The Town of Grand Bay-Westfield met in a regular session on Tuesday, April 13, 2004 at 7:30 p.m. with Mayor Losier presiding.

3.  APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Councillor Day moved to add item 21.a to the agenda:  Town Manager’s Report of March 29, 2004 Re:  Confirmation of Assistant Clerk/Treasurer position.

Seconded by Deputy Mayor McGowan.  Carried unanimously.
 

4.  DISCLOSURE OF CONFLICT OF INTEREST
Councillor Murphy declared a conflict of interest with item no. 20 – Memorandum of April 6, 2004 from Planning Advisory Committee Re:  Application for Tentative Subdivision Approval for Susan Morris Subdivision, Phase 2, Lot 2004-1 – Highland Road.

RE:  DRAFT BY-LAW NO. 103, TOWN OF GRAND BAY-WESTFIELD BY-LAW TO CLOSE CERTAIN PUBLIC STREETS OR RIGHT-OF -WAYS

Mayor Losier called three times for objections Re:  Draft By-law No. 103, Town of Grand Bay-Westfield By-law to Close Certain Public Streets or Right-of Ways.  No objections were made to proposed By-law No. 103.  Mayor Losier called three times for comments in support of proposed By-law No. 103, Town of Grand Bay-Westfield By-law to Close Certain Public Streets or Right-of Ways.  No comments were made in support of proposed By-law No. 103.

PUBLIC PRESENTATIONS
 
6.1  PRESENTATION RE:  2004 HALF MARATHON - JACK KEIR ATTENDING
Councillor Day moved to approve the proposed “Grand Bay-Westfield Half Marathon Event” to be held by the Half Marathon Committee on Canada Day, Thursday, July 1, 2004 subject to permission of the Team Leader of the RCMP and the District Engineer of the New Brunswick Department of Transportation for the traffic control; co-ordination with Canada Day Planning Committee for timing of the event, final route plan including registration, water/refreshment stations, finish line, awards and reception details; Recreation Department and the Works Department will be made available for the planning and preparation of this event, and a link to the Town’s web site will be available.

6.2 PRESENTATION OF RCMP STATISTICAL REPORT FOR MARCH 2004
– SERGEANT GREG GRANT ATTENDING

Councillor Day moved to receive and file the RCMP Statistical Report for March 2004 as presented by Sergeant Greg Grant.

Seconded by Councillor Murphy.  Carried.

It was noted that efforts would be made to have pedestrian crosswalks and turning lane markings painted as soon as possible.

It was also noted that a voice mail message would be left for Council members concerning the May 5th 7:30 p.m. Neighborhood Watch Meeting.

Councillor Murphy moved to receive and file the minutes of the Planning Advisory Committee Meeting of March 15, 2004.

Councillor Day moved to pay the Bills for Payment enbloc for a total of $74,837.88 and Bills for Ratification for a total of $33,247.65; grand total of $108,085.53.

Councillor Murphy moved to receive and file the Fundy Region Solid Waste Commission Auditor’s Report and Financial Statements for the year ended December 31, 2003.

Councillor Day moved to receive and file the Greater Saint John Community Economic Development Agency Incorporated Financial Statements for the year ended December 31, 2003.

Councillor Silliphant moved to receive and file the Town of Grand Bay-Westfield Sewerage Utility Accounts Receivable Report as at April 7, 2004.

16. MEMORANDUM OF MARCH 24, 2004 FROM DEVELOPMENT OFFICER
RE:  REVISIONS TO SCIF GRANT, ACOA APPLICATION - BRUNDAGE POINT RTN WATERFRONT DEVELOPMENT

Councillor Day moved to forward the revised programming and organizational diagram relative to the Summary of Costs for the Town’s application to ACOA for SCIF funding of the Brundage Point Trailhead as a component of the River Trails Network.

17. LETTER OF MARCH 22, 2004 FROM FEDERATION OF CANADIAN MUNICIPALITIES MEMBERS’
ADVISORY RE:  GST REFUND FOR MUNICIPAL GOVERNMENTS

Councillor Murphy moved to receive and file the letter of March 22, 2004 from Federation of Canadian Municipalities Members’ Advisory Re:  GST Refund for Municipal Governments.

18. TOWN MANAGER’S REPORT OF APRIL 6, 2004
RE:  APPOINTMENT TO EMERGENCY MEASURES ORGANIZATION

Councillor Day moved to appoint Murray Whipple to the Town Emergency Measures Organization effective immediately.

19.  WORKS COMMISSIONER’S REPORT OF APRIL 7, 2004
RE:  DRAFT TENDER FOR PLOWING AND OTHER WINTER MAINTENANCE

Councillor Murphy moved to proceed to public tender for the Plowing and Other Winter Maintenance Services, Bid Number 04-001W per document entitled Scope of Work 2004-2009 as attached to the Works Commissioner’s report of April 7, 2004.

Seconded by Councillor Silliphant.  Carried.
 

20.  MEMORANDUM OF APRIL 6, 2004 FROM PLANNING ADVISORY COMMITTEE
RE:  APPLICATION FOR TENTATIVE SUBDIVISION APPROVAL SUSAN MORRIS SUBDIVISION, PHASE 2, LOT 2004-1-HIGHLAND ROAD

Councillor Silliphant moved  Council  accept $79.39 (cash, money order or certified cheque) as money in lieu of Land for Public Purposes, for the approval of 1 new residential building lot to be created on Highland Road as shown on Tentative Subdivision Plan, Susan Morris Subdivision, Lot 2004-1, as prepared by DeSaulniers Surveys Inc., dated March 30, 2004, subject to:

a. Final Subdivision Plan recording any Utility easements required by NB Power;
b. Final Subdivision Plan is provided a Key Plan;
c. Final plan to remove the reference to the utility lot;
d. Final Subdivision Plan indicates Shaw Road as “Future Street” and provide a note on the Plan to indicate
     all lots accessed by the Future Street are not approved building lots until such time as the lot is accessed
     by a “Public Street”;
e. award of Municipal Services Contract for the construction of Sewer Services to the proposed new lots.

21. MEMORANDUM OF APRIL 6, 2004 FROM PLANNING ADVISORY COMMITTEE
RE:  APPLICATION FOR TENTATIVE SUBDIVISION APPROVAL KELLY DEVELOPMENT SUBDIVISION, LOTS 2004-1 TO 2004-12 – HIGHLAND ROAD

Deputy Mayor McGowan moved that Council accept $264.77 (cash, money order or certified cheque) as money in lieu of Land for Public Purposes, for the approval of 12 new lots to be created on Highland Road as shown on Tentative Subdivision Plan, Kelly Development Subdivision, Lots 2004-1 to 2004-12, as prepared by DeSaulniers Surveys Inc., dated March 22, 2004, subject to:

a. Final Subdivision Plan recording any Utility easements required by NB Power;
b. Final Subdivision Plan is provided a Key Plan;
c. Final Subdivision Plan indicates Shaw Road as “Future Street” and provide a note on the Plan to indicate
    all lots accessed by the Future Street are not approved building lots until such time as the lot is accessed
    by a “Public Street”;
d. award of Municipal Services Contract for the construction of Sewer Services to the proposed new lots
    and;
e. acknowledgement from the Department of Health and Department of Environment & Local Government
    of adequate water quality and quantity, meeting the Canadian Drinking Water Quality Guidelines for the
    development of these lots, prior to Tentative Approval being granted by the Development Officer.

21.a TOWN MANAGER’S REPORT OF MARCH 29, 2004
RE:  CONFIRMATION OF ASSISTANT CLERK/TREASURER POSITION

 Deputy Mayor McGowan moved to confirm Marcia Mason as Assistant 
Clerk/Treasurer for the Town of Grand Bay-Westfield effective March 15, 2004 with her service backdated to September 15, 2003 with approval for a $200 wage adjustment effective March 15, 2004.

 Seconded by Councillor Day.  Carried.
