1......... CALL TO ORDER - 7:30 P.M.
The Town of Grand Bay-Westfield Council met in a regular session on Tuesday, October 14, 2003 at 7:35 p.m. with Deputy Mayor McGowan presiding.
 
2.  RECORD OF ATTENDANCE
All members were in attendance with the exception of Mayor Losier.

Councillor Silliphant moved to pay Mayor Losier in her absence.

Seconded by Councillor Day.  Carried.
 

3.  APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Councillor Day moved to add item 28.a Re:  Legal Correspondence of October 9, 2003 from Gorman Nason to the agenda.

Seconded by Councillor Murphy.  Carried unanimously.

6.1 RCMP STATISTICAL REPORTS FOR AUGUST AND SEPTEMBER 2003 - 
CORPORAL GREG GRANT ATTENDING

Deputy Mayor McGowan noted Corporal Grant would not be attending and it was the consensus of Council to bring forward item 6.1 on the agenda should an RCMP Officer arrive for presentation of the Statistical Report.

6.2 INFORMATION UPDATE RE:  IMPERIAL THEATRE – BERTIS SUTTON, TOWN
REPRESENTATIVE ATTENDING AT 8:00 P.M.

Deputy Mayor McGowan noted Bertis Sutton would not be arriving until 8:00 p.m. It was the consensus of Council to bring forward item number 6.2 upon Mr. Sutton’s arrival.
 

7.  MINUTES OF REGULAR COUNCIL MEETING OF SEPTEMBER 22, 2003
Councillor Silliphant moved to adopt the minutes of the regular Council meeting of September 22, 2003 as presented.

7.1 MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF SEPTEMBER 15, 2003
Councillor Silliphant moved to receive and file the minutes of the Planning Advisory  Committee meeting of September 15, 2003.

Seconded by Councillor Murphy.  Carried.
 

7.2 TELEPHONE POLL OF SEPTEMBER 12, 2003 RE:  LEGAL SESSION
Councillor Day moved to ratify the Telephone Poll of September 12, 2003 Re:  Legal Session as presented.

Seconded by Councillor Silliphant.  Carried.
 

7.3 TELEPHONE POLL OF SEPTEMBER 22, 2003 RE:  PERSONNEL MATTERS
Councillor Day moved to ratify the Telephone Poll of September 22, 2003 Re:  Personnel Matters as presented.

7.4 NOTES FROM TENDER OPENING OF SEPTEMBER 24, 2003
RE:  VACUUM STREET SWEEPING SERVICES BID NO. T10-2003

Councillor Silliphant moved to receive and file Tender Notes of September 24, 2003  Re:  Vacuum Street Sweeping Services Bid No. T10-2003.

7.5 NOTES FROM LEGAL SESSION OF SEPTEMBER 22, 2003
Councillor Day moved to receive and file Notes from Legal Session of September 22, 2003.

8. BILLS FOR PAYMENT
Councillor Day move to pay the Bills for Payment enbloc for a total of $159,274.46 and approve Bills for Ratification for a total of $32,140.87 for a grand total of $191,415.33.

Seconded by Councillor Silliphant.  Carried.

The Town Manager provided information regarding certain items listed on Bills for Payment.

Councillor Silliphant moved to receive and file Town of Grand Bay-Westfield Sewerage Utility Accounts Receivable Report as at October 2, 2003.

16. LETTER OF SEPTEMBER 9, 2003 FROM DAVID COGSWELL, P. ENG., DESIGN BRANCH, 
DEPARTMENT OF TRANSPORTATION RE:  PROGRAM FOR IMPROVEMENTS TO PROVINCIALLY DESIGNATED HIGHWAYS WITHIN MUNICIPALITIES FOR 2004/BROUGHT FORWARD FROM SEPTEMBER 22, 2003/WORKS COMMISSIONER’S REPORT OF OCTOBER 7, 2003 

Councillor Day moved to concur with the recommendation of the Works Commissioner in his report dated October 7, 2003 to adopt the Designated Highway 5 Year Plan 2004-2008 and forward the Plan to the Department of Transportation. 

Seconded by Councillor Murphy.  Carried.

It was noted the municipal funding associated with the Designated Highway work relates to sidewalk construction.  It was also  noted the

Town Engineers would be advised to co-ordinate 2004 Sewerage Capital work and 2004 Designated Highway work to ensure no conflicts occur.
 

17. MAY 2003 DATA FROM HUMAN DEVELOPMENT COUNCIL RE:  INFO-LINE, ETC.
Councillor Day moved to table May 2003 data from Human Development Council Re: Info-Line, etc. to the October 27, 2003 agenda.

18. MEMORANDUM OF SEPTEMBER 29, 2003 FROM TOWN MANAGER 
RE:  APPOINTMENT TO TOWN EMERGENCY MEASURES ORGANIZATION

 Councillor Day moved to appoint Judith Rau to the Town Emergency Measures Organization effective immediately.

 Seconded by Councillor Murphy.   Carried.
 

19. LETTER RECEIVED OCTOBER 1, 2003 FROM ANDREW WALLACE, JONATHAN KELLY AND
MELINDA MCGRATH, GRAND BAY-WESTFIELD VISITOR INFORMATION CENTRE  (VIC) RE:  2003 SEASON 

Councillor Silliphant moved to receive and file letter received October 1, 2003 from Andrew Wallace, Jonathan Kelly and Melinda McGrath, Grand Bay-Westfield Visitor Information Centre.

Seconded by Councillor Day.  Carried.

It was noted a copy of the letter received October 1, 2003 from the Visitor Information Centre would be forwarded to the Tourism Committee.

Councillor Little moved that dialogue be held with the Chamber of Commerce and Town Staff with regard to points brought up in letter received October 1, 2003  Re:  Visitor Information Centre - 2003 Season.

It was noted thank you letters would be forwarded to the students who operated the VIC in 2003.
 

20. REPORT OF SEPTEMBER 30, 2003 FROM FIRE CHIEF RE:  TANKER WORK
Councillor Silliphant moved to concur with the recommendation of the Fire Chief per his report of September 30, 2003 to accept the quote from G. LeBlanc Fire Truck Repairs for two thousand six hundred and sixty eight dollars and fifty-four cents ($2,668.54) to replace the control rods on Tanker No 1.

Seconded by Councillor Day.  Carried.

It was noted the proposed work was a budgeted item.
 

21.  LETTER RECEIVED SEPTEMBER 22, 2003 FROM DAVID SHIELS RIVER VALLEY MIDDLE 
SCHOOL RE:  FUN RUN/REPORT OF OCTOBER 1, 2003 FROM DEVELOPMENT OFFICER 

Councillor Day moved to concur with the recommendation of the Development Officer dated October 1, 2003 to approve the proposed River Valley Middle School Run for Fun to be held on Sunday, October 26, 2003 under provisions set out in the Town’s Trafffic By-law No. 80, section 6(1) subject to permission of the Team Leader of the RCMP and the District Engineer of the New Brunswick Department of Transportation for the proposed route along Inglewood Drive, the Municipal Heritage Trail and crossing River Valley Drive starting and finishing at River Valley Middle School.

22. LETTER RECEIVED SEPTEMBER 30, 2003 FROM NEW BRUNSWICK ART BANK
RE:  2003 - 2004 NB ART BANK ACQUISITIONS PROGRAM

Councillor Murphy moved to receive and file letter received September 30, 2003 from New Brunswick Art Bank Re:  2003-2004 NB Art Bank Acquisitions Program.
 

Seconded by Councillor Day.  Carried.

It was noted information concerning the NB Art Bank Acquisitions Program would be posted on the Town Web Site and advertised by the Town.
 

6.2 INFORMATION UPDATE RE:  IMPERIAL THEATRE –
BERTIS SUTTON, TOWN REPRESENTATIVE ATTENDING AT 8:00 P.M.

Bertis Sutton provided a verbal presentation concerning the operations of the Imperial Theatre for the period October 2002 - October 2003.  Deputy Mayor McGowan thanked Mr. Sutton for his presentation and service as the Town’s representative.
 

23. LETTER OF OCTOBER 1, 2003 FROM GODFREY ASSOCIATES LTD. 
RE:  STREET IMPROVEMENTS 2003 - VARIOUS LOCATIONS, PROJECT NO. 010-100, CERTIFICATE NO. 3 - FINAL COMPLETION 

Councillor Day moved to concur with the recommendation of Godfrey Associates Ltd. and pay Galbraith Construction Ltd. $31,466.37 Re:  Street Improvements 2003, Various Locations, Project No. 010-100 Certificate No. 3 - Final Completion. 

 Seconded by Councillor Silliphant.  Carried.
 

24. REPORT OF OCTOBER 6, 2003 FROM TOWN MANAGER
RE:  REPAIRS AND MAINTENANCE - MUNICIPAL VEHICLES

Councillor Silliphant moved to concur with the recommendation of the Town Manager dated October 6, 2003 to enter into an agreement with Meineke Discount Mufflers for the Repairs and Maintenance of Municipal Vehicles  Re:  Bid No. 001RM-03 for the period January 1, 2004 to December 31, 2006 subject to the following rates:

$40.00 per hour Labour Rate - Regular Time
Parts Pricing - Bidder’s Cost Price plus 30%.

25. REPORT OF OCTOBER 8, 2003 FROM RECREATION DIRECTOR
RE:  INTEGRATED PEST MANAGEMENT SERVICES

Councillor Day moved to concur with the recommendation of the Recreation  Director dated  October 8, 2003  to  accept the  renewal  by
mutual consent with Urban Landscaping Ltd. for Integrated Pest Management Services at a cost of $8,487.38 + $1,273.09 HST for a Grand Total of $9,760.47 for another six month period of May - October 2004 at the same terms and conditions.

Seconded by Councillor Murphy.  Carried

It was noted that the rate for Integrated Pest Management has remained the same as the previous year.
 

26.  LETTER RECEIVED OCTOBER 2, 2003 FROM VERONICA RATCHFORD
RE:  FINANCIAL ASSESSMENT “WHEN GOING TO A NURSING HOME IN NEW BRUNSWICK”

Councillor Day moved to receive and file letter received October 2, 2003 from Veronica Ratchford Re:  Financial Assessment “When Going to a Nursing Home in New Brunswick” and that the correspondence be referred to Town Staff.

Seconded by Councillor Silliphant.  Carried. 
 

27.  LETTER OF SEPTEMBER 12, 2003 FROM HON. BRENDA FOWLIE, MINISTER OF 
ENVIRONMENT AND LOCAL GOVERNMENT RE:  NB CLEAN PROGRAM

Councillor Murphy moved to receive and file letter of September 12, 2003 from Hon. Brenda Fowlie, Minister of Environment and Local Government Re:  NB Clean Program.

Seconded by Councillor Day.  Carried.

It was noted that a letter of thanks would be forwarded to Hon. Brenda Fowlie.
 

28. WORKS COMMISSIONER’S REPORT OF OCTOBER 8, 2003
RE:  VACUUM STREET SWEEPING TENDER NO. T10-2003

Councillor Day moved to table the Works Commissioner’s Report of October 8, 2003 Re:  Vacuum Street Sweeping, Tender No. T10-2003 to the  October 27, 2003 agenda.

Councillor Day moved to concur with the recommendation per legal correspondence from Gorman Nason dated October 9, 2003.
