The Town of Grand Bay-Westfield Council met in a regular session on Monday, September 12, 2005 with Mayor Losier presiding.

3.  APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Deputy Mayor Murphy moved to adopt the agenda of September 12, 2005 as presented.

6.1 PRESENTATION BY JACK KEIR, GENERAL MANAGER, FUNDY REGION SOLID WASTE 
COMMISSION (FRSWC) AND RICHARD MCLEAN, TOWN REPRESENTATIVE ON THE (FRSWC) RE:  CAPPING OF #1, #2, AND #3 CELLS/INSTALLATION OF THE GAS COLLECTION PIPING SYSTEM

Jack Keir, General Manager, Fundy Region Solid Waste Commission  and Richard McLean, Town Representative on the FRSWC presented  an overview on the FRSWC capping of #1, #2, and #3 Cells as well as installation of the Gas Collection Piping System.  Jack Keir also provided information on the launching of a new Volunteer Household Hazardous Waste Program to coincide with Earth Day in April 2006.

Councillor McGowan moved to receive and file the report by Jack Keir and Richard Mclean.

 Seconded by Councillor Evans.  Carried.

 It was noted Jack Keir’s employment as General Manager at the FRSWC has been extended for three additional years. 

Mayor Losier thanked Richard McLean and Jack Keir for their excellent work with the FRSWC.
 

6.2 PRESENTATION OF NB MERIT AWARD FOR VOLUNTEER SERVICE TO FLOYD & SHIRLEY SCOTT
MAYOR LOSIER AND MLA MILT SHERWOOD PRESENTERS

 MLA Milt Sherwood and Mayor Grace Losier presented Floyd and Shirley Scott with an NB Merit Award for their many years of Volunteer Service and thanked them for their commitment to community service.
 

6.3 PRESENTATION OF RCMP STATISTICAL REPORT FOR AUGUST 2005 
RCMP REPRESENTATIVE ATTENDING

 Corporal Landry  presented the RCMP Statistical Report for August 2005.
 

Deputy Mayor Murphy moved to receive and file the RCMP Statistical Report for August 2005.

 Seconded by Councillor McGowan.  Carried.
 

6.4 PRESENTATION TO COLONEL JOHN LOGAN RE:  ARCON ’05  - MAYOR LOSIER PRESENTER
Mayor Grace Losier presented Colonel Logan with a  plaque in recognition of ARCON ’05 and thanked him for partnering with Grand Bay-Westfield for their military exercise.

 Colonel John Logan presented the Town with a large framed picture collage of their ARCON ’05 Exercise in Grand Bay-Westfield.
 

6.5 ENVIRONMENTAL TRUST GRANT ANNOUNCEMENTS OF MAY 17, 2005 FROM
MINISTER OF ENVIRONMENT AND LOCAL GOVERNMENT RE:  1) HENDERSON BROOK FISH PASSAGE RESTORATION PROJECT, 2) ENERGY REDUCTION - MUNICIPAL STREET LIGHTS PROJECT, 3) REMOVAL OF DERELICT VEHICLE INCENTIVE PROJECT - MLA MILT SHERWOOD ATTENDING

 MLA Milt Sherwood announced three grants received by the Town from the Environmental Trust Fund: $5,000 for the Henderson Brook Project, $7,300 for the Municipal Street Lights Project, and $2,500 for the Removal of Derelict Vehicle Incentive Program.

 Councillor Day moved to receive and file correspondence of May 17, 2005 Re:  Environmental Trust Grants and moved to authorize execution of relevant documentation.

7. MINUTES OF REGULAR COUNCIL MEETING OF AUGUST 8, 2005
Deputy Mayor Murphy moved to adopt the minutes of the Regular Council Meeting of August 8, 2005 as presented.

7.1 MINUTES OF PLANNING ADVISORY COMMITTEE SPECIAL MEETING OF AUGUST 4, 2005
Councillor Evans moved to receive and file the minutes of the Planning Advisory Committee Special Meeting of 
August 4, 2005.

 Seconded by Councillor McGowan.  Carried.
 

8. BILLS FOR PAYMENT
Councillor Day moved to pay the Bills for Payment enbloc for a total of $52,592.97 and Bills for Ratification for a total of $59,049.11 for a grand total of $111,642.08.

Seconded by Deputy Mayor Murphy.  Carried.

Councillor Evans moved to receive and file City of Saint John Recreation Facilities Committee (2004) Report Summary and further moved to refer the report back to the Recreation Director for feedback to Council on the contents.

 Seconded by Councillor Day.  Carried.
 

16. PROGRESS INVOICE NO. 1 OF AUGUST 4, 2005 FROM GODFREY ASSOCIATES LTD.
RE:  PROJECT NO. 010-133 STREET UPGRADING   2005, ROUTE NO. 177, ALLINGHAM TERRACE TO MULLEN LANE

Deputy Mayor Murphy moved to approve Progress Invoice No. 1 of August 4, 2005 from Godfrey Associates Ltd. Re:  Project No. 010-133 Street Upgrading 2005, Route 177, Allingham Terrace to Mullen Lane and authorize payment of relevant invoices.

17. LETTER OF JULY 29, 2005 FROM DAVID MORGAN, PRINCIPAL OF HARBOUR VIEW  HIGH SCHOOL
RE: REQUEST FOR USE OF TOWN FREE DAY AT HARBOUR STATION

Councillor McGowan moved to approve the use of the Town’s free day at Harbour Station to Harbour View High per letter of July 29, 2005 from David Morgan, Principal of Harbour View High and further moved to forward a letter to the new Principal David Morgan of Harbour View High stating our intent.

18. LETTER OF AUGUST 2, 2005 FROM LAUREN THOMPSON, PRESIDENT OF GUARDIAN ANGELS
RE:  THANK YOU FOR FUNDING THE INNOVATIVE COMPANY AWARD

 Deputy Mayor Murphy moved to receive and file letter of August 2, 2005 from Lauren Thompson, President of Guardian Angels thanking the Town for the funding for the Innovative Company Award.

Deputy Mayor Murphy moved to approve Detailed Claim #19 in the amount of $75,085.15 per letter of September 1, 2005 from Stephanie B. Patterson, P. Eng. with Godfrey Associates Ltd. Re:  Sewer System Extension - Grand Bay-Westfield, NB - Infrastructure Project No. 63 37 05 431 02, Project Nos. 010-091, 010-102, 010-103, 010-104, 010-109 & 010-110 with authorization for payment of relevant invoices.

20. DEVELOPMENT OFFICER’S REPORT OF SEPTEMBER 1, 2005
RE:  RIVER TRAILS NETWORK, BRUNDAGE POINT TRAILHEAD PROJECT

 Councillor Day moved to authorize staff to proceed with legal, survey, and real estate appraisal work and to proceed to acquire submerged Crown Land from the Department of Natural Resources for purposes of the development of the River Trails Network, Brundage Point Trailhead site.

 Seconded by Deputy Mayor Murphy.  Carried.

 Thanks were expressed to the Development Officer for all his work on the proposed Trailhead Project.
 

21. DEVELOPMENT OFFICER’S REPORT OF SEPTEMBER 1, 2005 
RE:  15 BEACH ROAD, CANCELLATION OF NOTICE

 Councillor McGowan moved to authorize required signatures on documentation to cancel a Notice applied to 15 Beach Road, registered in Kings County Registry Office as Document #299406 in 1993, noting that conditions described in the Notice no longer exist.

 Seconded by Deputy Mayor Murphy.  Carried.
 

22. LETTER OF SEPTEMBER 6, 2005 FROM PATRICIA PERRIN RE:  SENIORS HOUSING
Deputy Mayor Murphy moved to receive and file letter of September 6, 2005 from Patricia Perrin Re:  Seniors Housing and further moved that staff meet with Mrs. Perrin to communicate and share information on the Town’s development concept.

23.  DEVELOPMENT OFFICER’S REPORT OF SEPTEMBER 1, 2005
RE:  RIVER TRAILS NETWORK, ROLES & RESPONSIBILITIES

 Deputy Mayor Murphy moved to receive and file Development Officer’s report of September 1, 2005 Re:  River Trails Network, Roles and Responsibilities.

24. LETTERS OF AUGUST 31, 2005 FROM MARK SMITH RE:  TRANSIENT TRADER BY-LAW
Deputy Mayor Murphy moved that staff forward a letter to Mr. Mark Smith advising the current Transient Trader By-law is applicable to his operation noting the requirement of the fee as specified in the By-law. 

 Seconded by Councillor Evans.  Carried.

 It was noted Mark Smith advised Council he was the owner of Wally D’s.
 

25. DEVELOPMENT OFFICER’S REPORT OF SEPTEMBER 8, 2005 
RE:  FINAL SUBDIVISION APPROVAL, REQUEST FOR PARTIAL COMPLETION TO ESTABLISH BONDING REQUIREMENTS, SUBDIVISION DEVELOPER’S AGREEMENT, PANORAMIC ESTATES SUBDIVISION, PHASE 3

 Councillor Evans moved to accept the recommendation from the Town Engineer dated September 6, 2005 to accept the Certificate of Completion dated August 26, 2005, prepared by ADI Limited, as a Partial Completion of the work described as Panoramic Estates Subdivision, Phase 3 forming a partial release of security for the total project, reducing the total required security to a value of $60,490.00 and to approve signing authority on the Subdivision Developer’s Agreement for the Final Subdivision Plan, Panoramic Estates Subdivision, Phase 3 Town of Grand Bay-Westfield, Parish of Westfield, Kings County, New Brunswick, as prepared by Kierstead Quigley & Roberts Ltd. and dated July 12, 2005 and under section 56(1) of the Community Planning Act, assent to the Plan for the vesting of public streets, prior to Final Approval being granted by the Development Officer; subject to final receipt of all required documents and final review of contract documents to the satisfaction of the Town Solicitor.

 Seconded by Deputy Mayor Murphy.  Carried.
