PAC Minutes – May 7, 2001

The regular meeting of the Grand Bay-Westfield Planning Advisory Committee was held Monday, May 7, 2001 in Room “A”, 609 River Valley Drive.   Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:02 p.m.
1. RECORD OF ATTENDANCE
All members were present with the exception of Bill McCann and Mel Steffens
2. PLANNING ADVISORY COMMITTEE MINUTES OF APRIL 17, 2001
“…Michael Hare moved to accept as amended the April 17, 2001 Planning Advisory Committee Minutes….”
Motion seconded by Ralph Stevens.  Carried.
3. REGULAR COUNCIL MINUTES OF APRIL 9, 2001
“…Ralph Stevens moved to receive and file the April 9, 2001 Regular Council Minutes….”
Motion seconded by Deputy Mayor Black.  Carried.
4.  CHAIRMAN’S REMARKS
The Chairman advised the members that this is Deputy Mayor Black’s last P.A.C. meeting, and added that it has been a pleasure working with him and on behalf of the Committee, thanked Deputy Mayor Black for his hard work and commitment to the Town and to P.A.C.
5. DECLARATION OF CONFLICT OF INTEREST
No conflict of interest declared.
6. DEVELOPMENT OFFICER’S REPORT DATED MAY 3, 2001 RE:   REQUEST FOR VARIANCE  JEAN YVES BOUDREAU – 3 BALSAM DRIVE
(A) TELEPHONE POLL CONDUCTED APRIL 27, 2001
A Closed Session discussion was held regarding the above noted Request for Variance application to locate a main building 5.78 metres from the front yard set back, requiring a variance of 1.63 metres, which was previously dealt with by telephone poll on April 27, 2001 and was subsequently granted.
The Chairman advised that when the telephone poll was conducted, there were three members who could not be reached and he therefore broke the tie vote and that if the Committee wishes, another vote could be taken tonight.  He also advised that the Applicant would not be present this evening.
Ralph Stevens reported that upon speaking with Bill McCann, Mr. McCann advised that he would have been in favor of the variance requested.  It was unanimous that the Committee vote again and the following motion was made:
“…moved by Deputy Mayor Black that the Planning Advisory Committee grant the following variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law 16, Division 1, for the development of a single family home on the property located at 3 Balsam Drive, NBGIC No. 30111421:
a)  under section 13 (a), grant  a variance of 1.63 m to reduce the required minimum front yard set back from 7.5 m to 5.87 m….”
Motion carried.
Motion seconded by James Evans.  Carried.
6. (A)  TELEPHONE POLL CONDUCTED APRIL 27, 2001
“…moved by Ralph Stevens to receive and file the Telephone Poll conducted April 27, 2001….”
Motion seconded by Michael Hare.  Carried.
7. DEVELOPMENT OFFICER’S  REPORT DATED MAY 3, 2001 RE: SIMILAR & COMPATIBLE USE DOUG & RITA BLIZZARD – 14 BROAD STREET
A Closed Session discussion was held regarding a Similar & Compatible Use Application made by Doug & Rita Blizzard for a Home Occupation (Telephone Sales) to be conducted from their home located at 14 Broad Street.  The Development Officer advised that he has received one telephone call, stating  no objection to the proposal.
Present during the Open Session were Applicants, Doug & Rita Blizzard.  Mr. and Mrs. Blizzard advised the following information:
business hours would be between 8:00 a.m. to 5:00 p.m., with approximately 1 to 2 deliveries per day;

  • telephone sales type of business dealing with a variety of safety products;
  • business to be run from a 77 sq. ft. storage room in basement of their home with a small room used as an office.

Also present were neighbours,  Eric Martin and Joanna Burnham of 18 Broad Street.  They advised that they were not against the application, however, were  present to determine what exactly was proposed.
The following motion was then made:
“…moved by Jim Evans that the Planning Advisory Committee grant a Home Occupation to Doug and Rita Blizzard to operate Blizzard Safety Products on the property located at 14 Broad Street, NBGIC No. 30147151 as a use similar and compatible to other approved Home Occupations as identified in the Town’s Zoning By-law, By-law No. 16, Division 1, subject to:
(a) approval by the Development Officer of both house plans and site plans respecting all conditions set out under section 68 of the by-law prior to the operation of the business….”
Motion seconded by Ralph Stevens.  Carried.
8. DEVELOPMENT OFFICER’S REPORT DATED MAY 3, 2001 RE: TEMPORARY USE PERMIT – THE NEIGHBOURHOOD THEATRE COMPANY – 250  NEREPIS ROAD
The secretary reported that she was unable to contact Mrs. Marilyn Patstone to advise that their application for signage would be addressed by P.A.C. this evening.  However, the Development Officer advised that in the past few years, no one has been present representing the Theatre Company.
The following motion was then made:
“…moved by Michael Hare that the Planning Advisory Committee grant a Temporary Use Permit for The Neighbourhood Theatre Company to place T-1 temporary low level signs to a maximum of 6 times during the calendar year 2001, on property located at 150 Nerepis Road, NBGIC No. 00211805 subject to:
(a) conditions set out under section 70 of the Town’s Zoning By-law, Division I and approval by the Development Officer for each application for such signage;
(b) the termination of the development (temporary signage) is required after a maximum of 14 days for each signage permit that is issued, to a maximum of 6 times during the calendar year 2001.
Pursuant to Section 4(2), Division II of the Town’s By-law No. 16, Town of Grand Bay-Westfield Zoning By-law, authorization for the development described above (temporary signage) is hereby granted for the period beginning May 7, 2001 and expiring on December 31, 2001.  At the end of each authorized period, you (The Neighbourhood Theatre Company) are hereby required to terminate or remove the development (temporary signage) hereby authorized…”
Motion seconded by Ralph Stevens.  Carried.
9. REVISED P.A.C. DUTIES OF THE SECRETARY
“…moved by Ralph Stevens to adopt the amended P.A.C. Duties of the Secretary….”
Motion seconded by James Evans.  Carried.
10. PROPOSAL – PREPARATION OF MUNICIPAL PLAN & ZONING BY-LAW
Following a discussion regarding the above Proposal for the Preparation of Municipal Plan & Zoning By-law done up by The SGE Group Inc., the following motion was made:
“…moved by Ralph Stevens to receive and file the Proposal – Preparation of Municipal Plan & Zoning By-law….”
Motion seconded by James Evans.  Carried.
11. ADJOURNMENT
