Cpl. Grant advised he would provide information regarding the animal statistics for the
next Council Session.

16. FIRE CHIEF’S REPORT OF JANUARY 9, 2003 RE:  FIRE DEPARTMENT HIRING
Deputy Mayor McGowan moved to accept the recommendation of the Interview Team and engage Troy Gautreau as Training Officer for the Grand Bay-Westfield Volunteer Fire Department with the commencement date of employment to be February 3, 2003 and to engage Grant Graham as Equipment Officer for the Grand Bay-Westfield Volunteer Fire Department with the commencement date of employment to be February 4, 2003, both subject to acceptance of the Offer of Employment and Terms of Employment with both positions to be paid an annual salary of $26,520.00 and have an introductory period expiring on December 31, 2003.

the Federation of Canadian Municipalities (FCM) Re:  FCM’s Municipal Rights-of-Way
Defence Fund.

Councillor Day moved to receive and file letter of January 1, 2003 from Patricia Perrin Re:  Resignation from Tourism Committee and to send a letter to Mrs. Perrin to thank her for her time on the Committee advising she will be greatly missed.

20. TOWN OF GRAND BAY-WESTFIELD 2003 MUNICIPAL INSURANCE
PER FRANK COWAN COMPANY LTD.

Councillor Day moved to table the Town of Grand Bay-Westfield 2003 Municipal Insurance policy per Frank Cowan Company Ltd. until the next regular Council meeting of January 27, 2003 for additional information.

21. TOWN MANAGER’S REPORT OF JANUARY 2, 2003
RE:  PROCEDURES  CASH FLOW MANAGEMENT

Councillor Silliphant moved that the Town Manager be authorized to establish a 2003 Line of Credit for the Town with respect to the Sewerage Utility Operating Fund as per section 189(13) of the Municipalities Act not to exceed $187,188.00 and further a 2003 Line of Credit with respect to the General Operating Fund as per section 89(1)(2) of the Municipalities Act for an amount not to exceed $116,038, at the most competitive rate.

22. LETTER OF NOV. 19, 2002 FROM OFFICE OF THE MAYOR, CITY OF BATHURST
RE:  2003 BATHURST-CAMPBELLTON CANADA WINTER GAMES

Deputy Mayor McGowan moved to refer letter of November 19, 2002 from the Office of the Mayor, City of Bathurst Re:  2003 Bathurst-Campbellton Canada Winter Games to the Town Manager to determine the most advisable method to get information out to our residents about the Bathurst-Campbellton Canada Winter Games Lottery.

RE:  TOWN OF GRAND BAY-WESTFIELD INTEGRATED PEST MANAGEMENT AWARD FROM NEW BRUNSWICK HORTICULTURAL TRADES ASSOCIATION

Councillor Day moved to receive and file newspaper article of January 10, 2003 Re:  Town of Grand Bay-Westfield Integrated Pest Management Award from the New Brunswick Horticultural Trades Association.

FIRE CHIEF’S REPORT OF JANUARY 7, 2003 
RE:  DISPATCH SERVICES CONTRACT
 
Councillor Day moved to accept the base fee of $11,000 for the period of April 1, 2003 to March 31, 2004 in conjunction with the “Agreement Respecting Communication Services” between the Town of Grand Bay-Westfield and the City of Saint John as per correspondence from William Todd, Director of the Saint John Public Safety Communications Centre.

25.  MEMORANDUM OF NOVEMBER 19, 2002 FROM PLANNING ADVISORY COMMITTEE
RE:  TENTATIVE SUBDIVISION PLAN – PANORAMIC ESTATES PHASES 2 & 3

Deputy Mayor McGowan moved that Council accept $267.30 as Money in Lieu of Land for Public Purposes for Panoramic Estates Subdivision, Phase 2 and Panoramic Estates Subdivision Phase 3, based on Tentative Subdivision Plans dated September 19 and 20, 2002 as prepared by Kierstead Quigley and Roberts Ltd. under payment received by the Town under Panoramic Estates Subdivision Phase 1 subject to:

.. the Final Subdivision Plan showing remnant lot PID No. 00467001 as part of the Public Street;

and further that Council accept the preliminary design calculations for the construction of Phase 2 and Phase 3 of Panoramic Estates Subdivision as presented on drawing titled:  Plan and Profile June Avenue, Subdivision Services, Panoramic Estates dated December 18, 2002 and Panoramic Estates Cross Sections Station 0+104, Station 0+168, Station 0+234 subject to:

Street design to be completed by Professional Engineer, and reviewed to the satisfaction of the Town Engineer prior to completion of Developer’s Subdivision Agreement and approval of Final Subdivision Plan, meeting development standards for concrete curb and gutter street design, storm sewer and sanitary sewer design to be assumed by the Town;
 
b) 
 
 
 
the maximum slope on any roadway embankment (right-of-way) beyond the 2.5 m level space behind the curb, shall be 2H:1V for stability, except when rock is encountered;
 
c)
 
 
 
subject to (b), positive sloped embankments shall be provided with a maximum positive slope from the 2.5 m level area behind curb to extend onto the proposed building lots;
 
d) 
 
 
 
 
 
providing for top of concrete foundation walls to be a minimum of 750 mm above finished centre line road grade at a minimum 7.5 m set back from street line for future residential construction or be subject to Variance approval before building permit is issued for the development of the lot, geotechnical site grading design plan and engineered foundation design will be required on Lots C1-C8 in Phase 2;
 
e) 
 
 
driveway accesses must maintain a 2.5 metre area behind the curb to allow for future sidewalks (without having to re-shape driveways);
 
f) 
 
 
 
during any construction of roadways, sanitary and storm sewers, check-dams and other appropriate measures must be used to prevent and control erosion and debris from entering active infrastructure;
 
g) 
 
 
 
 
a note shall be provided on the Final Subdivision Plan indicating Lots C1-C8 have been filled and that the suitability of these lots for building construction is the responsibility of the property owner and requires a site grading and drainage plan prepared by a Geotechnical Engineer prior to issuance of a building permit;
 
h)
 
 
 
all slopes in excess of 15% on Lots C1-C8 are to be hydro-seeded and mulched, complete with a berm at the toe of the slope as soon as the initial lot grading is completed;
 
i)
 
 
 
 
 
 
 
subject to section 49 (2)(g) of the Community Planning Act, a Water Supply Assessment shall be completed by a qualified hydrologist or qualified professional engineer subject to guidelines provided by the Department of Environment & Local Government (as generated by the Rural Planning District Commission), to determine the availability and nature of the domestic water supply, prior to completion of Developer’s Subdivision Agreement and approval of Final Subdivision Plan;
 
j)
 
 
no blasting is to occur in the construction of the subdivision without a comprehensive pre-blast survey being conducted with prior approval of Council;
 
k) 
 
 
utility easements for Phase 2 and Phase 3 shall be reviewed by NB Power and NB Tel and recorded on the Final Subdivision Plan;
 
l) 
 
 
 
 
pursuant to Water Quality Regulation # 82-126, under the Clean Environment Act, the Department of the Environment and Local Government shall approve plans and profiles for installation of storm sewers, catch basins and manholes prior to Final Subdivision Approval subject to:
 
the completion of an overall Geotechnical Assessment, respecting the grading, fill placement, maximum slopes and requirements for slope stability and erosion control on lots C1-C8, to ensure the protection of the adjacent properties on Woolastook Drive, PRIOR to Tentative Subdivision Approval being granted by the Development Officer.

26.  WORKS COMMISSIONER’S REPORT OF JANUARY 7, 2003
RE:  BACKHOE ATTACHMENT PURCHASE

Councillor Day moved to approve the purchase of a fork attachment for the 2002 JCB214 backhoe for $3,595.00, plus HST and delivery.

Seconded by Councillor Silliphant.  Carried
