PAC Minutes – September 17, 2001

The regular meeting of the Grand Bay-Westfield Planning Advisory Committee was held Monday, September 17, 2001 in Room “A”, 609 River Valley Drive.   Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:04. p.m.
1. RECORD OF ATTENDANCE
All Members were present with the exception of  James Evans.
2. PLANNING ADVISORY COMMITTEE MINUTES OF SEPTEMBER 4, 2001

Motion seconded by Michael Hare.  Carried.
3. REGULAR COUNCIL MINUTES OF AUGUST 13, 2001
“…moved by Ralph Stevens to receive and file the Regular Council Minutes of August 13, 2001….”
Motion seconded by Bill McCann.  Carried.
4. CHAIRMAN’S REMARKS

5. DECLARATION OF CONFLICT OF INTEREST
None.
6. DEVELOPMENT OFFICER’S REPORT DATED SEPTEMBER 12, 2001  RE:  TEMPORARY USE PERMIT – FLORENCE CROWE, 183 NEREPIS ROAD, NBGIC NO. 00229088
A discussion was held in Closed Session regarding a Temporary Use Permit Application to erect a temporary sign.  The Development Officer informed the Committee that this application is for the Temporary Use only and not a variance for placement of the sign, referring to the sketch provided with last year’s application which locates the sign in compliance with the by-law.
During the discussion, the Committee had questions as to why Mrs. Crowe did not erect a permanent sign during the year as planned, and whether or not the store is to be sold.
The Secretary advised the Committee that Mrs. Crowe would not be attending this evening, due to a personal family matter.
During the Open Session, the Chairman called for presentations, but there were no presentations made in favor of or against this application.
The following motion was then made:
“…moved by Ralph Stevens that the Planning Advisory Committee grant a Temporary Use Permit, for the erection of a temporary T-1 type sign as set out under provisions of Section 70 of the Zoning By-law, Division I, to be located at 183 Nerepis Road, NBGIC No. 00229088, pursuant to Section 4(2) of the Town’s By-law No. 16, Town of Grant Bay-Westfield Zoning By-law, Division II.  Authorization for the development described above is hereby granted for the temporary period of October 1, 2001 expiring October 15, 2001, or any two week period commencing from the date of sale of the property,  to expire on December 31, 2001.  At the end of the authorized period, you are hereby required to terminate and remove the development hereby authorized….”
Motion seconded by Cllr. Little.  Carried with two (2) Nay Votes.
7. DEVELOPMENT OFFICER’S REPORT DATED SEPTEMBER 13, 2001  RE:  REQUEST FOR VARIANCE – CAROL DUBE´30 INGLESIDE COURT, NBGIC NO. 00459834
A discussion was held in Closed Session regarding a Request for Variance to add a second floor to the main building, requiring a variance on the height.  The Development Officer informed the Committee that this is a two family dwelling with an apartment in the basement and that the applicant wishes to add a second story to the main dwelling.
An addition to this item was handed out to the Committee, i.e. letter dated September 11, 2001 from surrounding property owners, Tom and Pauline Cote, stating no objection but with one concern.
Applicant, Carol Dube´ was present during the Open Session and advised the Committee of the following:

  • The addition is not an apartment but will consist of bedrooms and a rec room for her kids;
  • Her parents will be living with her in the basement apartment;
  • The sale of the property depends on whether or not the variance is approved.

Also present were Michael and Mark Savoy, representing their mother, Mrs. Rita Savoy of 20 Ingleside Court.  They advised the Committee of the following concerns:

  • what type of building was being proposed and wished to view the plans;
  • as this is in a R2 Zone, another apartment is not permitted;
  • their privacy at the back of their property would be altered due to the additional height of the building.

Following the above presentations, the Applicant’s plans were shown to Michael and Mark Savoy.
The following motion was then made:
“…moved by Bill McCann that the Planning Advisory Committee grant the following variance to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 16, Division I, for the development of an additional floor on the existing main building, located at 30 Ingleside Court, NBGIC No. 00459834:
a)      under Section 14, grant a variance of 0.75 m to increase the maximum height from 9.0 m to 9.75 m….”
Motion seconded by Ralph Stevens.  Carried.
8.  DEVELOPMENT OFFICER’S REPORT DATED SEPTEMBER 13, 2001  RE:  REQUEST FOR VARIANCE – RON & WENDY PYE, 23 MAJESTIC DRIVE, NBGIC NO. 30070452
A discussion was held in Closed Session regarding the above Request for Variance to locate an accessory building, requiring a variance to the front yard set back.
The Development Officer reported that the accessory building was placed on this location without a Building Permit, and that he made the Applicants aware of this fact six months ago.
The Applicants were not present during the Open Session.
There were no presentations made in favor of or against this proposal.
The following motion was then made:
“…moved by Ralph Stevens that the Planning Advisory Committee deny this Application, Re:  Request for Variance – Tom and Wendy  Pye, 23 Majestic Drive….”
Motion seconded by Bill McCann.  Carried.
9. DEVELOPMENT OFFICER’S REPORT DATED SEPTEMBER 13, 2001  RE:  ITEM TABLED SEPTEMBER 4, 2001 MEETING  REVIEW OF BUILDING BY-LAW, VALUE OF BUILDING PERMITS
Following a brief report by the Development Officer, the following was made:
“…moved by Ralph Stevens that the Planning Advisory Committee recommend Council consider the adoption of the following revisions to the Building By-law by the enactment of Draft By-law No. 17B….”
Motion seconded by Michael Hare.  Carried.
10. DEVELOPMENT OFFICER’S MEMO DATED SEPTEMBER 13, 2001  RE:  CONSULTANT’S PRESENTATION TO COUNCIL –  MUNICIPAL PLAN BY-LAW & ZONING BY-LAW REVIEW
“…moved by Michael Hare to receive and file the Development Officer’s Memo Re:  Consultant’s Presentation to Council – Municipal Plan By-law & Zoning By-law Review….”
Motion seconded by Mel Steffens.  Carried.
