PAC Minutes – October 2, 2000

The regular meeting of the Town of Grand Bay-Westfield Planning Advisory Committee was held Monday, October 2, 2000 at 7:00 p.m. in Room “A”.  Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:05 p.m.
1. RECORD OF ATTENDANCE
All members were present with the exception of Michael Hare.
2. P.A.C. MINUTES OF SEPTEMBER 18, 2000
“…it was moved by Bill McCann and seconded by Mel Steffens to accept as presented the September 18, 2000 P.A.C.  Minutes….”
Motion carried.
3. REGULAR COUNCIL MINUTES OF SEPTEMBER 11, 2000
“…it was moved by Ralph Stevens and seconded by Bill McCann to receive and file the September 11, 2000 Regular Council Minutes….”
Motion carried.
4. CHAIRMAN’S REMARKS
The Chairman requested the following item be added to the Agenda:
Development Officer’s Report Dated October 2, 2000 Re: Application made by Bruce Gault for P1 Signage Installation on a Public Right of Way – 609 River Valley Drive
“…it was moved by Ralph Stevens and seconded by Mel Steffens to add the above item to the Agenda at Item # 10….”
Motion carried.
5.  DECLARATION OF CONFLICT OF INTEREST
No Conflict of Interest declared.
6. DEVELOPMENT OFFICER’S REPORT DATED SEPTEMBER 26, 2000 RE: REQUEST FOR VARIANCE PETER CRUISE – 35 YOUNG STREET
A Closed Session discussion was held regarding the above Request for Variance for the demolition of an existing cottage and the construction of a new single family dwelling with foundation below center line of street, requiring a variance on the elevation.
One letter was received from a surrounding property owner stating no objection to this proposal. The Development Officer advised that the existing cottage is to be removed prior to construction of the new structure.  David informed the Committee that there is an easement at the back of the property and a request has been made to the Applicant to keep this free and clear.  The Committee concurred with the Development Officer’s recommendations found in his report.
Present during the Open Session were Applicant Peter Cruise, his mother and associates.  Mr. Cruise stated that he had nothing further to add.  When asked when construction would be started and completed, he advised that he plans to start this week, with a completion date of approximately 10 weeks, depending on the weather.  He advised that he would be using the existing drilled well on the property.  It was recommended to him that he attempt to divert the run off water away from the well to avoid possible contamination.
The following motion was then made:
“…moved by Bill McCann that P.A.C. grant the following variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law # 16, for the development of a single family dwelling to be located at 35 Young Street, NBGIC No. 00106005/00220335/0022319/00105999;
i) to Section 80, grant a variance of 5.0 metres, to located the top of foundation wall 4.3 metres below center line elevation of the street;
subject to:
a) providing minimum 3 metres positive slope of grade away from the foundation and exposed well cap to prevent build up or penetration;
b) maintain free and clear access to Municipal Sewer easement at all times.
Motion seconded by Deputy Mayor Black.  Carried.
The Chairman thanked all those present for attending.
7. DEVELOPMENT OFFICER’S REPORT DATED SEPTEMBER 26, 2000 RE: REQUEST FOR VARIANCE PAUL & KRISTA MACDONALD – 43 YOUNG STREET
A Closed Session discussion was held regarding the above Request for Variance for the demolition of existing cottage and construction of a new single family dwelling with foundation below center line of street, requiring a variance on elevation.
No correspondence was received either in favor of or objecting to this proposal.  The Development Officer advised the Committee that this Application is similar to the previous Item # 5.  However, the Applicant in this case wishes to reside in the existing cottage until construction of the new structure is completed.
The Committee concurred with the Development Officer’s recommendations in his report, however, wished to add a completion date for the demolition of the existing cottage to the conditions.
Present during the Open Session were Applicants, Paul and Krista MacDonald.  Mr. MacDonald stated that he had nothing further to add.  He advised that he has spoken with Works Commissioner, Bruce Gault with regard to ditching and water run off.  Mr. MacDonald was advised that Godfrey’s & Associates are conducting a study with  regard to ditching on the upper side of the road, due to clear cutting that has been done on a surrounding property.  The Chairman advised Mr. MacDonald that this was a Council matter.  However, it was recommended to Mr. MacDonald that he slope away from the building foundation, in order to avoid any water problems.
The following motion was then made:
“…moved by Jim Evans that P.A.C. grant the following variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law # 16, Division I, for the development of a single family dwelling to be located at 43 Young Street, NBGIC No. 00220293:
i) to Section 30, grant a variance of 5.3 metres, to locate the top of the foundation wall 4.6 metres below center line elevation of the street;
subject to :
a) providing minimum 3 metres positive slope of grade away from the foundation and exposed well cap to prevent water build up or penetration;
b) maintain free and clear access to Municipal Sewer easement at all times;
c) demolition of existing cottage to be completed by May 1, 2001….”
Motion seconded by Ralph Stevens.  Motion carried.
The Chairman thanked Mr. and Mrs. MacDonald for attending.
8. ITEM TABLED SEPTEMBER 18, 2000 RE: FIRE PROTECTION SERVICES REVIEW GROUP REPORT
A discussion was held regarding the pros and cons of the Town acquiring full time fire protection.  Deputy Mayor Black gave a brief report to the Committee.  Michael Hare submitted his concerns in writing to the Committee for consideration.  Due to his absence, the following motion was made:
“…moved by Deputy Mayor Black to receive and file the above Report and that it be put on the next meeting Agenda….”
Motion seconded by Ralph Stevens.  Carried.
9. DEVELOPMENT OFFICER’S MEMO DATED SEPTEMBER 25, 2000 RE: LIST OF CONCERNS TO BE SPECIFICALLY ADDRESSED IN MUNICIPAL PLAN & ZONING BY-LAW REVIEW
The Development Officer had binders on hand, along with a package giving background information for the Municipal Plan Review.  He advised that he is looking for input from the Committee Members.  Upon review, Jim Evans recommended adding three items to the list.
The following motion was then made:
“…moved by Bill McCann to table this item to the next meeting….”
Motion seconded by Ralph Stevens.  Motion carried.
10. DEVELOPMENT OFFICER’S MEMO DATED SEPTEMBER 27, 2000 RE: INFORMATION ON PROVINCIAL WELL FIELD PROTECTION  PROGRAM
Following a brief discussion, the following motion was made:
“…moved by Ralph Stevens to receive and file the above information….”
Motion seconded by Mel Steffens.  Motion carried.
11. DEVELOPMENT OFFICER’S REPORT DATED OCTOBER 2, 2000 RE: P1 SIGNAGE INSTALLATION  – BRUCE GAULT PUBLIC RIGHT OF WAY – 609 RIVER VALLEY DRIVE
During the discussion on the above request, the Committee had concerns with regard to location of the sign and liability.  Therefore, the following motion was made:
“…moved by Ralph Stevens that a memo be sent to Council advising that P.A.C. concurs with the Development Officer’s recommendations found in his report, providing the safety issue in terms of location is addressed, along with liability towards the Town….”
Motion seconded by Bill McCann.  Motion carried.
