PAC Minutes – May 21, 2002

The regular meeting of the Grand Bay-Westfield Planning Advisory Committee was held Tuesday, May 21, 2002 in Room “A”, 609 River Valley Drive.   Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:07 p.m.
1. RECORD OF ATTENDANCE
All Members were present with the exception of Tony Ratchford.
2. PLANNING ADVISORY COMMITTEE MINUTES OF MAY 6, 2002
“…moved by Mel Steffens to accept as presented the May 6, 2002 Planning Advisory Committee Minutes….”
Motion seconded by  James Evans.  Carried.
3. REGULAR COUNCIL MINUTES OF APRIL 22, 2002
“…moved by Ralph Stevens to receive and file the Regular Council Minutes of April 22, 2002….”
Motion seconded by Michael Hare.  Carried.
4. CHAIRMAN’S REMARKS

  • Re: Item No. 7 –  Applicant, Suzanne Sutton requested that her Application be addressed last on tonight’s Agenda.  It was unanimous that Item No. 7 be deferred to become Item No. 9, and Item No 9 becomes Item No. 7.
  • Re:  Duane Benson Appeal – Upon the request of the Chairman, James Evans gave a brief report on the recent Benson Appeal Hearing.

5. DECLARATION OF CONFLICT OF INTEREST
No conflicts declared.
6. LETTER DATED MAY 13, 2002 FROM MRS. CANDACE PERRY RE:   APPLICATION FOR VARIANCE – 39 MALLARD DRIVE
“…moved by Ralph Stevens to receive and file letter dated May 13, 2002 from Mrs. Candace Perry Re:  Application for Variance, 39 Mallard Drive….”
Motion seconded by Michael Hare.  Carried.
7. DEVELOPMENT OFFICER’S REPORT DATED MAY 15, 2002 RE:  APPLICATION FOR VARIANCE STEPHEN MAGEE – 34 MALLARD DRIVE
A discussion was held in Closed Session regarding an Application for Variance to construct an accessory building for woodworking and wood storage, requiring a variance to the height.
The Development Officer reported that the Applicant’s previous application was denied by PAC two weeks ago and that before proceeding, the Committee needs to establish if this proposal is substantially different than the one presented on May 6, 2002.
Following further review of the application, the following motion was made:
“…moved by Ralph Stevens that the Planning Advisory Committee address Application for Variance dated May 15, 2002 submitted by Stephen Magee of 34 Mallard Drive….”
Motion seconded by Cllr. Little.  Carried with one nay vote.
Applicant, Stephen Magee was present during the Open Session and advised the Committee of the following:

  • this is the same drawing, the only difference is the 10 ft. wall;
  • the setback on the side line is between 9 and 10 ft;
  • he has received no opposition from his neighbours.

There were no other presentations made in favor of or against this Application.
The following motion was then made:
“…moved by Cllr. Little that the Planning Advisory Committee grant the following request for variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division 2, for the development of an accessory building, located at 34 Mallard Drive, PID No. 00460550:
a) under section 14(a), a variance of 1.2 m to exceed the maximum height of 4.5 m to a total of 5.7 m….”
Motion seconded by James Evans.  Carried.
8.  DEVELOPMENT OFFICER’S REPORT DATED MAY 16, 2002 RE:   APPLICATION FOR VARIANCE RENE MARTIN – 20 VALLEY VIEW DRIVE
A discussion was held in Closed Session regarding the above Application for Variance to construct a single family dwelling, requiring a variance to the height of the foundation in relation to centre line grade of street.
The Development Officer reported that the Applicant has frontage on Woolastook Drive and Valley View Drive.  Due to the grade on the lot the Committee had concerns with regard to grading to prevent future water problems and also the well location.
Applicant, Rene Martin was present during the Open Session and advised the following:

  • he is not sure exactly where the well will be placed, as he is relying on the advise of the well driller for proper placement of the well;
  • he will be using swales on both sides to divert the water to existing ditches.

There were no other presentations made in favor of or in opposition to this Application.
The following motion was then made:
“…moved by Michael Hare that the Planning Advisory Committee grant the following request for variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division 1, for the development of a single family dwelling at 20 Valley View Drive, PID No. 30003867;
a) under Section 80, a variance of 3.75 m to reduce the height of the foundation wall from being required to be placed 750 m above centre line grade of the street to being located 3.0 m below the centre line grade of the street;
subject to:
the placement of the main building with a 15 m set back from the street line and adequate drainage including swales around the sides of the building to direct water away from the foundation…”
Motion seconded by Ralph Stevens.  Carried.
9. DEVELOPMENT OFFICER’S REPORT DATED MAY 10, 2002 RE:   APPLICATION FOR VARIANCE JOHN JARVIS – 23 EDGEMOUNT DRIVE
A discussion was held in Closed Session regarding the above Application for Variance to construct a single family dwelling, requiring a variance to the height of the building.
Applicant John Jarvis was present during the Open Session and did not give presentation.
There were no presentations made in favor of or against this application.
The following motion was then made:
“…moved by Ralph Stevens that the Planning Advisory Committee grant the following request for variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division I, for the development of a single family dwelling at 23 Edgemount Drive, PID No. 30202790:
a)   under section 14, a variance of 1.2 m to increase the height of the building from 9.0 m to 10.2 m….”
Motion seconded by Mel Steffens.  Carried.
10.  DEVELOPMENT OFFICER’S REPORT DATED MAY 16, 2002 RE:   APPLICATION FOR VARIANCE SUZANNE SUTTON – 102 NEREPIS ROAD
A discussion was held in Closed Session regarding the above Application for Variance for an addition to a single family home, requiring a variance to the front yard setback.
Applicant, Suzanne Sutton was not present during the Open Session.
Present was adjacent neighbour Sharon O’Brien of 98 Nerepis Road, who advised the Committee that she is not against this application, however she  has written a letter to the Applicant stating the following concerns:

  • the location of her well;
  • her well and casing being damaged during construction;
  • her water being affected;
  • she is taking precautions by having her water tested before and after construction.

The following motion was then made:
“…moved by James Evans that the Planning Advisory Committee grant the following request for variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division 2, for the development of an addition to an existing single family dwelling, located at 102 Nerepis Road, PID No. 00228478:
a)   under section 12(a), a variance of 2.38 m to reduce the front yard setback from 10 m to 7.62 m;
subject to the development meeting provisions of the Health Act regulating size and location of septic systems and compliance with Regulations under the Clean Water Act for well location….”
Motion seconded by Mel Steffens.  Carried.
