1...... CALL TO ORDER - 7:30 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Tuesday, October 14, 2008 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE

Deputy Mayor Archer, Councillor Day, Councillor McGowan, and Councillor Murphy were in attendance.  Councillor Calvin was absent.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Day moved to approve the agenda of Tuesday, October 14, 2008 as presented.

Seconded by Councillor McGowan.  Carried.

4. DISCLOSURE OF CONFLICT OF INTEREST

The Assistant Clerk declared a Conflict of Interest with Bills for Payment, Item #61.

5. PUBLIC HEARINGS

6. PUBLIC PRESENTATIONS

6.1 PRESENTATION OF RCMP STATISTICAL REPORT FOR SEPTEMBER 2008 - RCMP REPRESENTATIVE ATTENDING

Corporal Rob Landry provided information to Council regarding the RCMP Statistical Report for September 2008.  Cpl. Landry also introduced Inspector MacQuarrie to Council. Inspector MacQuarrie provided an update on operations within the District.

Councillor Murphy moved to receive and file RCMP Statistical Report for September 2008.

    Seconded by Councillor McGowan.  Carried.

6.2 PRESENTATION BY ED BETTS, TOWN REPRESENTATIVE, TRADE & CONVENTION CENTRE

Ed Betts, Town Representative, Trade & Convention Centre provided Council with information regarding the operations of the Trade & Convention Centre.

Councillor Murphy moved to receive presentation by Ed Betts, Town Representative, Trade & Convention Centre.

Seconded by Councillor McGowan.  Carried.

Mayor Losier thanked Mr. Betts for his service on the Board for the Trade & Convention Centre.

7. MINUTES

7.1 MINUTES OF REGULAR COUNCIL MEETING OF SEPTEMBER 22, 2008

Councillor Murphy moved to adopt minutes of the Regular Council Meeting of September 22, 2008 as presented.

Seconded by Councillor Day.  Carried.

7.2 MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF SEPTEMBER 15, 2008

Councillor McGowan moved to receive and file minutes of Planning Advisory Committee Meeting of September 15, 2008.

Seconded by Councillor Murphy.  Carried.

    The Assistant Clerk departed the meeting due to a stated Conflict of Interest.

8. BILLS FOR PAYMENT

    Councillor Day moved to pay item #61 in the amount of $40.00.

    Seconded by Councillor McGowan.  Carried.

The Assistant Clerk rejoined the meeting.

Councillor Day moved to pay Bills for Payment in the amount of $42,026.63 and Bills for Ratification in the amount of $52,107.37; Grand Total of $94,134.00.

Seconded by Deputy Mayor Archer.  Carried.

15.1 TOWN OF GRAND BAY-WESTFIELD SEWERAGE UTILITY ACCOUNTS RECEIVABLE REPORT AS AT SEPTEMBER 30, 2008

    Councillor Murphy moved to receive and file Town of Grand Bay-Westfield Sewerage Utility Accounts Receivable Report as at September 30, 2008.

    Seconded by Deputy Mayor Archer.  Carried.

RECREATION DIRECTOR’S REPORT OF OCTOBER 7, 2008 RE:  EXPRESSIONS OF INTEREST FOR CABOOSE

    Councillor Murphy moved to transfer the caboose to Edmundston Madawaska Tourism as it will conserve the caboose as an artifact in keeping with its historic intended use.

    Seconded by Councillor McGowan.  Carried.

Deputy Mayor Archer voted nay.

17. FIRE CHIEF’S REPORT OF OCTOBER 6, 2008 RE:  LEASED VAN

    Deputy Mayor Archer moved to authorize a 48 month lease of a Dodge Caravan from Dobson’s Chrysler Jeep for $470.99 plus taxes per month assigned as a Town vehicle and affixed with a permanent Town decal with the vehicle to be available for the Volunteer Fire Department and for other Town operations as needed.

    Seconded by Councillor McGowan.  Carried.

18. TOWN OF GRAND BAY-WESTFIELD SUMMARY INFORMATION SHEET - REQUESTS FOR FUNDING FOR SEPTEMBER 30, 2008 DEADLINE FOR GRANTS

    Councillor Day moved to approve grants to Jake Shaw and Lyndsay Day in the amount of $200 each.

    Seconded by Deputy Mayor Archer.  Carried.

19. RECREATION DIRECTOR’S REPORT OF OCTOBER 6, 2008 RE:  JANITORIAL SERVICES

    Councillor McGowan moved to approve the renewal of the agreement with Liam Beddow Cleaning for Janitorial Services for the amount of $2,010 plus applicable taxes per month for the period of January 1, 2009 to December 31, 2009.

    Seconded by Deputy Mayor Archer.  Carried.

20. WORKS COMMISSIONER’S REPORT OF OCTOBER 8, 2008 RE:  1 - TON SPREADER CONTROLS

    Deputy Mayor Archer moved to approve the purchase and installation of spreader controls on the Town’s 1-Ton truck by Applied Pressures Inc. for $5,820 plus taxes.

21.
MEMORANDUM OF OCTOBER 7, 2008 FROM PLANNING ADVISORY COMMITTEE RE:  TENTATIVE SUBDIVISION PLAN APPROVAL, CHESTNUT HILL ESTATES SUBDIVISION, PHASE 1/ DEVELOPMENT OFFICER’S REPORT OF OCTOBER 8, 2008

    Councillor McGowan moved:

1.      Council accept the proposed preliminary road design standards and consider a Municipal Service easement on the south east corner of the property for the inlet of the storm water culvert for Tentative Subdivision, Chestnut Hill Estates, Phase-1 subject to the following revisions to be required prior to approval of the final Subdivision Plan:

i)civic addresses to be recorded on the Final Subdivision Plan;
ii)subject to recommendation of approval by the Department of Environment for extension of sewer services;
iii)and also subject to approval of the following general conditions:

a)no blasting to occur in the development of the subdivision without a pre-blast survey and proof of liability insurance to the approval of Council;
b)recording of NB Power utility easements on the Final Subdivision Plan;
c)approval of Subdivision Developer’s Agreement prior to final approval of the Plan;

2.    Council accept $706.11 Money in Lieu of Land For Public Purposes (cash, debit, money order, or certified cheque) for the creation of two new multiple residential building lots prior to final approval of the Subdivision Plan;

3.    Council assent to the name Prince Street on the Final Subdivision Plan, based on the Tentative Subdivision Plan dated October 2, 2008.

    Seconded by Councillor Murphy.  Carried.

    It was noted the property owner has the option available to select an alternate street name.

22. CORRESPONDENCE OF OCTOBER 2, 2008 FROM THE LOCAL ADVISORY COMMITTEE FOR THE LOCH ALVA PROTECTED NATURAL AREA RE:  REQUEST FOR SUPPORT

    Councillor Murphy moved to table correspondence of October 2, 2008 from the Local Advisory Committee for the Loch Alva Protected Natural Area Re:  Request for Support, in order to obtain additional information from J.D. Irving Company.

    Seconded by Councillor McGowan.  Carried.

23. MEMORANDUM OF OCTOBER 7, 2008 FROM PLANNING ADVISORY COMMITTEE RE:  2009 BUDGET REQUEST

Councillor McGowan moved to forward memorandum of October 7, 2008 from the Planning Advisory Committee to the 2009 Budget process for consideration.

Seconded by Deputy Mayor Archer.  Carried.

24. CARD RECEIVED FROM HELENE PYE ON BEHALF OF THE TERRY FOX RUN RE:  THANK YOU FOR USE OF UNITY PARK

Deputy Mayor Archer moved to receive and file and have read card received from Helene Pye on behalf on the Terry Fox Run Re:  Thank You for use of Unity Park.

    Seconded by Councillor Day.  Carried.

25. LETTER OF OCTOBER 1, 2008 FROM CLAYTON ROGERS, P. ENG., GODFREY ASSOCIATES LTD. RE:  STREET IMPROVEMENTS 2008, VARIOUS LOCATIONS, PROJECT NO. 010-135, CERTIFICATE NO. 3 - FINAL COMPLETION

    Deputy Mayor Archer moved to approve payment of Certificate No. 3  - Final Completion to Lafarge Canada Inc. in the amount of $34,408.90 per letter of October 1, 2008 from Clayton Rogers, P. Eng., Godfrey Associates Ltd. Re:  Street Improvements 2008, Various Locations, Project No. 010-135.

    Seconded by Councillor Murphy.  Carried.

26. LETTER OF MAY 16, 2008 FROM MILLER MORRELL, PRESIDENT, GRAND BAY-WESTFIELD NEIGHBOURHOOD WATCH COMMITTEE RE:  THANK YOU FOR CONTRIBUTION TOWARDS NEIGHBOURHOOD WATCH COMMITTEE BIKE RODEO

    Councillor Day moved to receive and file and have read letter of May 16, 2008 from Miller Morrell, President, Grand Bay-Westfield Neighbourhood Watch Committee Re:  Thank You for Contribution towards Neighbourhood Watch Committee Bike Rodeo.

    Seconded by Councillor Murphy.  Carried.

    Letter of May 16, 2008 from Neighbourhood Watch Committee was read.

    It was noted the Town donated $500 towards the 2008 Neighbourhood Watch Bike Rodeo.

LETTER RECEIVED OCTOBER 3, 2008 FROM LORA SKEAD, PRESIDENT, MADD SAINT JOHN & AREA CHAPTER RE:  2008 RED RIBBON CAMPAIGN

    Councillor Murphy moved to support the MADD Canada’s Red Ribbon Campaign per letter received October 3, 2008 from Lora Skead, President, MADD Saint John & Area Chapter.

    Seconded by Deputy Mayor Archer.  Carried.

28. EMAIL OF OCTOBER 1, 2008 FROM SCHOOL DISTRICT 6 - CELEBRATE WHAT’S RIGHT WITH THE WORLD RE:  OCTOBER’S CELEBRATE THEME - RECOGNIZE ABUNDANCE

    Councillor Murphy moved to receive and file email of October 1, 2008 from School District 6 - Celebrate what’s Right with the World Re:  October’s Celebrate Theme - Recognize Abundance.

    Seconded by Deputy Mayor Archer.  Carried.
