The Town of Grand Bay-Westfield Planning Advisory Committee met for a regular meeting on Tuesday, September 5, 2006 at 8:08 p.m. with Chairman, Ralph Stevens presiding.

8. REQUEST FOR SIMILAR AND COMPATIBLE USE RE: MARY LEDDEN – 5 WOOLASTOOK DRIVE
(A)  DEVELOPMENT OFFICER’S REPORT DATED AUGUST 31/06
(B) E-MAIL RECEIVED FROM THE TIBBETS DATED AUGUST 25/06
The Applicant’s husband, Michael MacLeod was present and informed the Committee that in his opinion there was no need for a Variance, as the property was once granted a Non-Conforming Use Status and now has a home based business on the main level above the commercial businesses and the second floor would have a residential unit.
It was noted that the e-mail received from the Tibbetts stated no objection to this Application.
There was no one present speaking in favor of or against this Application.

 9. REQUEST FOR VARIANCE RE: MCGUIRE EXCAVATING LTD.   PHASE 2 & 4 – PANORAMIC ESTATES SUBDIVISION
(A) DEVELOPMENT OFFICER’S REPORT DATED AUGUST 31/06
(B) LETTER RECEIVED FROM JODY & JANICE BLAKELY/JEFF & LORI MCGOVERN DATED AUGUST 28/06
(C) E-MAIL RECEIVED FROM LINDA ESTABROOKS DATED SEPTEMBER 5/06
(D) E-MAIL RECEIVED FROM ADI LTD. DATED SEPTEMBER 1/06
Linda Estabrooks excused herself from the Committee and sat in the public area during the Open Session for this item.
Applicant, Sam Maguire was present and advised the Committee that he had nothing further to add to this Application.
The following residents expressed their concerns to the Committee:
* Linda Estabrooks – 113 Woolastook Drive
* Mrs. Estabrooks has concerns with regard to the protection of wells and that from the Fundy Engineering     Water Assessment Report, she noted that the data base does not appear to be current.
Mr. Maguire advised that Fundy Engineering Ltd. prepared the Water Assessment under the guidelines of the Department of Environment. He advised that he would ask for clarification for the Committee.
When asked how the water run off will be controlled for the proposed lots C-1 to C-7, Mr. Maguire advised that storm sewers with concrete curb and gutters will be installed on the road to collect the storm water and that Geotechnical input and plans to be prepared by ADI Ltd. would demonstrate effective control measures to the Committee.
* Jeff McGovern – 141 Woolastook Drive     Due to the fact that the adjacent property owners had problems with the previous developer, Mr. McGovern asked     if is there a better monitoring system in place with this new development?
Mr. Maguire stated that there are two safety checks in place, first ADI Ltd. does an inspection and then the Town’s Engineering Firm of Godfrey& Associates Ltd. does their inspection, but that he as the developer is ultimately responsible.
Mr. McGovern also inquired if the future property owners would be able to bring in fill and alter slopes on their own?
Mr. Maguire advised that he is prepared to protect the Town so that this does not become a problem, and that this could be addressed in the Deed of the sale of the property.
The Committee then expressed to Mr. Maguire that more information needs to be forthcoming in writing, particularly how they are going to address water run off onto Woolastook Drive, and also the concerns addressed by the residents present this evening, in particular items of concern listed in the letter received from Jody & Janice Blakely and Jeff & Lori McGovern, a copy of which he was previously given.
Mr. Maguire agreed that he would be willing to submit the required information.
