1. CALL TO ORDER - 7:30 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, August 13, 2007 with Mayor Loser presiding.

2. RECORD OF ATTENDANCE
Deputy Mayor Murphy, Councillor Little, Councillor McGowan, Councillor Day, and Councillor Evans were in attendance.
 
3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Deputy Mayor Murphy moved to approve the agenda of August 13, 2007 as presented.

Seconded by Councillor Day.  Carried.

6.1 PRESENTATION OF RCMP STATISTICAL REPORT FOR JULY 2007 
RCMP REPRESENTATIVE ATTENDING
Corporal Landry provided information to Council regarding the RCMP Statistical Report for July 2007.

Councillor McGowan moved to receive and file RCMP Statistical Report for July 2007 as presented.

 Seconded by Councillor Evans.  Carried.
 
6.2 NB MERIT AWARDS PRESENTATIONS 
HON. JACK KEIR, MLA AND MAYOR GRACE LOSIER PRESENTERS

 Lynn Koumbias presented Council with an overview of the nominees for the 2007 NB Merit Awards which included:

Environment Award Rose Theriault - nominated by Sacha Koumbias
Leadership Award Ernie Ring - nominated by Sacha Koumbias & Joanne Martin
Volunteer Award Beautification Committee - nominated by Erin Graham

 MLA, Jack Keir and Mayor Grace Losier presented Rose Theriault, River Valley Middle School Teacher the Environment Award and Ernie Ring, Teacher, Brown’s Flat School the Community Leadership Award. 

Deputy Mayor Murphy presented the Beautification Committee the Volunteer Service Award, Mayor Grace Losier, Chair Beautification Committee accepted the Award on behalf of the Committee.

Councillor Evans moved to recess for fifteen minutes.

 Seconded by Councillor McGowan.  Carried unanimously.

7.1 MINUTES OF REGULAR COUNCIL MEETING OF JULY 9, 2007
Deputy Mayor Murphy moved to adopt the minutes of the Regular Council Meeting of July 9, 2007 as presented.

 Seconded by Councillor Day.  Carried.
 
7.2 TELEPHONE POLL OF JULY 23, 2007 RE:  APPOINTMENT OF NB MERIT AWARDS COMMITTEE
Deputy Mayor Murphy moved to ratify the Telephone Poll of July 23, 2007 appointing Lynn Koumbias, Peter Fenwick, and Glen Cosman as members of the 2007 NB Merit Awards Committee.

 Seconded by Councillor McGowan.  Carried.
 
7.3 TENDER NOTES OF AUGUST 7, 2007 RE:  STORM SEWER ROUTE NO. 177, PROJECT NO. 010-128
Councillor Day moved to receive and file the Tender Notes of August 7, 2007 Re:  Storm Sewer Route No. 177, Project No. 010-128.

 Seconded by Councillor Little.  Carried.
 
8. BILLS FOR PAYMENT
Councillor Day moved to pay Bills for Payment enbloc for a total of $39,497.44 and Bills for Ratification for a total of $72,187.99; grand total of $111,685.43.

Seconded by Deputy Mayor Murphy. Carried.

RE:  COMMISSION MINUTES FOR MARCH 15, APRIL 12, AND MAY 10, 2007

 Councillor Evans moved to receive and file memorandum of July 10, 2007 from Fundy Region Solid Waste Commission Re:  Commission Minutes for March 15, April 12, and May 10, 2007.

OF TRANSPORTATION RE: PROGRAMS FOR IMPROVEMENTS - DESIGNATED HIGHWAYS

 Deputy Mayor Murphy moved to forward the letter of July 10, 2007 from David Cogswell, P. Eng., Director, Department of Transportation Re: Programs for Improvements - Designated Highways to the Works Commissioner for a report to Council.

18. DRAFT AGREEMENT RIVER VALLEY COMMUNITY CENTER FOUNDATION INC./ TOWN OF
GRAND BAY-WESTFIELD RE:  COMMUTER EXPRESS BUS SERVICE - PROPERTY AT 749 RIVER VALLEY DRIVE PID NO. 30165179

 Deputy Mayor Murphy moved to authorize execution of the Draft Agreement dated August 13, 2007 between the River Valley Community Center and the Town of Grand Bay-Westfield Re:  Commuter Bus Service - property at 749 River Valley Drive, PID# 30165179 with approval for minor revisions that may be deemed necessary by the Town Solicitor.

 Seconded by Councillor McGowan.  Carried.

RE:  BRUNDAGE POINT RIVER CENTRE CHANGE ORDERS

 Deputy Mayor Murphy moved to receive and file Memorandum of August 2, 2007 from Development Officer Re:  Brundage Point River Centre Change Orders.

 Councillor Day moved to approve payment of Certificate No. 1 in the amount of $137,475.83 to Debly Enterprises Ltd. per letter of August 8, 2007 from Ken Hannah P. Eng., Godfrey Associates Ltd. Re:  Street Improvements 2007 Various Locations, Project No. 010-126.

21. LETTER OF AUGUST 9, 2007 FROM KEN HANNAH, P. ENG., GODFREY ASSOCIATES LTD. 
RE:  STORM SEWER IMPROVEMENTS 2006, PROJECT NO. 010-120 - FINAL COMPLETION

 Councillor Day moved to approve payment of Final Completion in the amount of $13,963.58 to Keel Construction Ltd. per letter of August 9, 2007 from Ken Hannah, P. Eng., Godfrey Associates Ltd. Re:  Storm Sewer Improvements 2006, Project No. 010-120.

 Seconded by Councillor Little.  Carried.
 
22. LETTER OF AUGUST 9, 2007 FROM KEN HANNAH P. ENG., GODFREY ASSOCIATES LTD.
RE:  STORM SEWER IMPROVEMENTS AND BLIND KNOLL ELIMINATION, PROJECT NO. 010-127 - CERTIFICATE NO. 1

 Councillor Day moved to approve payment of Certificate No. 1 in the amount of $121,485.29 to Keel Construction Ltd. per letter of August 9, 2007 from Ken Hannah P. Eng., Godfrey Associates Ltd.  Re:  Storm Sewer Improvements and Blind Knoll Elimination, Project No. 010-127.

 Seconded by Deputy Mayor Murphy.  Carried.
 
23. LETTER OF JULY 9, 2007 FROM STEPHANIE PATTERSON, P. ENG., GODFREY ASSOCIATES LTD.
RE:  WATERFRONT DEVELOPMENT BRUNDAGE POINT TRAILHEAD, PROJECT NOS. 010-116 & 010-125 - CLAIM NO. 13

Councillor Day moved to approve Claim No. 13  Project Nos. 010-116 & 010-125, Waterfront Development Brundage Point Trail Head, Grand Bay-Westfield, NB per letter of June 20, 2007 from Stephanie Patterson, P. Eng., Godfrey Associates Ltd. with authorization for payment of relevant invoices.

 Seconded by Councillor Evans.  Carried.
 
24. DRAFT AGREEMENT EMS GRAND BAY-WESTFIELD INC./ TOWN OF GRAND BAY-WESTFIELD
RE:  LEASE OF AMBULANCE AREA AT 293 NEREPIS ROAD

 Councillor Day moved to authorize execution of the Draft Agreement dated August 13, 2007 between EMS Grand Bay-Westfield Inc. and the Town of Grand Bay-Westfield Re:  Lease of Ambulance Area at 293 Nerepis Road with approval for minor revisions that may be deemed necessary by the Town Solicitor.

 Seconded by Councillor McGowan.  Carried.
 
25. LETTER OF AUGUST 7, 2007 FROM STEPHANIE PATTERSON, P. ENG., GODFREY ASSOCIATES LTD.
RE:  TENDER RESULTS - STORM SEWER, ROUTE NO 177 - PROJECT NO. 010-128

 Councillor Day moved to award contract Re:  Storm Sewer, Route No. 177 - Project No. 010-128 to the low tenderer, Galbraith Construction Ltd. for the Tender Price of $228,113.20 subject to approval from the Department of Transportation, per letter of August 7, 2007 from Stephanie Patterson, P. Eng., Godfrey Associates Ltd.

 Seconded by Councillor McGowan.  Carried.
