1.  CALL TO ORDER - 7:30 P.M.
The Town of Grand Bay-Westfield Council met in a regular session on Monday, July 12, 2004 at 7:30 p.m. with Mayor Losier presiding.

All members were in attendance with the exception of Councillor McGowan and Councillor Evans.

Councillor Day moved to pay Councillor McGowan and Councillor Evans in their absence.

PRESENTATION OF RCMP STATISTICAL REPORT FOR JUNE 2004
- RCMP REPRESENTATIVE ATTENDING 

Constable Elise Gregoire presented the RCMP Report for June 2004.
Councillor Day moved to receive and file the RCMP Statistical Report for June 2004.

6.2 PRESENTATION OF CERTIFICATE OF MERIT TO THE RIVER VALLEY LIONS CLUB AS 
AWARDED  BY THE CELEBRATE CANADA COMMITTEE OF NEW BRUNSWICK/PRESENTATION OF TOWN PLAQUE TO LIONS CLUB

Mayor Losier presented Larry Burns, President, River Valley Lions Club with a Certificate of Merit as awarded by the Celebrate Canada Committee of New Brunswick as well as a plaque from the Town of Grand Bay-Westfield in recognition of their outstanding efforts towards Canada Day activities in the community.
 

6.3 PRESENTATION OF FIRE SERVICE ACHIEVEMENT AWARDS TO VOLUNTEER FIREFIGHTERS
- PROVINCIAL LEVEL I IFSTA FIREFIGHTING TRAINING

Mayor Losier, Fire Chief McCoy and Deputy Fire Chief Troy Gautreau presented Jeremy Harley, Justin MacDougall, Bruce Rupert, Gilles Roy and Adrian Spencer with certificates of completion for their Provincial Level I IFSTA Firefighter Training.  Jeremy Harley, Bruce Rupert and Gilles Roy were also presented certificates on their achievement of Class II Firefighter Status.
 

6.4 PRESENTATION BY FIRE CHIEF RE:  LEASE ACQUISITION OF 4 X 4 VEHICLE FOR 
VOLUNTEER FIRE DEPARTMENT

Chief McCoy presented information to Council regarding the lease and use of the 2004 Dodge Ram acquired for the Volunteer Fire Department.

Councillor Little moved to finalize documents for the acquisition of the leased 2004 Dodge Ram 1500 4x4 Quad Cab ½ Ton from Dobson Chrysler for the Volunteer Fire Department with authorization for appropriate signatures.

Seconded by Councillor Day.  Carried.
 

6.5 PRESENTATION BY HARRIET HUTCHINSON, RIVER VALLEY LIONS
RE:  RIVER VALLEY LIONS SENIORS COMPLEX PROPOSAL

Harriet Hutchinson of the River Valley Lions Building Committee provided Council with information on the proposed Seniors Complex to be located at the site of the River Valley Lions building, noting a Business Plan is currently being prepared.

Deputy Mayor Murphy moved to receive and file presentation by Harriet Hutchinson of the River Valley Lions Re:  River Valley Lions Seniors Complex Proposal.

Councillor Day moved to pay the Bills for Payment enbloc for a total of $11,041.39 and Bills for Ratification for a total of $28,750.99; grand total of $39,793.38.

It was noted the Provincial Government is enacting non-smoking legislation.
 

17.  LETTER OF JUNE 29, 2004 FROM FEDERATION OF CANADIAN MUNICIPALITIES
RE:  NEW DEAL FOR CANADA’S CITIES AND MUNICIPALITIES

Councillor Day moved to receive and file letter of June 29, 2004 from Federation of Canadian Municipalities Re:  New Deal for Canada’s Cities and Municipalities.

18. RECREATION DIRECTOR’S REPORT OF JULY 7, 2004
RE:  RIVER VALLEY CHAMBER OF COMMERCE (R.V.C.C.) OPERATION OF VISITOR INFORMATION CENTER (V.I.C.) FOR 2004

Deputy Mayor Murphy moved that a grant in the amount of $3,050 be forwarded to the River Valley Chamber of Commerce to assist with the operation of the Visitor Information Center in Grand Bay-Westfield subject to:
 

1...
 
the people working the V.I.C. be asked to pick up litter around and near the Caboose as part of their daily duties while the V.I.C. is operating;
2. 
 
at the beginning and end of the operation of the V.I.C. that items in the Caboose be safely unpacked and then packed for the season;
3.
 
that the students submit an Information Sheet to the Town by August 26, 2004 with relevant operating information completed on a standard information sheet provided by the Town;
4. 
 
that the students complete weekly visitor information statistics on forms supplied by the Town with the number and breakdown of tourist inquires;
5. 
 
that the students are to return their signed out keys for the Visitor Information Center directly after use for the season to the Town office;
6. 
 
 
that the River Valley Chamber of Commerce will forward any financial requests for assistance for the 2005 Tourist season prior to October 1, 2004; the request is to include a breakdown of expenses for the $3,050 received from the Town of Grand Bay-Westfield;
7. 
 
to consult with the Recreation Department before carrying out any repairs or changes on or around the caboose area.

Councillor Day moved to receive and file memorandum of July 6, 2004 from Planning Advisory Committee Re:  List of Planning Advisory Committee Items for First Half of 2004.

20. MEMORANDUM OF JULY 6, 2004 FROM PLANNING ADVISORY COMMITTEE
RE: TENTATIVE SUBDIVISION APPROVAL - VALLEY VIEW ESTATES SUBDIVISION, PHASE 9, STAGE 3/DEVELOPMENT OFFICER’S REPORT OF JULY 7, 2004 

Councillor Day moved to grant approvals as previously granted by Council regarding street design and Land for Public Purposes for Tentative Subdivision Plan, Valley View Estates Subdivision, Phase 9 – Stage 3, as prepared by Hughes Surveys & Consultants Ltd., Plan dated January 7, 2004.

Seconded by Councillor Little.  Carried.
 

21. LETTER OF JUNE 22, 2004 FROM PREMIER BERNARD LORD
RE: YOUTH COMMUNITY ASSISTANCE PROGRAM (YCAP) APPROVAL - PORTABLE PLAYGROUND EQUIPMENT

Councillor Day moved to authorize the purchase of Portable Playground Equipment Re:  Youth Community Assistance Program (YCAP) Approval noting the Town received a grant in the amount of $450.00 towards the purchase of Portable Playground Equipment.

23. LETTER OF JULY 2, 2004 FROM MINISTER BRENDA FOWLIE 
RE:  SUPPORT OF THE ENERGY EFFICIENCY PROJECT FOR COMMUNITY CENTRUM 

Deputy Mayor Murphy moved to refer letter of July 2, 2004 from Minister Brenda Fowlie Re:  Support of the Energy Efficiency Project for Community Centrum to Town staff for a recommendation back to Council.

Seconded by Councillor Day.  Carried.

It was noted the Environment Trust Fund supported the Town for an Energy Efficient Project in the Centrum in the amount of $16, 500.

Councillor Day moved to receive and file facsimile dated July 7, 2004 from Kenneth W. Hannah, P. Eng., Godfrey Associates Ltd. Re:  Sanitary Sewer Extensions – Contract No. 2, Grand Bay-Westfield, NB, Project No. 010-110.

It was noted Infrastructure Contract No. 2 is tentatively set to begin in August 2004.

27. DRAFT CANADA/NEW BRUNSWICK INFRASTRUCTURE PROGRAM APPLICATION
RE:  WOOLASTOOK DRIVE UPGRADING

Councillor Day moved to approve application for Canada/New Brunswick Infrastructure Program Re:  Woolastook Drive Upgrading as prepared by Godfrey Associates Ltd.

28.  WORKS COMMISSIONER’S REPORT OF JULY 6, 2004
RE:  SIDEWALK PLOWING AND SNOWBLOWING MAINTENANCE TENDER NO. 04-002W

Councillor Day moved that all tenders received for Sidewalk Plowing and Snowblowing Maintenance Tender No. 01-002W be rejected and the bid securities be returned to the bidders and staff be directed to proceed to tender on the purchase of a new Trackless unit.

29. TOWN MANAGER’S REPORT OF JULY 7, 2004
RE:  APPOINTMENT OF NB MERIT AWARDS VOLUNTEER PANEL

Deputy Mayor Murphy moved to appoint an NB Merit Awards Volunteer Panel comprised of Lynn Koumbias, Peter Fenwick, and Glen Cosman to review the applications for NB Merit Awards and make recommendations to Council with authorization for the Volunteer Panel to add up to three additional members to the Panel in response to the recent Town public notice.

30. DEVELOPMENT OFFICER’S REPORT OF JUNE 28, 2004 
RE:  3 ALLINGHAM TERRACE - REQUEST TO BUILD ON MUNICIPAL RIGHT-OF-WAY

Deputy Mayor Murphy moved that the application for an agreement to construct a retaining wall on the municipal right-of-way at 3 Allingham Terrace be denied with the matter referred to staff to arrange a meeting with the property owner to discuss alternative options.

Seconded by Councillor Day.  Carried.
 

31. DEVELOPMENT OFFICER’S REPORT OF JULY 7, 2004
RE:  63 CENTRAL AVENUE PROPERTY, DANGEROUS OR UNSIGHTLY PREMISES BY-LAW VIOLATION

Councillor Day moved to approve the serving of Notice on Mr. P.A. William Hall, owner of 63 Central Avenue, PID Nos. 30066658 and 00220368 for removal of all miscellaneous materials found in the yard and the demolition of the main structure located on this property, to be completed within 30 days of date of the Notice under provisions of the Town of Grand Bay-Westfield By-law No. 105, Dangerous or Unsightly Premises By-law, and also to appoint David Taylor as Officer to sign the Notice.

32. DEVELOPMENT OFFICER’S REPORT OF JULY 7, 2004
RE:  RTN, WATERFRONT DEVELOPMENT PLAN, BRUNDAGE POINT TRAILHEAD

Councillor Day moved to approve the preparation of a Draft Fish Habitat Compensation Plan by Natech Environmental Services for the approval by the Department of Oceans and Fisheries of the Brundage Point Trailhead site for the amount of approximately $5,000.00 and further moved to approve the preparation of an Archeological Field Study and report for the approval of the Department of Oceans and Fisheries of the Brundage Point Trailhead site for the amount of $1,000.00.

Seconded by Deputy Mayor Murphy.  Carried.
