AMENDMENT TO BY-LAW NO. 2, TOWN OF GRAND BAY-WESTFIELD BY-LAW RESPECTING
THE SANITARY WASTEWATER SYSTEM

The
Council of the Town of Grand Bay-Westfield under the authority vested in
it by Section 189 of the
|
|
Municipalities
Act, R.S.N.B. 1973, c. M-22, and amendments thereto, hereby enacts
as an amendment to By-law No. 2, Town of Grand Bay-Westfield By-law Respecting
the Sanitary Wastewater System. Subsection 26(3) of By-law No. 2, as amended
by By-law No. 2A, is hereby amended by deleting the following:

and
replacing, as follows:
|
|
"In
the event that any person, having received a request by, or an order from
the Municipality to connect to the municipal sewer system, refuses or neglects
to connect to the said sewer system within the time frame fixed by the
Municipality, said person shall be liable to legal action by the Municipality
requesting an order from the Court of Queen's Bench of New Brunswick to
compel said person to connect to the sewer system, and to compel the said
person to pay the costs of the Municipality in connection with such legal
action, pursuant to Section 106.1 of the Municipalities Act."
