Town of Grand Bay-Westfield
Sanitary Wastewater System By-law AmendmentThe Council of the Town of Grand Bay-Westfield under authority vested in it by Section 189 of the Municipalities Act, R.S.N.B. 1973, c.M-22 and amendments thereto, hereby enacts as an amendment to By-law No. 2, Town of Grand Bay-Westfield By-law respecting the Sanitary Wastewater System.
1(1). Subsection 26(1) of By-law No. 2 is hereby amended by deleting the following:
26(1). The cost of financing, operating and maintaining the sewer system shall be raised by a user service charge and the owner of a building receiving sewerage services shall pay a user charge of a uniform rate as set out in a resolution of Council multiplied by the number of user units assessed to the service connection in accordance with Schedule “A”, a schedule of user units adopted by a resolution of Council or as individually set by a resolution of Council.
and replacing as follows:
26(1) The cost of financing, operating and maintaining the sewer system shall be raised by a user service charge and the owner of a building receiving sewerage services shall pay an annual user charge per user unit, established in accordance with subsection 26(1.1) of this By-law, multiplied by the number of user units assessed to the service connection in accordance with Schedule “A”.
1(2). By-law No. 2 is hereby amended by inserting a subsection 26(1.1) following subsection 26(1) as follows:
26(1.1) Subject to subsection 26(1.3) hereof, the annual user charge per user unit referred to in subsection 26(1) of this By-law shall be $245.00.
1(3). By-law No. 2 is hereby amended by inserting a subsection 26(1.2) following subsection 26(1.1) as follows:
26(1.2) The annual user charge established by subsection 26(1) hereof is due and payable on the day on which the invoice therefor is mailed.
1(4). By-law No. 2 is hereby amended by inserting a subsection 26(1.3) following subsection 26(1.2) as follows:
26(1.3) Where there are no arrears or penalties payable in respect of the annual user charge established by subsection 26(1) hereof, a discount not exceeding $15.00 per unit, applicable to residential units only, shall be allowed provided that payment of the annual user charge is received by the Municipality no later than 5:00 p.m., April 1, of the year in respect of which the annual user charge is invoiced.
1(5). By-law No. 2 is hereby amended by inserting a subsection 26(1.4) following subsection 26(1.3) as follows:
26(1.4) Schedule “A” referred to in subsection 26(1) hereof shall form part of this By-law.
1(6). By-law No. 2 is hereby amended by inserting a heading entitled “REPEAL” and a section 31 following subsection 30(2) as follows:
REPEAL
31. Town of Grand Bay By-law No. 180 entitled “By-law relating to Sanitary Wastewater System and Village of Westfield By-law No. 70 entitled “By-law relating to Sewerage System “ are hereby repealed.
1(7). Subsections 1(1), 1(2) and 1(4) of this Amendment to By-law No. 2 shall come into force on January 1, 1999.
