“…moved by Linda Estabrooks.   that the Planning Advisory Committee advise Council that under provisions of the Community Planning Act, two of the Committee Member’s terms are due to expire on January 1, 2011; and that both Members, Chyann Kirby and Ronald Daigle, have offered to stand for re-appointment to the Committee (with new 3-year terms from January 3, 2011 to January 1, 2014)…”

APPLICATION FOR VARIANCE RE: DIANE & GLEN SIMPSON – 11 YOUNG STREET
(A) DEVELOPMENT OFFICER’S REPORT DATED OCT. 14 2010
(B) LETTER FROM GARRY SAFFORD DATED OCT. 12, 2010
Mr. Simpson was present to discuss his proposal, noting the following:
the design of the house is 52 feet deep with the required setbacks on a 100 foot lot depth, he is asking for a reduction of the rear yard setback for the main building of 5 ft to allow an additional 3 feet for off street parking in front of the house demolition of the existing cottage was scheduled to start today
Jim Evans noted the Committee’s concern for the stairs leading from the rear deck as shown on the Plan would extend beyond the property line and cautioned the Committee to ensure that the property lines are respected.
No other presentations were provided in favour or against the proposal.
“…moved by Ron Daigle that the Planning Advisory Committee approve the following variance requests to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 112, for the construction of a new dwelling to be located as shown on the submitted site plan at 11 Young Street, PID No. 105965/220301:
a) under section 8.2.3.3 (e), grant a variance of 1.5 m to reduce the rear yard setback for the main building from 7.5 m to 6.00 m;
b)  under section 4.9.4, grant a variance of 4.8m to reduce the rear yard setback for the deck stair from 6.0m to 1.2 m;
c)  under section 4.9.5 (a) (ii), grant a variance of 0.8m to reduce the rear yard setback for the raised unenclosed deck from 2.0 m to 1.2 m;
subject to the location of the proposed stair from the deck be re-located to either end of the deck to maintain the minimum 1.2 m set back from the rear property line for the deck and the stair…”

APPLICATION FOR VARIANCE RE: SUSANNE HENWOOD & J.D. HOHMANN – 42 YOUNG STREET
(A) DEVELOPMENT OFFICER’S REPORT DATED OCT. 14, 2010
Mr. Hohmann was present to discuss his proposal, noting the following:
he thanked the Committee for considering the application to amend the decision granted in June 2009 the initial misunderstanding with the location of his property line with respect to the survey markers in the adjacent roadways (pavement is actually over the survey marker encroaching onto his property on Young Street and Kirtley Avenue pavement is actually offset from the right of way away from his property the confusion over the ownership of the roads and the present maintenance of Kirtley Avenue as closed in the winter season the additional requirement of 6 m back from the corner property   pin for sight lines is respected in the shed’s existing location The property is a sloping site which makes it difficult to set an accessory building on level ground and the cost of a boom truck to re-locate it is too expensive
Cllr. Murphy noted that the item dealt with in 2009 anticipated the construction of a new garage and the removal or relocation of the shed to meet the Zoning By-law within a period of 14 months.
Jim Evans noted that the road maintenance respects the existing conditions and the by-law setbacks relate to the property line, not the actual paved or travelled surfaces.
No other presentations were provided in favour or against the proposal.
