The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, September 24, 2007 with Mayor Losier presiding.

Councillor Day moved to receive and file Quotation Notes of September 12, 2007 Re:  Pavement Markings 2008 - 2009.

8. BILLS FOR PAYMENT
Councillor Day moved to pay Bills for Payment enbloc for a total of $21,332.24 and Bills for Ratification for a total of $173,738.82 grand total of $195,071.06.

    Councillor Day moved to receive and file the following Consent Agenda item:

a) Grand Bay-Westfield Volunteer Fire/Rescue Department Report for August 2007.

It was requested that Town staff check the status of the fire alarms noted in the August monthly report with information to be provided to Council.

17. LETTER OF SEPTEMBER 5, 2007 FROM RON MALONEY, MAYOR, TOWN OF QUISPAMSIS
RE:  OFFICIAL OPENING OF THE BRUNDAGE POINT RIVER CENTRE

 Councillor Day moved to receive and file letter of September 5, 2007 from Ron Maloney, Mayor, Town of Quispamsis Re:  Official Opening of the Brundage Point River Centre and to have the letter read into the record.

TRACK ASSOCIATION  RE:  THANK YOU
Councillor Day moved to receive and file letter of September 10, 2007 from Joe Oliver, Chairman River Valley Track Association Re:  Thank You and to have the letter read into the record.

19.  TOWN MANAGER’S REPORT OF SEPTEMBER 17, 2007 RE:  LONG TERM FINANCING
Deputy Mayor Murphy moved that the Treasurer and Mayor be authorized to issue and sell to the New Brunswick Municipal Finance Corporation a Municipality of Grand Bay-Westfield debenture in the principal amount of $300,000 for a term of fifteen (15) years with an option to renew in five (5) years on such terms and conditions as are recommended by the New Brunswick Municipal Finance Corporation, and be it resolved that the Municipality of Grand Bay-Westfield agree to issue post dated cheques payable to the New Brunswick Municipal Finance Corporation as and when they are requested in payment of principal and interest charges on the above debenture, one year in advance.

 Seconded by Councillor McGowan.  Carried.
 

20. LETTER OF SEPTEMBER 11, 2007 FROM JULIE PUGSLEY, P.R.O. KIDS MANAGER 
RE:  P.R.O. KIDS PROGRAMS/RECREATION DIRECTOR’S REPORT OF SEPTEMBER 19, 2007

 Councillor Day moved to approve the P.R.O. Kids Program funding agreement with the City of Saint John at the yearly amount of $2,200 from the Town of Grand Bay-Westfield for 2008 and 2009.

 Seconded by Councillor Evans.  Carried.
 

21. DEVELOPMENT OFFICER’S REPORT OF SEPTEMBER 19, 2007 
RE:  TENTATIVE SUBDIVISION PLAN, PANORAMIC ESTATES SUBDIVISION, PHASE 2, TENTATIVE APPROVAL EXTENSION

 Councillor Evans moved to grant an extension to Tentative Approval of Panoramic Estates Subdivision, Phase 2 and:

1. that a note be included on the Plan which is to be registered and form part of the Developer’s Subdivision Agreement to require Engineered fill and erosion control measures with 1 vertical to 2 horizontal (1:2) slope protection to be undertaken and verified by the Consulting Engineer, including preparation for foundation placement on engineered fill as required prior to the completion of the development of Phase 2 or in advance of any Building Permits to be issued for these lots in Phase 2, with confirmation of compliance with the minimum required 690 m² area for each of these lots ( C-1 to C-7 and B-22 to B-26) per requirements of section 4.8 of Town Zoning By-law No. 101;

2. that an undertaking be registered against the property to restrict any changes in final grades and slope protection, unless modifications are designed, supervised, and substantiated by a geotechnical engineering firm licensed in the Province of New Brunswick, for any such alterations;

3. that an undertaking be registered against all lots created in Panoramic Estates Phase 2 and Phase 4 to advise potential homeowners of the possible treatment requirements necessary to meet the Canadian Drinking Water Quality Guidelines for elevated levels of fluoride…

4. that Council accept the proposed development design standards as shown on Preliminary Plans, Subdivision Services, Panoramic Estates Phase 2, Drawings 4-1 and 4-2 for an extension of June Avenue as prepared by ADI Limited received August 31, 2006 subject to:

a) the following revisions to be noted on the final Subdivision Plan:

i) indicate a 15 m radius temporary turn around to be at the south end of June Avenue;

ii) delete the 20 m x 17 m temporary turn around as indicated beside lot B-21;

iii) record the slope stabilization control measures to be undertaken on Lots C1-C7;

a) approval of the following general conditions:

i) no blasting to occur in the development of the subdivision without a pre-blast survey and proof of liability insurance to the approval of Council;

ii) recording of NB Power Utility Easements on the Final Subdivision Plan (provided that the service corridor not be located at the rear of the lots);

iii) approval of Subdivision Developer’s Agreement including conditions for infill stabilization and erosion control prior to final approval of the Plan;

5. that Council accept $205.19, Money in Lieu of Land For Public Purposes (cash, debit, money order, or certified cheque) for the creation of thirteen new building lots as shown on the Tentative Subdivision Plans, Panoramic Estates Subdivision as prepared by Kierstead Quigley & Roberts Ltd., Phase 2 dated August 21, 2006;

6.  that Council assent to the proposed name on the Final Subdivision Plans as June Avenue, for Panoramic Estates Subdivision - Phase 2, as prepared by Kierstead Quigley & Roberts Ltd. dated August 21, 2006.

22. WORKS COMMISSIONER’S REPORT OF SEPTEMBER 18, 2007
RE:  QUOTATIONS FOR 2008-2009 PAVEMENT MARKINGS

 Councillor Day moved to award Quotation Number 2008-2009 Re:  Pavement Markings to Four Season Sports Ltd., with an option to renew for 2010 to supply pavement markings in the Town for 2008 and 2009.

 Seconded by Councillor McGowan.  Carried.
 

23. CORRESPONDENCE OF SEPTEMBER 20, 2007 FROM STEPHANIE B. PATTERSON, 
P. ENG., GODFREY ASSOCIATES LTD. RE:  STORM SEWER IMPROVEMENTS AND BLIND KNOLL ELIMINATION, CERTIFICATE NO. 2, PROJECT NO. 010-127

 Councillor Day moved to approve Certificate No. 2 per correspondence of September 20, 2007 from Stephanie B. Patterson, P. Eng., Godfrey Associates Ltd. Re:  Storm Sewer Improvements and Blind Knoll Elimination, Project No. 010-127 and to authorize payment of relevant invoice.

 Seconded by Deputy Mayor Murphy.  Carried.
 

24. CORRESPONDENCE OF SEPTEMBER 20, 2007 FROM STEPHANIE B. PATTERSON, 
P. ENG., GODFREY ASSOCIATES LTD. RE:  STREET IMPROVEMENTS 2007, VARIOUS LOCATIONS, CERTIFICATE NO. 2 - FINAL COMPLETION, PROJECT NO. 010-126

  Councillor Day moved to approve Certificate No. 2 - Final Completion per correspondence of September 20, 2007 from Stephanie B. Patterson, P. Eng., Godfrey Associates Ltd. Re:  Street Improvements 2007, Various Locations, Project No. 010-126 and to authorize payment of relevant invoice.

 Seconded by Councillor McGowan.  Carried.

 Deputy Mayor Murphy moved to approve Certificate No. 5 for ACOA Project No. 189417, Waterfront Development Brundage Point River Centre, Grand Bay-Westfield, which has been issued from Richard & Co. Architecture Inc. per letter of September 17, 2009 from Stephanie B. Patterson, P. Eng., Godfrey Associates Ltd. with authorization for payment of relevant invoices.

 Seconded by Councillor McGowan.  Carried.

Eng., Godfrey Associates Ltd. with authorization for payment of relevant invoices.
