The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, September 14, 2009 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE

Deputy Mayor Archer, Councillor Calvin, Councillor Day, Councillor McGowan and Councillor Murphy were in attendance.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Day moved to approve agenda of September 14, 2009 with the addition of item No. 23.a - Works Commissioner’s Report of September 11, 2009 Re:  Easement - Gary Davis Property.

Seconded by Deputy Mayor Archer.  Carried unanimously.

6.1 PRESENTATION OF RCMP STATISTICAL REPORTS FOR JULY AND AUGUST 2009 - RCMP REPRESENTATIVE ATTENDING

    Cpl. Landry provided information to Council regarding the RCMP Statistical Reports for July and August 2009.  

    Councillor Murphy moved to receive and file RCMP Statistical Reports for July and August 2009.

Councillor McGowan moved to adopt the minutes of the Regular Council Meeting of August 10, 2009 as presented.

Councillor Murphy moved to adopt the minutes of the Special Council Meeting of August 18, 2009 as presented.

Councillor Day moved to receive and file minutes of Planning Advisory Committee Meeting of August 17, 2009.

Councillor Murphy moved to receive and file Tender Notes of September 4, 2009 Re:  Salt Shed - Shannon Road, Project No. 010-147.

Councillor Day moved to pay Bills for Payment in the amount of $54,452.02 and Bills for Ratification in the amount of $114,647.62; Grand Total $169,099.64.

Councillor Murphy moved to receive and file General Revenue Fund Financial Report as at August 19, 2009.

Seconded by Deputy Mayor Archer.  Carried.

The Town Manager provided information regarding the General Revenue Fund Financial Report as at August 19, 2009.

16. LETTERS OF AUGUST 6, 2009 AND SEPTEMBER 9, 2009 FROM CLAYTON ROGERS, P. ENG., GODFREY ASSOCIATES LTD. RE:  STORM SEWER IMPROVEMENTS 2009, HIGHLAND ROAD AND INGLEWOOD DRIVE, GRAND BAY-WESTFIELD, NB, PROJECT NO. 010-141, CERTIFICATE NO. 1 AND CERTIFICATE NO. 2

Deputy Mayor Archer moved to  approve payment of Certificate No. 1 to Keel Construction in the amount of $125,423.59 and Certificate No. 2 to Keel Construction in the amount of $108,616.87 per letters of August 6, 2009 and September 9, 2009 from Clayton Rogers, P. Eng., Godfrey Associates Ltd. Re:  Storm Sewer Improvements 2009, Highland Road and Inglewood Drive, Grand Bay-Westfield, NB, Project No. 010-141.

17. LETTER OF AUGUST 27, 2009 FROM CHRISTOPHER WALDSCHUTZ, SECRETARY, THE GREATER SAINT JOHN SENIORS’ ADVISORY COMMITTEE RE:  RESPONSE TO REQUEST FOR ASSISTANCE

    Councillor Day moved to receive and file and have read letter of August 27, 2009 from Christopher Waldschutz, Secretary, The Greater Saint John Seniors’ Advisory Committee Re:  Response to Request for Assistance.

    Seconded by Deputy Mayor Archer.  Carried.

    It was noted that a letter would be forwarded to The Greater Saint John Seniors’ Advisory Committee to advise them that Councillor McGowan is a liaison for the River Valley Seniors and does not sit on the Board of the Greater Saint John Seniors’ Advisory Committee noting the Town will advertise again for a Board member from Grand Bay-Westfield, if the Advisory Committee so wishes.

18. LETTER OF AUGUST 13, 2009 FROM CLAYTON ROGERS, P. ENG., GODFREY ASSOCIATES LTD. RE:  SIDEWALK PANEL REPLACEMENT - NEREPIS ROAD (RTE. 177) PROJECT NO. 010-139, CERTIFICATE NO. 2 - FINAL COMPLETION

Councillor Day moved to pay Certificate No. 2 - Final Completion to Maguire Excavating in the amount of $3,847.20 per letter of August 13, 2009 from Clayton Rogers, P. Eng., Godfrey Associates Ltd. Re:  Sidewalk Panel Replacement - Nerepis Road (Rte. 177) Project No. 010-139.

19. LETTER RECEIVED SEPTEMBER 8, 2009 FROM BILL WALLACE RE:  POLICING SERVICES

Deputy Mayor Archer moved to refer letter received September 8, 2009 from Bill Wallace Re:  Policing Services to the RCMP Team Leader to meet with the resident and report back to Council.

20. MEMORANDUM OF AUGUST 19, 2009 FROM PLANNING ADVISORY COMMITTEE RE:  RECOMMENDATION TO COUNCIL - TENTATIVE SUBDIVISION APPROVAL - CHESTNUT HILL ESTATES, PHASE 2

    Councillor Murphy moved to receive and file memorandum of August 19, 2009 from Planning Advisory Committee Re:  Recommendation to Council - Tentative Subdivision Approval - Chestnut Hill Estates, Phase 2.

    Seconded by Deputy Mayor Archer.  Carried.

21. FIRE CHIEF’S REPORT OF SEPTEMBER 4, 2009 RE:  PUMP HOUSE RELOCATION PROJECT

    Deputy Mayor Archer moved to authorize the relocation of the Pump House located on the Westfield Crescent per Fire Chief’s Report of September 14, 2009 as allocated in the 2009 Capital Budget and also to proceed with ordering the electric pump required in advance due to the long delivery time for the unit and the project schedule time frame.

    Seconded by Councillor McGowan.  Carried.

22. Letter of September 8, 2009 from Clayton Rogers, P. Eng., Godfrey Associates Ltd. Re:  New Salt Shed, Shannon Road, Grand Bay-Westfield, NB Project No. 010-147 - Recommendation for Award of Contract

    Councillor Day moved to award the contract to the low tenderer, Castle Rock Construction Services Inc., for the corrected Tender Price of $315,299.66 HST included per letter of September 8, 2009 from Clayton Rogers, P. Eng., Godfrey Associates Ltd. Re:  New Salt Shed, Shannon Road, Grand Bay-Westfield, NB Project No. 010-147.

23. DEVELOPMENT OFFICER’S REPORT OF SEPTEMBER 9, 2009 RE:  ATLANTIC CANADA REGIONAL ADAPTATION COLLABORATIVE

    Councillor Murphy moved to support the Town’s participation in the Province’s Regional Adaptation Collaborative, studying the affects of Climate Change by providing Town Staff to participate in the Proposed Lower St. John River Project, to reduce risk and vulnerability in future land use planning, infrastructure and design decisions.

    Seconded by Deputy Mayor Archer.  Carried.

23.a WORKS COMMISSIONER’S REPORT OF SEPTEMBER 11, 2009 RE:  EROSION DAMAGE TO SEWER EASEMENT ON GARY DAVIS PROPERTY - 28 ASH GLEN LANE

    Deputy Mayor Archer moved to approve the restoration and stabilization of the maintenance access road to service the municipal sewer system at the north east corner of the property at 28 Ash Glen Lane; project to be supervised and administered by Godfrey Associates Ltd. for completion by the end of September 2009 subject to:

    1.    DFO approval;
    2.    approval of related costs.

    Seconded by Councillor Murphy.  Carried.
