RE:  ZONING AND BUILDING BY-LAWS - VIOLATIONS

Carisa Cosman addressed Council on behalf of Robin Cosman reading and submitting a letter concerning a storage shed for the Cosman property at 20 Beverley Hills Drive.

Councillor McGowan moved that Council give 14 days notice to the property owner of 20 Beverley Hills Drive, PID No. 30085013 to comply with Zoning By-law No. 101 and to remove the illegally placed structure (accessory building).

Councillor Day moved to pay the Bills for Payment enbloc for a total of $48,020.77 and Bills for Ratification for a total of $35,752.88; grand total of $83,773.65.

16. LETTER OF JUNE 4, 2004 FROM RIVER VALLEY ACTION COMMITTEE ON DISABLED  PERSONS
RE:  DISABLED ACCESS/RECREATION DIRECTOR’S REPORT OF JUNE 8, 2004

Deputy Mayor Murphy moved to respond to the River Valley Action Committee through the Recreation Director advising that the Recreation Director will meet with Mr. Brooker to work on identifying sources of funding for the electrical door system, e.g. Fundy Future Environment and Benefits Council, etc. with the Committee’s request to be forwarded to the Town’s 2005 General Capital Budget process.

17. TOWN MANAGER’S REPORT OF JUNE 2, 2004
  RE:  APPOINTMENT OF TOURISM COMMITTEE CHAIRPERSON

Councillor Day moved to appoint Joannah Lang as Chairperson for the Town Tourism Committee, effective immediately.

Seconded by Councillor Evans.  Carried.
 

18. TOWN MANAGER’S REPORT OF JUNE 2, 2004 RE:  CANADA DAY EVENTS
Councillor Day moved to authorize 2004 Canada Day events as co-ordinated by the River Valley Lions and to authorize funding of $1,500 in conjunction with available government funding.

23. CORRESPONDENCE OF JUNE 7, 2004 FROM DEVELOPMENT OFFICER
RE:  REVISIONS TO SKIFF GRANT, ACOA APPLICATION - BRUNDAGE POINT RTN WATERFRONT DEVELOPMENT

Councillor McGowan moved to adopt the revised programming and organizational information requested by ACOA as well as additional letters of support received from Enterprise Saint John and Saint John Waterfront Development Partnership, for the Town’s application to ACOA for SKIFF funding of the Brundage Point Trailhead as a component of the River Trails Network.

24. LETTER OF MAY 27, 2004 FROM BRIAN D. BIGGINS, 41 MAJESTIC DRIVE
RE:  DRAINAGE ON SUNSET CRESCENT/DEVELOPMENT OFFICER’S REPORT OF MAY 27, 2004

Deputy Mayor Murphy moved that Council instruct staff to proceed with survey work to document existing grades for properties drained by an open culvert on the southeast corner of Sunset Drive.

25. CORRESPONDENCE OF JUNE 8, 2004 FROM DEVELOPMENT OFFICER
RE:  LAND ACQUISITION, FOWLER PROPERTY

Councillor Day moved that the Town offer to purchase three lots of land on Milligan Road from Beverly Wayne Fowler and Elizabeth Fowler, his wife, subject to title approval by the Town Solicitor, said parcels having PID Nos. 224485, 99911 and 99903 for a purchase price of $16,000, of which $10,000 is payable on closing and the balance to be in the form of an official receipt, issued by the Town, reflecting a donation to a Canadian Municipality in the amount of $6,000, being the fair market value of the land transferred to the Town, less compensation received; and further that the said purchase price shall include all the interest of Beverly Wayne Fowler in certain island or islands at the mouth of Milligan Brook, said island(s) having PID No. 99895; and further that staff and the Town Solicitor be authorized and directed to  prepare the necessary documentation and bring the matter to conclusion as soon as possible and further move that the Town acquire the interest of the Joseph A. Likely Estate in the above description island(s) having PID No. 99895, for the sum of $1.00 and that staff and the Town Solicitor be authorized and directed to prepare the necessary documentation and bring the matter to conclusion as soon as possible.

26. LETTER OF JUNE 1, 2004 FROM BARRY OGDEN RE:  MARIGOLD CAMPAIGN
Deputy Mayor Murphy moved to receive and file letter of June 1, 2004 from Barry Ogden Re:  Marigold Campaign.

27. DEVELOPMENT OFFICER’S REPORT OF JUNE 9, 2004
RE:  UNSIGHTLY PREMISES COMPLAINT, 2 SECOND STREET

Councillor McGowan moved, failing voluntary compliance by Mr. Thomas within 14 days, that a series of official notices be forwarded by registered mail to Mr. Thomas indicating the Town’s intention to proceed with legal action in regard to unsightly premises violations.

28. FIRE CHIEF’S REPORT OF JUNE 1, 2004 RE:  STATION 2 HVAC
Councillor Day moved to purchase and install a fresh air heat recovery unit in the firefighters’ lounge in Fire Station 2, the unit to be supplied and installed by Atlantic Air Cleaning Specialist and the necessary carpentry and electrical work to be perfomed by the Town’s contracted contractors, per report of June 1, 2004 as submitted by Fire Chief.

29. TOWN MANAGER’S REPORT OF JUNE 2, 2004 RE: 2004 SUMMER MEETING SCHEDULE 
Deputy Mayor Murphy moved to cancel the Regular Council Meetings of July 26, 2004 and August 23, 2004 with a Special Council Meeting to be called if required.

Seconded by Councillor McGowan.  Carried.
 

30. WORKS COMMISSIONER’S REPORT OF JUNE 10, 2004
RE:  PLOWING AND OTHER WINTER MAINTENANCE SERVICES, TENDER NO. 04-001W

Councillor McGowan moved to award Tender No. 04-001W for Plowing and Other Winter Maintenance Services to Brad Gould Trucking & Excavating Ltd. being the low bidder for $1,350,000 over the five (5) year duration of the contract subject to:

1) the execution of the formal contract with minor changes to reflect the equipment to be used by Brad Gould
    Trucking & Excavating Ltd.;

2) final contract to be reviewed by the Town’s solicitor prior to execution by the Town,

with authorization for signatures on the contract, upon approval by the Town solicitor, and with application of brine when applicable.

Seconded by Deputy Mayor Murphy.  Carried.
