MINUTES
MONDAY, MAY 10, 1999
The Town of Grand Bay-Westfield met in a regular session on Monday, May 10, 1999 at 7:45 p.m. with Councillor Keir presiding.
It was with unanimous consent that the following item be added to the agenda as item 1a:

TELEPHONE POLL OF MAY 6, 1999 RE: APPOINTMENT - COUNCILLOR KEIR Councillor Calvin moved to ratify Telephone Poll of May 6, 1999 in that per section 5(5) of Procedural By-law No. 1 Councillor Jack Keir is, in the absence or inability of both the Mayor and the Deputy Mayor, to act in place and stead of the Mayor.
Seconded by Councillor McGowan. Carried.

RECORD OF ATTENDANCE All members were in attendance with the exception of Mayor Losier and Deputy Mayor Black.
Councillor Sutton moved to pay Mayor Losier and Deputy Mayor Black in their absence.

R.C.M.P. STATISTICAL REPORT FOR THE PERIOD APRIL 7 – MAY 5, 1999/LETTER OF MARCH 30, 1999 FROM ROYAL CANADIAN MOUNTED POLICE RE: 1999/2000 DIRECTIONAL STATEMENT OF THE R.C.M.P/FAX OF APRIL 27, 1999 FROM CPL. MATTHEWS, ROYAL CANADIAN MOUNTED POLICE RE: GRAND BAY-WESTFIELD COVERAGE/LETTER OF APRIL 26, 1999 FROM RIVER VALLEY COMMUNITY CENTER TO RCMP – CST. STEPHANE LANGLOIS ATTENDING Cst. Stephane Langlois presented the April 7 – May 5, 1999 Statistical Report.
It was noted that there is ongoing communication between the RCMP and Kelly Goddard’s office of the River Valley Community Center to establish a common goal of having the youth of the area respect the River Valley Community Center property.
It was noted that Staff Sergeant Brown will be requested to meet with Council to discuss RCMP issues in general and arrangements will be made through the Town Manager’s office.

LETTER OF APRIL 7, 1999 FROM WESTFIELD AND DISTRICT RECREATION COMMISSION/REPORT FROM RECREATION DIRECTOR DATED APRIL 8, 1999 RE: 1999 FINANCIAL REQUEST FROM WESTFIELD AND DISTRICT RECREATION COMMISSION – SIX REPRESENTATIVES FROM THE WESTFIELD AND DISTRICT RECREATION COMMISSION ATTENDING Sana Nearing introduced members of the Westfield and District Recreation Commission as follows: Dave Thornton, Chairman, Barb Martin, Twila Hitchcock, Lori Maxan, and Keith Martin.
Sana Nearing gave a presentation requesting the Town of Grand Bay-Westfield donate $5,700 to the Westfield and District Recreation Commission.
Following Mrs. Nearing’s presentation it was noted that the Commission’s request will be discussed with the Recreation Director, Gary Clark in terms of the Recreation Budget and duplication of services.

ENTERPRISE SAINT JOHN (ESJ) 1998 AUDITED FINANCIAL STATEMENTS – ESJ REPRESENTATIVES ATTENDING David Barry, Chairperson of Enterprise Saint John introduced Steve Carson, General Manager and Diane Bormke, Treasurer.
David Barry offered comments regarding the Greater Saint John Economic Development Commission Financial statements as at December 31, 1998. Mr. Barry noted ESJ will be forwarding a letter to the area Councils to address the Commission’s financial procedures.

MINUTES OF REGULAR COUNCIL MEETING OF APRIL 26, 1999 Councillor Calvin moved to adopt the minutes of the regular Council meeting of April 26, 1999 as presented.

MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF APRIL 19, 1999 Councillor Sutton moved to receive and file the minutes of the Planning Advisory Committee meeting of April 19, 1999.

TELEPHONE POLL OF APRIL 29, 1999 RE: DONATION TO RCMP FOR BICYCLE RODEO Councillor Calvin moved to ratify the Telephone Poll of April 29, 1999 in that authorization be granted for a donation of $300.00 to the 1999 RCMP sponsored Bicycle Safety Rodeo per written request of April 14, 1999 from Constable Norm Adams.

TENDER NOTES OF MAY 5, 1999 RE: SERVICES BY A QUALIFIED CARPENTER #0028C-99 Councillor Sutton moved to receive and file the Tender Notes of May 5, 1999 Re: Services by a Qualified Carpenter #0028C-99.

BILLS FOR PAYMENT Councillor Sutton moved to pay the Bills for Payment enbloc for a total of $52,276.72, and approve the Bills for Ratification for a total of $46,847.85, Grand Total $99,124.57.

WORKS COMMISSIONER’S REPORT OF MAY 5, 1999 RE: PARTIAL MORTGAGE DISCHARGE/LETTER OF MAY 5, 1999 FROM SOLICITOR RALPH POLEY, GORMAN NASON RE: LETTER FROM DONALD J. STEVENSON CONCERNING 7 CRYSTAL COURT (LOT 89-8 ON PLAN #10569) Councillor Calvin moved that whereas the Town of Grand Bay-Westfield is the Mortgagee in a certain indenture of Mortgage dated the 7th day of September, 1990 and made by Nu - Life Developers Ltd. as Mortgagor, duly registered in Kings County Records by the number 276320 in Book 858 at page 551; and whereas the Town has received a request for a Partial Discharge of the said Mortgage from W. K. Webb & Assoc., the owner of Lot 89-8, discharging the said Lot 89-8 from the said Mortgage; and whereas there are no obligations of the present owner of the said lot 89-8 in respect of the said Mortgage, therefore be it resolved that the Mayor and Manager (Clerk) be and hereby are authorized to execute a Partial Discharge of the said Mortgage, discharging the said lot 89-8 of and from its terms, as requested.

LETTER OF APRIL 28, 1999 FROM PAUL MCILVEEN RE: STREET LIGHT AT PROSSER COURT Councillor McGowan moved to forward a letter to Mr. Paul McIlveen Re: Street Light at Prosser Court providing responses to the inquiries listed in his letter of April 28, 1999.

FAX OF APRIL 23, 1999 FROM ANDREW MORTON, DEPUTY DIRECTOR EMERGENCY MEASURES ORGANIZATION RE: APPLICATION FOR JEPP FUNDING FOR PURCHASE OF RESCUE VEHICLE FOR VOLUNTEER FIRE DEPARTMENT Councillor Sutton moved to refer fax of April 23, 1999 from Andrew Morton, Deputy Director Emergency Measures Organization Re: Application for JEPP Funding for Purchase of Rescue Vehicle for Volunteer Fire Department to the Town Manager to provide details on available funding.

LETTER OF MARCH 30, 1999 RE: LEEMING EXPRESS – 1 WONG WAY/WORKS COMMISSIONER’S REPORT OF MAY 5, 1999 Councillor McGowan moved to concur with the recommendation of the Works Commissioner in his Report of May 5, 1999 in that a letter be forwarded to concerned property owners on Wong Way advising them that the operation of a delivery service outside of the home is not a business under the Zoning By-law, even if calls are received at home; the Town will forward a letter to the property owner at 1 Wong Way asking that the property be cleaned up and a formal notice will be sent to the property owner if the property is not cleaned up voluntarily.

WORKS COMMISSIONER’S REPORT OF MAY 5, 1999 RE: 10 FIRST STREET/LETTER OF MAY 5, 1999 FROM SOLICITOR RALPH POLEY, GORMAN NASON RE: 10 FIRST STREET – GRAND BAY-WESTFIELD PROPERTY Councillor Sutton moved to concur with the recommendation of the Works Commissioner in his report of May 5, 1999 in that authorization be granted for appropriate signatures for documents as approved by the Town’s Solicitor and attached to his correspondence of May 5, 1999 and that Mr. McAulay be paid $47.00 for the granting of the redefined municipal sewer easement across his property.

TOWN MANAGER’S REPORT OF MAY 5, 1999 RE: QUOTATIONS FOR SERVICES BY A QUALIFIED CARPENTER Councillor Calvin moved to concur with the recommendation of the Town Manager in her report of May 5, 1999 in that Hilton Lomax be engaged to provide the services of a qualified carpenter for the period May 26, 1999 to May 26, 2001, subject to all terms and conditions of Quotation Number 028C-99 and per hourly rate submitted in the Hilton Lomax quotation dated May 3, 1999.

LETTER OF APRIL 29, 1999 FROM HON. MARCELLE MERSEREAU, MINISTER OF MUNICIPALITIES AND HOUSING RE: "MUNICIPAL GUIDELINES FOR YEAR 2000 EMERGENCY PLANNING" Councillor Calvin moved to refer letter of April 29, 1999 from Hon. Marcelle Mersereau, Minister of Municipalities and Housing Re: “Municipal Guidelines for Year 2000 Emergency Planning” for an appropriate response to Hon. Marcelle Mersereau.

RECREATION DIRECTOR’S REPORT OF MAY 6, 1999 RE: 1999 BALLFIELD ALLOCATIONS Councillor Sutton moved to concur with the recommendation of the Recreation Director in his report of May 6, 1999 in that the following be implemented:
1. the allocation of Ballfield time will be set annually by the Recreation Director following field request times for the various leagues submitted in writing no later than the second week of April;
2. leagues consisting of a majority of players over 19 years of age that use the lights at River Valley Middle School will be required to pay $100 per team to cover the cost of power for the lights.Seconded by Councillor Calvin. Carried.
