WESTFIELD WHARF – CHARLES GAUDET, FISHERIES AND OCEANS (NO WRITTEN
DATA)
Charles Gaudet, Fisheries & Oceans advised Fisheries and Oceans is prepared to provide $37,000 to the Town with respect to the transfer of the Westfield Wharf. It was noted an Agreement of Transfer would need to be executed by the Town and Fisheries and Oceans. Councillor Keir moved to have the Town Manager forward a letter to Fisheries & Oceans advising of the Town’s intent to take ownership of the Westfield Wharf for an amount of $37,000 to be paid by Fisheries and Oceans. Seconded by Deputy Mayor Black. Carried.

DRAFT CENTRUM SIGN POLICY FOR ADOPTION BY COUNCIL
Councillor Keir moved to adopt the following Draft Centrum Sign Policy: Purpose To provide guidance to the Recreation Director and the Municipality when considering requests for use of the Community Centrum Sign by Community Groups, Town Departments, and Town Committees in Grand Bay-Westfield. Rationale The permanent sign across from the Centrum was erected to eliminate the need for temporary low level signs on all Town right-of-ways. The Town recognizes that advertising is needed for Community Special Events and Town Public Notices to assist in making residents aware of activities. However, it is also recognized that the use of the Centrum sign alone may not be conclusive notice for advertising events and that many other forms of promotion are required to get the word out. It is not the intent of this policy to have the sign used for regular ongoing weekly, bi-monthly or monthly event announcements, however, such notices may be permitted on occasion. It is the intent of this policy to only permit sign use for events held in Grand Bay-Westfield unless a notice is deemed to be in the best interest of the Municipality. General Principles: 1. requests will be considered on a first come first serve basis; as a general rule, information respecting commercial activities will not be displayed; 2. municipal requirements shall have priority over any other requests; 3. special events being held at the Community Centrum shall have priority over events located in other facilities; 4. requests should be submitted a week in advance of date of event; 5. display of information does not constitute endorsement of the content by the Town; 6. display will attempt to identify the name of the event, day, date, time, location and, if space allows, a contact name and number, however, the Town reserves the right to edit as needed; 7. display time for information will be considered for a maximum of two weeks; 8. display will be considered on one side or both sides of sign depending on other requests and available lettering; 9. information requested for display must not present demeaning or derogatory portrayals of individuals or groups, or exploit violence, sexuality, children, the customs, and conviction of characteristics of religious or ethnic-cultural groups, persons with disabilities or any other person, group or institution in a manner which is offensive; 10. advertising is governed by the Human Rights Act which provides that no person shall be discriminated against “because of the race, colour, ancestry, place of origin, religion, marital status, family status, physical or mental disability, sex, sexual orientation or age of the person or that group or class of persons”; 11. information promoting an individual political party or politician will not be permitted; 12. information of a commercial nature or for the buying or selling of a product and not directly related to renting the Centrum for this purpose will not be permitted; an exception to this would be the example of a trade show renting the Centrum. Disclaimer The use of the Community Centrum sign is provided “as is” without warranty of any kind, either express or implied on the part of the Town of Grand Bay-Westfield. The sign could include technical inaccuracies or abbreviated spelling and any reliance on the information is at the complete risk of the user. The information which is contained on the sign is not in its original form. Seconded by Councillor Sutton. Carried.

DRAFT ACCESS TO INFORMATION – FIRE PROTECTION SERVICES POLICY FOR
ADOPTION BY COUNCIL
Deputy Mayor Black moved to adopt the Draft Access to Information – Fire Protection Services Policy as follows: Access to Information
2.01 Process Requests for information should be forwarded to the Fire Chief or his designate. The Fire Chief or his designate will record the request for information and respond verbally or in writing as appropriate. Communications with potential legal ramifications with law enforcement agencies or other parties (e.g. insurance companies, lawyers, private investigators, and the Fire Marshall) may be verbal, but must always be supported in writing. Requests for information regarding non-public information will be refused, and at no time shall copies of Incident Reports be made available to the public or others due to legal ramifications. The person/agency requesting the information will be advised that the information is only available under subpoena/court order. This section does not apply to certain legislative requirements of the Municipalities Act and the Fire Prevention Act in regard to mandatory reporting. Proactive releases of information to the media are acceptable under this policy. This option could be used in regard to a major incident or a positive incident which could assist in maintaining a positive public image. 2.02 Reporting Requests for information and their response will be communicated to the Town Manager before action is taken, if feasible. Requests regarding non-public information will be communicated to the Town Manager in writing as soon as possible after they occur. The Town Manager will be notified within 24 hours of any requests for information which may have legal considerations. 2.03 Subject The subject of this policy is the release of information regarding Volunteer Fire Department responses. 2.04 Rationale The public should have access to information about the Fire Department’s responses which could be or is public at the time of the incident. However, information which is not generally accessible to the public should not be released except under a legal order. 2.05 Policy Statement The Volunteer Fire Department may release information about Fire Department responses to members of the public or media. This information shall be limited to: a) the date and location of the request for a response;
As a general rule, information which could have been seen or recorded by a member of the public present during any phase of the response can be released without approval by the Town Manager. 2.06 Responsibility The Fire Chief is responsible for all information released by the Department unless superseded by a decision of the Town Manager or Council. In these circumstances, the Fire Chief shall not be responsible for the information released, and shall not be responsible to communicate the information. The Fire Chief will notify the Town Manager immediately if a request for information is likely to lead to controversy or public scrutiny of the Fire Department. A joint decision will be made as to the communications strategy in these cases. 2.07 Miscellaneous The Fire Chief is expected to use discretion and judgment when releasing information of a sensitive nature. If, in the Fire Chief’s opinion, it is in the public’s interest that information not be released, he should refrain from doing so and discuss the matter with the Town Manager. WORKS COMMISSIONER’S REPORT OF FEBRUARY 8, 2001 RE: MUNICIPAL
KILOMETRAGE MAINTENANCE RESPONSIBILITY AGREEMENT 2001
Councillor Keir moved to concur with the recommendation of the Works Commissioner in his report of February 8, 2001 in that staff meet with representatives of the Department of Transportation to begin discussing turning over to the Province the maintenance responsibility for River Valley Drive and Nerepis Road at the end of the amalgamation deal; and further moved that the 2001 Municipal Kilometrage Maintenance Responsibility Agreement be executed. Seconded by Deputy Mayor Black. Carried.

LETTER DATED DECEMBER 6, 2001 FROM HON. MILT SHERWOOD, MINISTER
OF PUBLIC SAFETY RE: INCREASED MUNICIPAL RATES FOR RCMP CONTRACTS
FOR 2001
Larry Bennett, Director of Policing Services, as well as Chief Superintendent Randy Robar, Staff Sgt. Brown, Cpl. Oliver and John Jurcina of the RCMP were present. A general discussion occurred and it was noted the cost per officer has gone up by $5,000 per officer to an incorporated municipality with the local service districts experiencing no such increase. Superintendent Robar noted that it would be the taxpayers of New Brunswick that would be paying for the increase per officer. Mayor Losier noted Council’s concerns and stated that an equitable sharing of this increase across the province for both municipalities and local service districts is desirable. Larry Bennett noted he would take Council’s concerns back to the government to address bringing equity into overall policing costs. Councillor Keir moved to receive and file letter dated December 6, 2001 from Hon. Milt Sherwood, Minister of Public Safety Re: Increased Municipal Rates for RCMP Contracts for 2001. Seconded by Councillor Calvin. Carried. Councillor Keir moved to forward a letter to the Minister’s Round Table on Local Government with respect to the issue of the RCMP Contracts for 2001 explaining the Town’s position on the inequity of rates for RCMP contracts. Seconded by Councillor Calvin. Carried.

Lingley Property, dated February 22, 1971 and prepared by Murdock-Lingley Ltd. New Brunswick Land Surveyors under Section 3 (1) of the Town’s Zoning by-law, Town of Grand Bay-Westfield By-law No. 16, Division 2 for the development of a single family dwelling on a parcel of land identified by NBGIC No. 00210443, subject to: a) any future subdivison accessed by this right-of-way to require a public street to be vested in the Municipality and upgraded to minimum standards established under the Subdivision By-law. Seconded by Deputy Mayor Black. Carried.
