PAC Minutes – September 7, 1999

The regular meeting of the Town of Grand Bay-Westfield Planning Advisory Committee was held Tuesday,  September 7, 1999 at 7:00 p.m. in Room “A”.  Chairman, Larry Chapman conducted the meeting and called the meeting to order at 7:07 p.m.

2. P.A.C. MINUTES OF AUGUST 16, 1999
It was moved by Philip Kelly and seconded by Bill McCann to accept the August 16, 1999 P.A.C. Minutes as presented.
Motion carried.
3. CHAIRMAN’S REMARKS
No remarks.
4.  DECLARATION OF CONFLICT OF INTEREST
No conflict declared.
5. TELEPHONE POLL CONDUCTED AUGUST 24, 1999 RE: REQUEST FOR APPROVAL OF A HOME OCCUPATION MAUREEN DIGNARD – 21 BAYVIEW ROAD
It was moved by Ralph Stevens and seconded by James Evans to ratify the following  Telephone Poll.
Motion carried.
By authorization of the Planning Advisory Committee Chairman, Larry Chapman, regarding a Request for Approval of a Home Occupation for a Day Nursery made by Maureen Dignard, 21 Bayview Road, as follows:
“…moved that the Request for Approval of a Home Occupation for a Day Nursery be approved, subject to the following:
1. terms of Section 68 of the Grand Bay-Westfield Zoning By-law Division 1, a Home Occupation is subject to the requirements that:
(a) not more than one person is engaged therein, in addition to members of the family residing in the dwelling unit in which it is located;
(b) it is confined to the dwelling unit, and no part of it is located in an accessory building or structure;
(c) the floor area of the dwelling unit which is devoted to it does not exceed the lesser of:
(i) 20 percent of the floor area of the dwelling unit, or
(ii) 27 square metres (300 square feet);
(d)  no change, except for a sign permitted under Subsection (2) of Section 70 of  the Zoning By-law is made in the outside appearance of the building which would indicate that a Home Occupation is being conducted therein;
(e)  no goods or services other than those directly pertaining to the Home Occupation are supplied or sold therein or therefrom;
(f)  no equipment or material used therein is stored other than in the dwelling unit mentioned in Clause (a);
(g)  no commercial vehicle used in connection therewith, and no vehicles of any kind bearing a sign in connection therewith is stored on the lot on which the dwelling containing it is located, except in a wholly enclosed building;
(h)  two off street parking spaces are provided in excess of the one required for the dwelling unit meeting the requirements of Section 66(3) of the Zoning by-law;
2. Application to and approval of all Health and Community Services Standards for a Day Care Centre or Community Day Care Home, including  review and approvals by the Office of the Fire Marshall and the Department of Health;
3. the Application and approval of a Building Permit for a proposed fence in the front and side yard;
4.  one additional sanitary sewerage user unit shall be charged as set out in Schedule “A” of Grand Bay-Westfield By-law No. 2, Sanitary Wastewater System.
The above noted terms and conditions shall be verified through inspections by and correspondence between the Town of Grand Bay-Westfield Building Inspector and the Provincial regulatory bodies having jurisdiction….”
6.  REQUEST FOR VARIANCE RE: ALLAN MCCLUSKEY – 250 HIGHLAND ROAD
A discussion was held in Closed Session regarding the above Request for variance to construct a detached garage, exceeding the maximum floor area required.
Development Officer, David Taylor advised that the Applicant plans to use the same siding as on the house.  The surrounding property owners have been contacted with no objections received.
Due to the short Agenda, the Secretary attempted to contact Allan McCluskey to advise him that he could attend the Open Session at 7:30 p.m. rather than 8:00 p.m., however to no avail.  The following motion was then made:
“…It was moved by Philip Kelly that P.A.C. approve the Request for Variance made by Allan McCluskey of 250 Highland Road, to construct a detached garage 24 ft. wide by 32 ft. deep, with a floor area of 768 sq. ft., exceeding the maximum floor area of 645 sq. ft….”
Motion seconded by Ralph Stevens.  Motion carried.
7. ADJOURNMENT
Ralph Stevens moved to adjourn at 7:15 p.m.
The Secretary remained until 8:00 p.m. in the event Allan McCluskey arrived for the Open Session.  However, he did not appear.
