1. CALL TO ORDER - 7:30 P. M.

The Town of Grand Bay-Westfield Council met in a regular session on Tuesday, May 24, 2005 with Mayor Losier presiding.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Councillor Day moved to add to agenda item No. 23 - letter  of May 18, 2005 from Jane Madsen,  letter of May 19, 2005  from Shirley James, and letter of May 20, 2005 from Guy and Marie Swan and further moved agenda items 17, 18, and 19 be added to Public Presentations as  items  6.a, 6.b, and 6.c.

 Seconded by Councillor McGowan.  Carried unanimously.

RE:  BUILDING AND ZONING BY-LAW VIOLATION

 Bruce Savoie presented Council with an overview of his letter of May 17, 2005 Re:  Building and Zoning By-law Violations.

 Deputy Mayor Murphy moved to refer the letter of May 17, 2005 from Bruce Savoie to Town Staff to report back to Council with respect to the letter’s content.

 Seconded by Councillor McGowan.  Carried.
 

6.b  LETTER OF MAY 17, 2005 FROM CHARLES AND THELMA CLAYTON 
RE:  BUILDING AND ZONING BY-LAW VIOLATIONS

 Charles Clayton presented Council with an overview of his letter of May 17, 2005 Re:  Building and Zoning By-law Violations.

 Deputy Mayor Murphy moved to refer the letter of May 17, 2005 from Charles and Thelma Clayton to Town Staff to report back to Council with respect to the letter’s content.

6.c LETTER OF MAY 17, 2005 FROM JOHN CHIASSON AND MARIAN DEMPSEY
RE:  BUILDING AND ZONING BY-LAW VIOLATIONS

 Marian Dempsey and John Chiasson presented Council with an overview of their letter of May 17, 2005 Re:  Building and Zoning By-law Violations.

 Councillor Evans moved to refer the letter of May 17, 2005 from John Chiasson and Marian Dempsey to Town Staff to report back to Council with respect to the letter’s content.

 Seconded by Deputy Mayor Murphy.  Carried.

It was noted the Town would notify Bruce Savoie, Charles and Thelma Clayton, and John Chiasson and Marian Dempsey when the subject of their by-law violations is returning to the Council agenda.
 

7. MINUTES OF REGULAR COUNCIL MEETING OF MAY 9, 2005
Deputy Mayor Murphy moved to adopt the minutes of the Regular Council Meeting of May 9, 2005 as presented.

Councillor McGowan moved to receive and file the minutes of the Planning Advisory Committee Meeting of May 2, 2005.

Councillor McGowan moved to receive and file the Tender Notes of May 5, 2005 Re:  Street Improvements – 2005, Project No. 010-111.

Councillor Day moved to pay the Bills for Payment enbloc for a total of $59,093.30 and Bills for Ratification for a total of $40,231.00; grand total of $99,324.30.

Councillor Day moved to receive and file the General Revenue Financial Report as at April 30, 2005.

16. LETTER OF MAY 4, 2005 FROM STEPHANIE PATTERSON, P. ENG., GODFREY ASSOCIATES LTD. 
RE:  SEWER SYSTEM EXTENSION, GRAND BAY-WESTFIELD, INFRASTRUCTURE PROJECT NO. 63 37 05 431 02, PROJECT NOS. 010-091, 010-102, 010-103, 010-104, 010-109 & 010-110, CLAIM NO. 16

Councillor Day moved to approve Claim No. 16 and pay relevant invoices in the amount of $84,027.12 per letter of May 4, 2005 from Stephanie Patterson, P.Eng., Godfrey Associates Ltd.  Re:  Sewer System Extension, Grand Bay-Westfield, Infrastructure Project No. 63 37 05 431 02, Project Nos. 010-091, 010-102, 010-103, 010-104, 010-109 & 010-110.

 Deputy Mayor Murphy moved to donate $100.00 to the Canada Day Half Marathon per letter of May 9, 2005 from Grand Bay-Westfield Half Marathon Re:  Mile Marker Sponsor.

21. RECOGNITION OF TOWN EMERGENCY SERVICES
RE:  RECENT FLOODING

 Councillor Day moved to receive and file memorandum Re:  Recognition of Town Emergency Services - Recent Flooding.

Seconded by Deputy Mayor Murphy.  Carried.

 It was noted letters were forwarded to Diane McGowan, Westfield Volunteer Ambulance Services, to the Grand Bay-Westfield Volunteer Fire/Rescue Department, and to Bruce Gault, Works Department acknowledging their dedication during the recent flooding in our community.

 Mayor Losier thanked all Town Emergency Services for their efforts during recent flooding.
 

22. ST. JOSEPH’S COMMUNITY HEALTH CENTRE SEMINAR
RE:  FINDING THE ART OF BALANCE

 Councillor Day moved to receive and file memorandum received Re:   St. Joseph’s Community Health Centre Seminar - Finding the Art of Balance.

 Seconded by Deputy Mayor Murphy.  Carried.

 It was noted the information concerning the upcoming seminars would be placed in the next available Town mass mail out noting calendar dates with a copy of the information to go to volunteer groups, e.g. emergency services.
 

23.  LETTER OF MAY 14, 2005 FROM JANET AND PETER JACKSON
RE:  USES OF LAND ZONED R1 RESIDENTIAL/DEVELOPMENT OFFICER’S REPORT OF MARCH 18, 2005/LETTER OF MAY 18, 2005 FROM JANE MADSEN, LETTER OF MAY 19, 2005 FROM SHIRLEY JAMES AND LETTER OF MAY 20, 2005 FROM GUY AND MARIE SWAN 

 Deputy Mayor Murphy moved Council grant authority to the Town’s Solicitors to apply, if necessary, to the appropriate Court for an Order requiring stripping of topsoil and/or excavation of land by or on behalf of Dean Construction Ltd. and/or Douglas Smith, in violation of applicable Town By-laws, to immediately cease, pending Council’s receipt and consideration of any application for an excavation permit under the appropriate By-laws of the Town and further that Staff be authorized to assist the Town’s Solicitors in this matter, where necessary, per letter of May 14, 2005 from Janet and Peter Jackson Re: 
Uses of Land Zoned R1 Residential/Development Officer’s Report of March 18, 2005.

24. LETTER OF MAY 17, 2005 FROM ANDREW AND KELLY MURRAY
RE:  MURRAY PROPERTY AT 23 RIDGE WAY/WORKS COMMISSIONER’S REPORT OF MAY 4, 2005 BROUGHT FORWARD FROM MAY 9, 2005

 Councillor Evans moved a letter be forwarded to Andrew and Kelly Murray  requesting the Murrays  provide to the Town written confirmation of the following:

(a) the damages that they allege that they have suffered as a result of the Town’s actions;

(b) the action that they are requesting the Town to take in the matter.

25. DEVELOPMENT OFFICER’S REPORT OF MAY 18, 2005
RE:  EXHIBITION BY-LAW, APPLICATION FOR LICENSE - FARMERS MARKET

Deputy Mayor Murphy moved to have staff proceed with issuing Exhibition License 05-2 for River Valley Community Center to hold a Farmers Market (individual market stall vendors) to be located outside main building on the north end parking area of the River Valley Community Center on the following six (6) dates:  May 28, 2005; June 25, 2005; July 23, 2005; August 20, 2005; September 17, 2005, and October 8, 2005 subject to:

i) provisions of the Town’s Noise By-law;
ii) maintaining emergency access routes during the event;
iii) the tent is to be set up on the preceding Friday prior to each Market Day and taken down immediately after the Market Day is concluded.

Seconded by Councillor McGowan.  Carried.
 

26. MEMORANDUM OF MAY 17, 2005 FROM PLANNING ADVISORY COMMITTEE
RE:  TENTATIVE SUBDIVISION APPROVAL (REVISION) PANORAMIC ESTATES SUBDIVISION, PHASE 3/DEVELOPMENT OFFICER’S REPORT OF MAY 17, 2005 

Councillor Day moved to concur with the Planning Advisory Committee and accept $35.12 as Money in Lieu of Land for Public Purposes for the addition of two new lots in an Amended Tentative Subdivision Plan, Panoramic Estates Subdivision, Phase 3, as shown on the Plan prepared by Kierstead Quigley & Roberts with a revised date of May 9, 2005 subject to:

a) final review and recommendation from the Town Engineer on design changes to be reflected in amendments to Plan and Profile Garfield Street Drawing 4-2 as prepared by ADI Limited dated August 8, 2003,

and further moved to approve the name Boyd Drive and to assent to the name on the Final Subdivision Plan as presented on the amended Tentative Subdivision Plan dated May 9, 2005, in place of the previously proposed street name of Garfield Street. 

 Seconded by Councillor Evans.  Carried.
 

27. RIVER VALLEY WESLEYAN CHURCH LITTER CLEAN UP ON JUNE 11, 2005
Deputy Mayor Murphy moved to receive and file the notice Re:  Litter Clean Up on River Valley Drive scheduled for June 11, 2005 by area churches.

 Seconded by Councillor Day.  Carried.

It was noted information on the Litter Clean Up would be placed in the next available Town mass mail out, including a contact number.
 

28. LETTER OF MAY 5, 2005 FROM STEPHANIE PATTERSON, P. ENG., GODFREY ASSOCIATES LTD. RE:  STREET IMPROVEMENTS 2005, PROJECT NO. 010-111

Councillor Day moved to award the contract for Street Improvements 2005, Project No. 010-111 to the low tenderer Keel Construction Ltd. for the tender price of $256,360 per letter of May 5, 2005 from Stephanie Patterson, P.Eng., Godfrey Associates Ltd.

 Seconded by Deputy Mayor Murphy.  Carried.
 

29.  DEVELOPMENT OFFICER’S REPORT OF MAY 16, 2005 
RE:  TOWN OF GRAND BAY-WESTFIELD STRATEGIC DEVELOPMENT ACTION PLAN, DEVELOPMENT CONCEPT PLAN, COMMERCIAL/MULTI-DENSITY RESIDENTIAL ACCESS CORRIDOR

Councillor McGowan moved that Council accept the proposal provided by SGE Acres for Consultant Services to prepare a Development Concept Plan - Commercial/Multi-Density Residential Access Corridor as defined in the terms of reference set out in the Request for Proposal No. 05-CP01, for the fixed price of  $19,430 including fees and expenses plus HST.

30. E-MAIL FROM DEPUTY MAYOR BRENDA MURPHY ON BEHALF OF TOURISM COMMITTEE
RE:  TOWN CONTRIBUTION TO THE VISITOR INFORMATION CENTRE FOR 2005 BROUGHT FORWARD FROM MAY 9, 2005

 Deputy Mayor Murphy moved that the Town contribute $1,500 (half) toward the cost of operating the Visitor Information Centre (VIC) during the month of June, with the understanding the River Valley Chamber of Commerce will cover the other half; with this being a pilot for 2005 with the Chamber submitting detailed statistics for June 2005 to the Town in addition a grant in the amount of $3,500 is approved to the River Valley Chamber of Commerce to assist with the operation of the Visitor Information Center in Grand Bay-Westfield with all funding subject to:

1. the people working the V.I.C. be asked to pick up litter around and near the Caboose as part of their daily duties 
    while the V.I.C. is operating;

2. at the beginning and end of the operation of the V.I.C. that items in the Caboose be safely unpacked and then
    packed for the season;

3. that the students submit an Information Sheet to the Town by August 26, 2005 with relevant operating information
    completed on a standard information sheet provided by the Town;

4. that the students complete weekly visitor information statistics on forms supplied by the Town with the number and
    breakdown of tourist inquires;

5. that the students are to return their signed out keys for the Visitor Information Center directly after use for the
    season to the Town office;

6. that the River Valley Chamber of Commerce will forward any financial requests for assistance for the 2005 Tourist
    season prior to October 1, 2005; the request is to include a breakdown of expenses for the $3,500 received from
    the Town of Grand Bay-Westfield;

7. to consult with the Recreation Department before carrying out any repairs or changes on or around the caboose area.
