CALL TO ORDER
The Town of Grand Bay-Westfield Planning Advisory Committee met for a regular meeting on Monday, September 17, 2012 at 8:01 p.m. with Chair, Ralph Stevens presiding.

There was no one present with regard to this Application.

8. APPLICATION FOR VARIANCE RE: MIKE O’LEARY –  733 RIVER VALLEY DRIVE
(A) DEVELOPMENT OFFICER’S REPORT SEPTEMBER 13, 2012
(B) E-MAIL RECEIVED SEPTEMBER 14, 2012 FROM VICKIE GAUNCE
Applicant, Mike O’Leary was present and addressed the Committee as follows:
This Application for Variance is for the installation of propane tanks for his 3-Bay Car Wash; when he made his Application one year ago, it did not include the tanks, as he was unsure if he would go with electric, oil or propane; he has since decided to use propane tanks, however, the location in which Irving recommended they be placed does not fall under the By-law requirements of 3 m minimum setback from buildings and property lines; they are located at the back of the building and he has put extra barriers and sod in the area; there is a wait of 2 ½ weeks to have them hooked up, as they are not commissioned yet; he is willing to do whatever the Town deems necessary; he is prepared to move them if the Variance is denied and is willing to incur the cost.
The Committee asked the Applicant if Irving Regulations were met and was this the best location?
Mr. O’Leary replied yes Irving Regulations were met and this was deemed the best location for the tanks, due to the fact that the vacuums are located on the left side of the building and the positioning of the flood lights.
There was no one present speaking in favor of this Application.
Speaking against this Application was Vickie Gaunce of 37 Epworth Park Road.
Ms. Gaunce addressed the Committee as follows:
She operates a business directly behind the Car Wash; the front of her building faces the tanks and they are an eye sore; the view of the road is now obscured; she is worried that snow removal will be an issue; is it not dangerous to have them placed less than 3 m from a building? she does not understand why the Town would allow this as it has By-laws; she would like to see them moved to the side of the building; concerned for the safety of children as they go through the lot.
“…moved by Chyann Kirby that the Planning Advisory Committee APPROVE the following Variance Request to the Town’s Zoning By-law, Town of Grand Bay-Westfield By-law No. 112: i) under Section 5.1.3 (a) grant a Variance of 1.63 m to reduce the rear yard setback from 3 m to 1.37 m to locate three propane storage tanks on the rear of the building as per submitted Site Plan.…”
Seconded by Ron Daigle.  Carried.
