REGULAR COUNCIL MEETING MINUTES
MONDAY, JANUARY 10, 2000The Town of Grand Bay-Westfield met in a regular session on Monday, January 10, 2000 at 7:30 p.m. with Mayor Losier presiding.

RECORD OF ATTENDANCE All members were in attendance with the exception of Councillor Calvin and Councillor Keir.
It was noted that Councillor Calvin was in attendance for Information Session.
Councillor Sutton moved to pay Councillor Calvin and Councillor Keir in their absence.

DISCLOSURE OF CONFLICT OF INTEREST Councillor McGowan declared a conflict of interest with the following item from Bills for Ratification: $

DEVELOPMENT OFFICER’S REPORT OF JANUARY 5, 2000 RE: UNSIGHTLY PREMISES BY-LAW – 60 YOUNG STREET, NBGIC #00219113 David Taylor, Development Officer, gave a presentation regarding the unsightly premises at 60 Young Street, noting that three letters and a final notice had been sent to the property owner identifying the dangerous and unsightly conditions.
Mayor Losier inquired if there was anyone wishing to speak regarding 60 Young Street, NBGIC #00219113.
No one spoke in regard to the property at 60 Young Street.
Councillor Sutton moved to concur with the recommendation of the Development Officer in his report of January 5, 2000 in that:
1) the Town proceed with a Notice to be served by the Clerk on the owner of the property at 60 Young Street, having NBGIC #00219113 in accordance with section 190 of the Municipalities Act for permitting the property to become dilapidated or deteriorated so as to be in a dangerous unsightly or unhealthful condition, to require the following work to be carried out:
a) remove automobile with expired license plate No. C39-876 (1979);
b) remove all metal scraping and miscellaneous wood from property;
c) remove makeshift storage space behind vehicle.2) upon failure on the part of the owner to comply with the Notice within 60 days the Town will proceed with an application to the Court of Queens Bench to remedy the outstanding violation.

DEVELOPMENT OFFICER’S REPORT OF JANUARY 5, 2000 RE: UNSIGHTLY PREMISES BY-LAW – 140 GEORGE STREET, NBGIC #00077370 David Taylor, Development Officer gave a presentation regarding the unsightly premises at 140 George Street noting that three letters and a final notice had been set out to the property owner identifying the dangerous and unsightly conditions and the time frame required to remedy such conditions.
Mayor Losier inquired if there was anyone wishing to speak regarding 140 George Street, NBGIC #00077370.
No one spoke in regard to the property at 140 George Street.
Councillor McGowan moved to concur with the recommendation of the Development Officer in his report of January 5, 2000 in that:
1. the Town proceed with a Notice to be served by the Clerk on the owner of the property at 140 George Street, having NBGIC #00077370 in accordance with section 190 of the Municipalities Act for permitting the property to become dilapidated or deteriorated so as to be in a dangerous unsightly or unhealthful condition to require the following work to be carried out:
1. remove charcoal pick-up truck S-15 license no. CCQ206
2. remove blue GMC Van license no. CF9401
3. remove ford Tempo L unlicensed
4. remove brown Mercury unlicensed
5. remove red Chevrolet license no. BPF342
6. remove red Pontiac license no. BPG 97
7. remove brown Mercury Lynx unlicensed
8. remove blue GMC S 15 pick up truck license no. CBZ534
9. remove dump truck unlicensed
10.remove single axle with 2 mounted tires2. upon failure of the owner to comply with the Notice within 60 days, staff is directed to proceed with an application to the Court of Queens Bench to remedy the outstanding violations.

DEVELOPMENT OFFICER’S REPORT OF JANUARY 5, 2000 RE: UNSIGHTLY PREMISES BY-LAW – 8 HILLSIDE ROAD, NBGIC #00227405 David Taylor, Development Officer gave a presentation regarding the unsightly premises at 8 Hillside Road, noting that three letters and a final notice were sent to the property owner identifying the dangerous and unsightly conditions and the time frame to remedy such conditions.
Mayor Losier inquired if there was anyone wishing to speak regarding 8 Hillside Road, NBGIC #00227405.
No one spoke in regard to the property at 8 Hillside Road.
Deputy Mayor Black moved to concur with the recommendation of the Development Officer in his report of January 5, 2000 in that:
1. the Town proceed with a Notice to be served by the Clerk on the owner of the property at 8 Hillside Road, having NBGIC #00227405 in accordance with section 190 of the Municipalities Act for permitting the property to become dilapidated or deteriorated so as to be in a dangerous, unsightly or unhealthy condition to require the following work to be carried out:
a. secure all openings to garage to prevent unauthorized entry;
b. remove all loose debris/structures around garage and main building;
c. remove abandoned vehicle identified as a 1987 Hyundai, red in colour with license plate no. BHI 723;
d. secure all openings (windows and deteriorated wall below main entrance) to main building to prevent unauthorized entry.2. upon failure on the part of the owner to comply with the Notice within 30 days, staff will proceed with application to the Court of Queens Bench to remedy the outstanding violations.

5. PUBLIC PRESENTATIONS 5.1
R.C.M.P. STATISTICAL REPORT FOR THE MONTH OF DECEMBER, 1999 Cst. Norman Adams presented the R.C.M.P. Statistical Report for the month of December, 1999.
Councillor Sutton moved to receive and file the R.C.M.P. Statistical Report for the month of December, 1999.

RECOGNITION OF CST. NORMAN ADAMS ON HIS CERTIFICATE OF RECOGNITION FROM THE CRIME PREVENTION ASSOCIATION Mayor Losier presented Cst. Norman Adams with a letter and congratulated Cst. Adams on receiving a Certificate of Recognition from the Crime Prevention Association.
Cst. Adams expressed his appreciation on his nomination for the award by the Town.

LETTER OF RECOGNITION TO CAPTAIN TROY GAUTREAU RE: COMPLETION OF FIRE SERVICE INSTRUCTOR LEVEL 1 COURSE Mayor Losier presented Captain Troy Gautreau with a letter of congratulations on his completion of the Fire Service Instructor Level I Course.

TELEPHONE POLL OF DECEMBER 13, 1999 RE: CHRISTMAS GIFT CHEQUES Councillor Sutton moved to ratify the Telephone Poll of December 13, 1999 in that authorization be granted for Christmas Gift Cheques for $30.00 each as per list dated December 10, 1999.

TELEPHONE POLL OF DECEMBER 22, 1999 RE: PAYMENT OF INVOICE FOR THE FIRE RESCUE VEHICLE Deputy Mayor Black moved to ratify the Telephone Poll of December 22, 1999 in that authorization be granted to pay $209,921.35 (less 3% holdback for 90 days) for the Fire Rescue Vehicle complete with chassis per recommendation of the Fire Chief; in addition authorization is granted to transfer $140,000 from the General Capital Reserve Fund to the General Operating Fund Re: Purchase of Fire/Rescue Van.

BILLS FOR PAYMENT Councillor McGowan departed the meeting due to a stated conflict of interest.
Councillor Sutton moved to approve the following item from the Bills for Ratification: $

Councillor McGowan rejoined the meeting.
Councillor Sutton moved to pay the Bills for Payment enbloc for a total of $112,548.88, and approve the remaining Bills for Ratification for a total of $61,547.39, Grand Total $174,096.27.

TOWN OF GRAND BAY-WESTFIELD SEWERAGE UTILITY ACCOUNTS RECEIVABLE REPORT AS AT JANUARY 6, 2000 Deputy Mayor Black moved to receive and file the Town of Grand Bay-Westfield Sewerage Utility Accounts Receivable Report as at January 6, 2000.

LETTER OF DECEMBER 10, 1999 FROM HEART AND STROKE FOUNDATION OF NEW BRUNSWICK RE: FEBRUARY HEART MONTH Councillor Sutton moved to grant permission to the Heart and Stroke Foundation of New Brunswick to canvass door-to-door throughout the Town of Grand Bay-Westfield during the month of February.

FAX OF JANUARY 4, 2000 FROM FEDERATION OF CANADIAN MUNICIPALITIES RE: CRTC INITIATING RIGHTS-OF-WAY PROCEEDING Councillor Sutton moved to concur with the Federation of Canadian Municipalities (FCM) to encourage the CRTC to establish a clear and fair protocol for access to municipal property by telecom companies; this protocol will facilitate the negotiation of reasonable settlements confirming to the five FCM rights-of-way principles as follows:
1. in pursuance of bona fide municipal purposes, municipal governments must have the ability to manage the occupancy and uses of rights-of-way, including the establishment of the number, type and location of telecommunications and broadcasting facilities, while taking into account applicable technical constraints;
2. municipal governments must recover all costs associated with occupancy and use of rights-of-way by telecommunications service providers and broadcasting undertakings;
3. municipal governments must not be responsible for the costs of relocating telecommunications and broadcasting facilities if relocation is required for bona fide municipal purposes;
4. municipal governments must not be liable for losses associated with the disruption of telecommunications or broadcasting services or with damage to the property of telecommunications service providers or broadcasting undertakings as a result of usual municipal activities or the activities of other parties;
5. recognizing that rights-of-way have value, municipal governments must receive full compensation for the occupancy and use of municipal rights-of-way by telecommunications service providers and broadcasting undertakings.
Also, authorization is granted to contribute to the FCM Municipal Rights-of-Way Defence Fund at 3 cents per capita for a total of $146.40.

LETTER RECEIVED DECEMBER 8, 1999 FROM MINISTER OF ECONOMIC DEVELOPMENT, TOURISM AND CULTURE RE: HERITAGE WEEK 2000 Councillor McGowan moved to refer letter received December 8, 1999 from the Minister of Economic Development, Tourism and Culture Re: Heritage Week 2000 to the Recreation Director for action.

LETTER OF NOVEMBER 12, 1999 FROM COMMUNICATIONS NEW BRUNSWICK RE: SUPPORT FOR EMERGENCY PREPAREDNESS PROJECTS IN NEW BRUNSWICK Councillor Sutton moved staff identify emergency preparedness projects that may be partially funded from the federal and provincial governments through JEPP.

It was noted that the Town of Grand Bay-Westfield was successful in obtaining 1999 - 2000 funding from JEPP in the amount of $42,500 towards the purchase of the new fire/rescue vehicle.

REPORT OF JANUARY 5, 2000 FROM RECREATION DIRECTOR RE: LETTER RECEIVED DECEMBER 17, 1999 FROM WESTFIELD AND DISTRICT RECREATION COMMISSION Deputy Mayor Black moved to concur with the recommendation of the Recreation Director in his report of January 5, 2000 with authorization to forward the fourth quarterly payment of $1,000 for 1999 to the Westfield and District Recreation Commission.

REPORT OF JANUARY 5, 2000 FROM TOWN MANAGER RE: APPLICATION FOR ENHANCED FIRE SERVICE ARRANGEMENT Councillor McGowan moved that the Town of Grand Bay-Westfield make application to the NB 9-1-1 Service Branch for the Grand Bay-Westfield Volunteer Fire/Rescue Department to participate in an enhanced fire service arrangement with appropriate correspondence to be forwarded to NB 9-1-1 under the signature of Mayor Losier and Fire Chief McCoy noting Chief McCoy as the contact for the Town.
