1. ........ CALL TO ORDER 
The Town of Grand Bay-Westfield Council met in a regular session on Monday, April 22, 2002 at 7:35 p.m. with Mayor Losier presiding.
 
2. RECORD OF ATTENDANCE
All members were in attendance with the exception of Councillor Calvin who was absent due to a death in the family.

Deputy Mayor McGowan moved to pay Councillor Calvin in his absence.

Seconded by Councilor Silliphant.  Carried.
 

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Deputy Mayor McGowan moved to add the following items to the agenda as 30a & 30b:

30a. Report of April 19, 2002 from Works Commissioner Re:  Lift Station Pump Replacement

30b. Letter of April 22, 2002 from Andrew Easton Re:  Resignation from Emergency Measures Organization.

Seconded by Councillor Day.  Carried unanimously.

6.1 PRESENTATION RE:  CHARLOTTE COUNTY DEVELOPMENT CORPORATION INC.
GEOFF KNIGHT, EXECUTIVE DIRECTOR ATTENDING

Geoff Knight, Executive Director of the Charlotte County Development Corporation gave a presentation describing the various programs offered by the Development Corporation.

Councillor Day moved to receive and display the Community Business Development Centre information as presented by Geoff Knight.

Seconded by Councillor Little.  Carried.
 

6.2  LETTER OF APRIL 12, 2002 FROM SOLICITOR RICHARD A. NORTHRUP
RE:  GULLIVER/NEIL PROPERTY, 21 HAMILTON ROAD, PID NO. 00226704/DEVELOPMENT OFFICER’S REPORT OF APRIL 17, 2002

Solicitor Richard Northrup, representing Lynn Gulliver of 21 Hamilton Road, gave a presentation regarding the sale of Ms. Gulliver’s property located at 21 Hamilton Road and the encroachment onto the road allowance on the east side of the property.  Mr. Northrup requested the Town give assurances that it would allow the encroachment to the vendor and her successors.

Councillor Day moved that in the apparent encroachment of an existing dwelling located at 21 Hamilton Road, as shown on survey plan prepared by Hughes Surveys dated 1983, as encroaching on the “Common Road”, that such encroachment is not the subject of any plan or action by the Town to have the building removed, as the Town does not consider the said Common Road a public street.

7. MINUTES OF REGULAR COUNCIL MEETING OF APRIL 8, 2002
Councillor Day moved to adopt the minutes of the regular Council meeting of April 8, 2002 as presented.

Seconded by Councillor Silliphant.  Carried.
 

7.1 MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF APRIL 2, 2002
Councillor Silliphant moved to receive and file the minutes of the Planning Advisory Committee meeting of April 2, 2002.

Seconded by Deputy Mayor McGowan.  Carried.
 

8. BILLS FOR PAYMENT
Councillor Day moved to pay the Bills for Payment enbloc for a total of $29,732.93 and approve the Bills for Ratification for a total of $63,079.36, Grand Total $92,812.29.

Seconded by Councillor Silliphant.  Carried

Councillor Silliphant moved to receive and file the Town of Grand Bay-Westfield Sewerage Utility Accounts Receivable Report as at April 9, 2002.

Seconded by Councillor Day.  Carried.
 

16. DEVELOPMENT OFFICER’S REPORT OF APRIL 15, 2002
RE:  LAND ACQUISITION, PID #00228296 LILLIAN CAMP PROPERTY, REMNANT PARCEL BETWEEN NEREPIS ROAD AND NB SOUTHERN RAILWAY

Councillor Day moved to accept the offer of land out of PID 00228296 laying between Nerepis Road and NB Southern Railway from Lillian Camp subject to legal and survey costs being born by the Town.

Seconded by Deputy Mayor McGowan.  Carried.
 

17. WORKS COMMISSIONER’S REPORT OF APRIL 17, 2002
RE:  TRAFFIC CONTROLS RIVER VALLEY DRIVE

Councillor Silliphant moved to refer the Works Commissioner’s report of April 17, 2002 Re: Traffic Controls River Valley Drive to MLA Milt Sherwood to determine if funding could be provided by the Province to do a Traffic Study along River Valley Drive.

Seconded by Councillor Day.  Carried.

Mayor Losier noted that due to the increase of traffic on River Valley Drive viable alternatives for traffic needed to be considered.  In speaking with DOT and the RCMP it was determined that before anything could be changed on River Valley Drive there would need to be a Traffic Study with a price tag of $5,000.00.

Councillor Silliphant moved to forward a response to the two residents (per Works Commissioner’s Report of April 17, 2002) regarding concerns about traffic on River Valley Drive.

18. LETTER OF APRIL 3, 2002 FROM CLAYTON ROGERS, P. ENG., GODFREY ASSOCIATES
RE:  STREET CONDITION REPORT - STREET IMPROVEMENTS IMPLEMENTATION SCHEDULE

Councillor Day moved to proceed with the Street Condition Report and Street Improvements Implementation Schedule as presented in the Godfrey Associates Report of April 3, 2002.

Seconded by Councillor Little.  Carried.

It was noted that the fee for the Street Condition Report is $3,500 plus HST.
 

19. TOWN MANAGER’S REPORT OF APRIL 3, 2002 RE:  EMPLOYEE AND EMPLOYER
REPRESENTATIVES FOR MUNICIPAL ADVISORY CORPORATION INC./BROUGHT FORWARD FROM APRIL 9, 2002 AGENDA

Councillor Day moved to appoint Deputy Mayor Diane McGowan as the Town’s employer representative on the Municipal Advisory Corporation Inc. with an employee representative to be appointed at the discretion of Town employees.

Seconded by Councillor Silliphant.  Carried.
 

20. FIRE CHIEF’S REPORT OF APRIL 2, 2002 RE:  DISPATCH SERVICES CONTRACT
Deputy Mayor McGowan moved to accept the base fee of $10,900.00 for the period of April 1, 2002 to March 31, 2003 in conjunction with the “Agreement Respecting Communication Services” between the Town of Grand Bay-Westfield and the City of Saint John as per correspondence from William Todd, Director of the Saint John Public Safety Communications Centre.

Seconded by Councillor Day.  Carried.
 

21.  LETTER OF APRIL 1, 2002 FROM SHARON A. O’BRIEN, SENIOR WATCH INC.
RE:  BANNING THE USE OF WEED KILLERS AND PESTICIDES

Councillor Day moved to refer letter of April 1, 2002 from Sharon A. O’Brien, Senior Watch Inc. Re:  Banning the use of Weed Killers and Pesticides to Recreation Director for an update back to Council.

Seconded by Deputy Mayor McGowan.  Carried.
 

22. MEMORANDUM OF APRIL 3, 2002 FROM PLANNING ADVISORY COMMITTEE
RE:  PLANNING ADVISORY COMMITTEE VACANCY

Councillor Day moved to proceed to advertise the vacancy on the Planning Advisory Committee due to the resignation of Tony Ratchford.

Seconded by Councillor Silliphant.  Carried.

Councillor Day moved to accept with regret the resignation of Tony Ratchford from the Planning Advisory Committee with a letter of appreciation to be forwarded to Mr. Ratchford.

23. LETTER OF APRIL 2, 2002 FROM SAINT JOHN FLAMES HOCKEY CLUB
RE:  SEASON TICKET RENEWAL

Councillor Day moved to purchase two season tickets from the Saint John Flames Hockey Club to share with community volunteers as has been done in the past.

24. LETTER OF MARCH 28, 2002 FROM ATLANTIC HEALTH SCIENCES CORPORATION
RE:  REGIONAL HEALTH AUTHORITY 2

Councillor Day moved to receive and file letter of March 28, 2002 from Atlantic Health Sciences Corporation Re:  Regional Health Authority 2.

25. PRESS RELEASE FROM ENVIRONMENT AND LOCAL GOVERNMENT
RE:  BUDGET ESTIMATES/ENVIRONMENT AND LOCAL GOVERNMENT

Councillor Day moved to write to Mayor Raymond Murphy, President of the Union of the Municipalities of New Brunswick (UMNB) and Hon. Kim Jardine, Minister of Environment and Local Government to request local service districts and municipalities be treated in an equitable manner.

Seconded by Councillor Silliphant.  Carried.
 

26. LETTER OF APRIL 11, 2002 FROM EMERGENCY MEASURES ORGANIZATION
RE: EMERGENCY RESPONSE PLANS AND DISASTER EXERCISES AND TRAINING

Councillor Day moved to receive and file letter of April 11, 2002 from Emergency Measures Organization Re:  Emergency Response Plans and Disaster Exercises and Training.

27. LETTER OF APRIL 11, 2002 FROM CANADIAN RED CROSS
RE:  THANK YOU FOR DONATION AND SUPPORT FOR RED CROSS MASH BASH 2002

Deputy Mayor McGowan moved to receive and file letter of April 11, 2002 from the Canadian Red Cross Re:  Thank You for Donation and Support for Red Cross Mash Bash 2002.

28. LETTER DATED MARCH 27, 2002 FROM ENTERPRISE SAINT JOHN
RE:  CHANGES TO LETTERS PATENT/BROUGHT FORWARD FROM APRIL 8, 2002 AGENDA

Councillor Little moved the Town of Grand Bay-Westfield consent to the amendment of the Letters Patent of the Greater Saint John Economic Development Commission, Incorporated in the form of the amendment hereto attached as “Schedule A”, and further the Town of Grand Bay-Westfield consents to the amendment of the By-laws of the Commission to provide for the position of Past Chairperson, and to provide for the criteria for the selection of Directors in the form of the provision attached hereto as “Schedule B”.

Councillor Day moved to accept with regret the resignations of Suzanne Skidmore and Bev Wilcox from the Beautification Committee with letters of appreciation to be forwarded to Suzanne Skidmore and Bev Wilcox.

Councillor Day moved to appoint Roy Morris to the Beautification Committee effective April 22, 2002.

30. FAX DATED APRIL 9, 2002 FROM THE UNION OF MUNICIPALITIES OF NEW BRUNSWICK 
(UMNB)  RE:  NEWSLETTER FOR MARCH

Councillor Day moved to receive fax dated April 9, 2002 from the Union of Municipalities of New Brunswick (UMNB) Re:  Newsletter for March and to forward a request to Kathy Stapleton of the Stewardship Branch for the Department of Environment and Local Government to invite her to give a presentation to Council with regard to lawn care pesticides, managing pesticides, and pesticide registration within our community.

30a. WORKS COMMISSIONER REPORT OF APRIL 19, 2002
RE:  LIFT STATION PUMP REPLACEMENT

Councillor Silliphant moved that a new sewage lift pump be purchased from Thomas Industrial Sales for $3,750.00 plus tax for Lift Station No. 7, Brandy Point Road.

30b. LETTER OF APRIL 22, 2002 FROM ANDREW EASTON RE:  RESIGNATION
Councillor Day moved to accept with regret the resignation of Andrew Easton from the Town Emergency Measures Organization.

Seconded by Deputy Mayor McGowan.  Carried.

Deputy Mayor McGowan moved to appoint Councillor Bev Day as Acting Director of the Town of Grand Bay-Westfield Emergency Measures Organization effective immediately and until the conclusion of the upcoming EMO exercise.

Seconded by Councillor Silliphant.  Carried.
