARKS
No remarks.
5.  DECLARATION OF CONFLICT OF INTEREST
No conflict of interest declared.
6. DEVELOPMENT OFFICER’S REPORT DATED APRIL 25, 2000 RE: REQUEST FOR TEMPORARY USE PERMIT CHRISTINE ROGERS-JACOBSEN/WESTFIELD GOLF & COUNTRY CLUB –  8 COUNTRY CLUB ROAD
A Closed Session discussion was held regarding the above request made by the Westfield Golf & Country Club for a Temporary Use Permit for the erection of a temporary sign advertising fund raising events.  The Development Officer informed the Committee that this is the same request that P.A.C. has approved for the past two years.  Letters and telephone calls have been received from the surrounding property owners, with three in favor and four against the proposal.  The Members concurred with the Development Officer’s recommendations outlined in his report.
Present during the Open Session were Applicant, Christine Rogers-Jacobsen and two surrounding property owners, Richard Likely and Bill Warwick.
Ms. Rogers stated that she has received positive comments in the past two years regarding the sign and that the sign does attact locals and tourists.  There was no one present in favor of the proposal.  Mr. Likely and Mr. Warrick were two of the four property owners who also wrote stating objection to the proposal.  Mr. Likely advised the Committee that he is opposed to the Billboard type sign and that this may encourage other signs to appear within the Town.  Mr. Likely was advised that in the past two years, there have been no other applications for signs in the Westfield portion of the Town, other than from Westfield  School and Westfield United Church advertising upcoming events.
The following motion was then made:
“…moved by Ralph Stevens that P.A.C. grant a Temporary Use Permit for the Westfield Golf & Country  Club to place temporary P-2 signage in addition to the existing “legal” non-conforming type P-2 sign located at 8 Golf club Road, NBGIC No. 00227538,  pursuant to Section 4 (2), Division II; of the Town’s By-law # 16, Town of Grand Bay-Westfield Zoning By-law.  Authorization for the development described above (P-2 signage) is hereby granted for the temporary period of May 2, 2000, expiring September 4, 2000.  At the end of the authorized period, you (Westfield Golf & Country Club) are hereby required to terminate or remove the development hereby authorized….”  Motion seconded by Michael Hare.  Carried.
All parties present were thanked for their input.
7. DEVELOPMENT OFFICER’S REPORT DATED APRIL 20, 2000 RE: REQUEST FOR TEMPORARY USE PERMIT GRANDOR PROPERTY HOLDINGS LTD.C/O PAUL GORDON/BENNY SHOLTEN – 217 RIVER VALLEY DRIVE
A Closed Session discussion was held regarding the above request to erect a temporary structure to be used as a garden centre.   The Development Officer informed the Committee that the construction of the garden centre was started, however was subsequently halted awaiting tonight’s decision.  The Committee concurred with the Development Officer’s recommendations outlined in his report.
There was no one present during the Open Session.  The Secretary advised that she left a message earlier today with one of the Scholton employees to advise Paul Gordon of the meeting tonight.
The following motion was made:
“…moved by James Evans that P.A.C. grant a Temporary Use Permit to Grandor Property Holdings Ltd. c/o Paul Gordon for the erection of a temporary structure to be used as a garden centre to be located at 217 River Valley Drive, NBGIC No. 00218628,  pursuant to Section 5 (2), Division I; of the Town’s By-law # 16, Town of Grand Bay-Westfield Zoning By-law.
Authorization for the development described above (garden centre) is hereby granted for the temporary period of May 2, 2000, expiring July 1, 2000.  At the end of the authorized period, you (Grandor Property Holdings Ltd.) are hereby required to terminate or remove the development hereby authorized.
Subject to:
a) a Building Permit Application and payment of $10.00 Permit Fee being received by the Town….”
Motion seconded by Bill McCann. Carried.
8. DEVELOPMENT OFFICER’S REPORT DATED APRIL 25, 2000 RE: REQUEST FOR VARIANCE DONALD R. RINGUETTE – 12 MAJESTIC DRIVE
A Closed Session discussion was held regarding the above request for the construction of a detached garage, requiring a variance on the height and area.  The Members concurred with the Development Officer’s recommendations, however, were unsure as to what type of foundation the Applicant planned on constructing, and also the timeline for the completion date of the siding of the garage.
Donald Ringuette was not present during the Open Session.  The Secretary informed the Members that she tried several times during the day to contact Mr. Ringuette, but to no avail.  His place of employment advised that he would be away until Wednesday.
The following motion was made:
“…moved by Bill McCann that P.A.C. grant the following variances to Donald R. Ringuette for the development of a detached, two-car garage to be located at 12 Majestic Drive, NBGIC No. 00087205 under the Town’s By-law # 16, Town of Grand Bay-Westfield Zoning By-law, Division l, as follows:
1. under Section 15, grant a variance of 0.37 metres to exceed the maximum height of an accessory building from 4.5 metres to 4.87 metres
2. under Section 15(c), grant a variance of 6.89 square metres to exceed the maximum area of an accessory building from 60 square metres to 66.89 square metres.
Subject to the following:
a) the garage to be built on a concrete foundation and/or concrete slab;
b) the garage siding to be compatible with the main building and to be completed within six months from the date the Building Permit is issued….”  Motion seconded by Deputy Mayor Black.  Carried.
9.  DEVELOPMENT OFFICER’S REPORT DATED APRIL 17, 2000 RE: ITEM TABLED APRIL 3, 2000 MEETING NOISE BY-LAW – EXEMPTION OF SNOW REMOVAL EQUIPMENT
Following a brief discussion, the following motion was made:
“…moved by Ralph Stevens to receive and file the above information to be brought forward again the first meeting in November, 2000….”
Motion seconded by Bill McCann.  Carried.
10. FOR INFORMATION ONLY RE:P.A.C. FILE 3 142-P1-2000  LIST OF APPLICATIONS TO DATE FOR YEAR 2000
The Development Officer informed the Committee that he has compiled a reference list of  the different types of application that have come before P.A.C. to date this year.  The Members commended David for this and the following motion was made:
“…moved by Bill McCann that P.A.C. forward this reference list on to Council for their information….”
Motion seconded by Ralph Stevens.  Carried.
11. ADJOURNMENT
Ralph Stevens moved to adjourn at 8:20 p.m.
