The Town of Grand Bay-Westfield Planning Advisory Committee met for a regular meeting on Monday, May 7, 2012 at 8:00 p.m. with Chair, Ralph Stevens presiding.

APPLICATION FOR VARIANCE RE: GERALD CONLEY-BEDDOW  – 50 SUNNSIDE DRIVE
(A)   DEVELOPMENT OFFICER’S REPORT DATED MAY 3, 2012
Applicant, Gerald Conley-Beddow was present and addressed the  Committee as follows:
his Application for Variance is to reduce the minimum front yard setback to construct a garage; an Engineers design was obtained for the concrete slab; he was subsequently contacted by the Development Officer, advising him to Stop Work, without a Building Permit, and that a Variance would be required because the slab was too close to a Municipal Right-of-Way; he was not aware this was a Municipal Right-of-Way or that a Building Permit was required for the slab, just for the building; he thought that his property line started at the edge the ditch rather than along the edge of his driveway; he suggested that the request for variance may need to be 25 ft rather than only 15 ft; his neighbours did not have a problem with the location as the right-of-way was not used.
The Committee stated to Mr. Conley-Beddow that this is a corner lot, and  that it appears that the slab may be constructed so as to encroach onto the Municipal property, PAC cannot consider the Variance request until proper measurements are provided, depicting where his property line is in conjunction with his house/ concrete slab location.  Once the Committee is in receipt of a proper drawing showing where the building is intended to be located (with dimensions confirmed by a Surveyor) the item can return to the Committee for consideration.
There were two neighbours present residing on the opposite of the Sunnyside Drive present at the meeting, both of whom indicated their support for the Application.
There was no one present speaking against this Application.
“…moved by Jim Burke that the Planning Advisory Committee TABLE the Application for a requested Variance of 4.5 m, to reduce the front yard setback from Latour Street from 7.5 m to 3.0 m for the construction of an accessory building (detached garage) to be located at 50 Sunnyside Drive, PID No. 458844,  until the application can be supported by a surveyor, showing actual dimensions to the existing house and present concrete slab location from the property line to consider the present request for a 10 foot front yard setback; AND
noting that once the requested information and/or revised application has been received, new letters to neighbouring property owners will be provided in advance of establishing the next date for the item to be re-considered by the Planning Advisory Committee….”
Seconded by Chyann Kirby.  Carried.
