1.  CALL TO ORDER - 7:30 P. M.
The Town of Grand Bay-Westfield Council met in a regular session on Monday, December 12, 2005 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE
All members of Council were in attendance with the exception of Councillor Day.

Councillor McGowan moved to pay Councillor Day in her absence.

Seconded by Councillor Evans.  Carried.
 

3.  APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Councillor Evans moved to adopt the agenda as presented and add items 26.a – Proposed Transfer from the Sub-division Fund, 26.b - Proposed Transfer to the General Capital Reserve Fund, and 26.c - Proposed Transfer from the Capital Reserve Fund (Wharf).

 Seconded by Councillor McGowan.  Carried unanimously.

RCMP REPRESENTATIVE ATTENDING

 Cst. Gregoire presented the RCMP Statistical Report for November 2005.

 Deputy Mayor Murphy moved to receive and file the RCMP Statistical Report for November 2005.

6.2 PRESENTATION
RE:  PROPOSED OPERATING BUDGET FOR 2006 FOR FUNDY REGION SOLID WASTE COMMISSION - JACK KEIR, GENERAL MANAGER AND RICHARD MCLEAN, TOWN REPRESENTATIVE, FUNDY REGION SOLID WASTE COMMISSION ATTENDING 

 Richard McLean, Town Representative introduced Jack Keir, General Manager, Fundy Region Solid Waste Commission.  Jack Keir presented Council with an overview of the Proposed Operating Budget for 2006 for Fundy Region Solid Waste Commission.

 Deputy Mayor Murphy moved to receive and file the presentation Re:  Proposed Operating Budget for 2006 for Fundy Region Solid Waste Commission as presented by  Jack Keir, General Manager, Fundy Region Solid Waste Commission and to advise the Town’s representative Council is in support of the budget as presented.

 Seconded by Councillor Little.  Carried.

 Richard McLean and Jack Keir were thanked for their excellent service to the Fundy Region Solid Waste Commission.
 

6.3 PRESENTATIONS TO GRAND BAY-WESTFIELD VOLUNTEER FIREFIGHTERS
FIRE CHIEF DAN MCCOY AND MAYOR LOSIER PRESENTERS

Provincial Firefighter II Certificate

Fire Chief McCoy, Training Officer Gautreau, and Mayor Losier presented certificates to the following firefighters:

7.2 MINUTES OF FUNDY REGION SOLID WASTE COMMISSION MEETINGS OF JULY 14, 2005, 
SEPTEMBER 8, 2005, AND OCTOBER 13, 2005

 Councillor McGowan moved to receive and file the minutes of Fundy Region Solid Waste Commission Meetings of July 14, 2005, September 8, 2005, and October 13, 2005.

Councillor McGowan moved to pay the Bills for Payment enbloc for a total of $93,878.24 and Bills for Ratification for a total of $38,239.84, grand total of $132,118.08.

By-law No. 2C, Town of Grand Bay-Westfield By-law Respecting the Sanitary Wastewater System was read a third time by title and enacted.

A concern was noted regarding the extra cost for Group Homes established under the by-law amendment.

16.  TOWN MANAGER’S REPORT OF DECEMBER 8, 2005
RE:  2006 GENERAL REVENUE FUND OPERATING BUDGET

Deputy Mayor Murphy moved that the sum of $3,732,595 be the total budget of the Municipality, that the sum of $3,063,226 be the Warrant of the Municipality for the ensuing year, and that the tax rate for the Municipality be $1.3500 and further that the Council orders and directs the levying by the Minister of Environment and Local Government of said amount on real property liable to taxation under the Assessment Act within the Municipality of Grand Bay-Westfield.

17. TOWN MANAGER’S REPORT OF DECEMBER 8, 2005
RE:  2006 SEWERAGE REVENUE FUND OPERATING BUDGET

Councillor Evans moved to adopt the 2006 Sewerage Revenue Fund Operating Budget as per documents attached to the Town Manager’s report of December 8, 2005 reflecting total revenues of $455,414 and total expenditures of $455,414; the sewerage user fee shall be $270.00 per user unit effective January 1, 2006 with a $15.00 discount for residential units only, if full payment is received by the Town Office by 5:00 p.m. on Monday, April 3, 2006; discount applicable where there are no arrears or penalties payable in respect of the annual user charge.

 Councillor Evans moved to receive and file e-mail of November 3, 2005 from the Kidney Foundation of Canada Re:  March Drive Campaign and to notify residents of the Campaign in an upcoming mailout.

KIMBERLEY GAUDET RE:  REQUEST FOR DONATION TO HELP FUND STUDY ABROAD TRIP TO THE UNIVERSITY OF AARHUS IN AARHUS, DENMARK

 Deputy Mayor Murphy moved to receive and file letter received November 28, 2005 from Grand Bay-Westfield resident Kimberley Gaudet Re:  Request for Donation to Help Fund Study Abroad Trip to the University of Aarhus in Aarhus, Denmark and to forward a letter of explanation to Ms. Gaudet.

21. PROPOSED 2005 - 2006 WESTFIELD VOLUNTEER AMBULANCE CONTRACT FOR 
AUTHORIZATION OF SIGNATURES

22. LETTER OF DECEMBER 6, 2005 FROM BDA LANDSCAPE ARCHITECTS
RE:  PLANTING - HENDERSON BROOK, GRAND BAY-WESTFIELD (THE GREATER SAINT JOHN FOUNDATION GRANT)

Deputy Mayor Murphy moved to authorize payments per letter of December 6, 2005 from BDA Landscape Architects  Re:  Henderson Brook Project.

23. LEGISLATION RE:  GREATER SAINT JOHN REGIONAL FACILITIES COMMISSION
Councillor Evans moved to receive and file legislation information regarding the Greater Saint John Regional Facilities Commission.

24. EMERGENCY MEASURES ORGANIZATION  REPORT OF DECEMBER 9, 2005 
RE:  APPOINTMENT OF EMERGENCY MEASURES ORGANIZATION MEMBERS

Councillor McGowan moved to appoint Murray McLean, Patti McCormick, Martha Vowles, David Peterson, and Amber Fillmore to the Town’s Emergency Measures Organization (EMO) effective immediately.

 Seconded by Councillor Evans.  Carried.

A thank you was extended to Fire Chief Dan McCoy, EMO Director,  Vic Aucoin, and EMO members for their efforts with recruitment.
 

25.  DEVELOPMENT OFFICER’S REPORT OF DECEMBER 8, 2005
RE:  2006 EXCAVATION PERMIT – KEEL CONSTRUCTION LTD., BALLENTINE PIT, PID NOS. 00093088, 00227546, 00227595 AND 30042899

 Councillor Evans moved to approve the Rehabilitation Plan as presented by Hobart Realty Ltd. dated May 15, 1998 prepared by Murdock Lingley Ltd. as it relates to the 2006 Excavation Permit for excavation of material from Ballentine Pit, lands identified by PID  Nos. 00093088, 00227546, 00227595, 30042899 and further moved to approve the Bond of Indemnity in the amount of $50,000.00 to be issued by the Guarantee Company of North America to be held as security for the Rehabilitation of the Ballentine Pit located at lands identified by PID Nos. 00093088,  00227546, 00227595, 30042899 for the 2006 Excavation Permit period and to be effective from January 1, 2006 to December 31, 2007 inclusive and further moved to approve conditions for the 2006 Excavation Permit as set out in section 15.9 of the Town’s Zoning By-law with the additional requirement to provide street sweeping on Ballentine Place once per week during the months of June through October and provide to the Town within 5 working days of the end of each of these months written records of the dust control measures undertaken; additional dust control measures may be requested by the Building Inspector as required, subject to special and or unreasonable dust conditions.

26. TOWN MANAGER’S REPORT OF DECEMBER 8, 2005 
RE:  2005 BUDGETED TRANSFER TO THE SEWERAGE CAPITAL RESERVE FUND

Deputy Mayor Murphy moved to transfer $20,000 from the Sewerage Revenue Fund to the Sewerage Capital Reserve Fund and further moved to transfer from Sewerage Capital Reserve to Sewerage Revenue Funds an amount of $71,024 to cover the following costs:

1) residential pumps not covered by Infrastructure Funds for $48,369
2) easements for Infrastructure Project $22,655.

26.a PROPOSED TRANSFER FROM THE SUBDIVISION FUND
Councillor McGowan moved to transfer $350 from the Subdivision Fund to the General Operating Fund regarding the donation towards the Outdoor Rink Project at Inglewood School.

 Seconded by Deputy Mayor Murphy.  Carried.
 

26.b PROPOSED TRANSFER TO THE GENERAL CAPITAL RESERVE FUND
Councillor Evans moved to transfer $96,000 from the General Operating Fund to the General Capital Reserve Fund and further moved to transfer $71,450.65 from the General Capital Reserve Fund to the General Revenue Operating Fund regarding the following:

1) relocation of communication equipment to Rogers Tower ($6,869.46);

2) Centrum Heating Upgrade ($30,225.25) and Exhaust System for Fire Apparatus Areas ($34,355.94).

 Seconded by Councillor McGowan.  Carried.
 

26.c PROPOSED TRANSFER FROM THE CAPITAL RESERVE FUND (WHARF)
Deputy Mayor Murphy moved to transfer $2,837.68 from the Capital Reserve Fund (Wharf) to the General Operating Fund regarding 2005 expenditures for the Trailhead Project recorded in account number 191-100.

 Seconded by Councillor McGowan.  Carried.
