CALL TO ORDER

The Town of Grand Bay-Westfield Council met in a regular session on Monday, March 24, 2003 at 7:36 p.m. with Mayor Losier presiding.

Councillor Silliphant moved to receive and file the minutes of the Planning Advisory Committee meeting of March 3, 2003.

Seconded by Councillor Day.  Carried.
 

7.2  TENDER NOTES OF MARCH 12, 2003
RE:  SERVICES BY A QUALIFIED PLUMBER, QUOTATION NO. 002P-03

Councillor Day moved to receive and file Tender Notes of March 12, 2003 Re:  Services by a Qualified Plumber, Quotation No. 002P-03.

Seconded by Councillor Murphy.  Carried.
 

8.  BILLS FOR PAYMENT
Councillor Day moved to pay the Bills for Payment enbloc for a total of $112,078.25 and approve the Bills for Ratification for a total of $121,234.31, Grand Total $233,312.56.

Seconded by Councillor Murphy.  Carried.

16. TOWN MANAGER’S REPORT OF MARCH 13, 2003
RE:  QUOTATIONS FOR SERVICES BY A QUALIFIED PLUMBER

Councillor Day moved that Campbell’s Plumbing & Heating Ltd. be engaged to provide the services of a qualified plumber for the period May 26, 2003 to May 26, 2005 subject to all terms and conditions of Quotation Number 002P-03 per an hourly rate of $38.00 and parts pricing submitted in their quotation dated March 11, 2003 with B & R Commercial named as the second supplier.

Seconded by Councillor Silliphant.  Carried.
 

17.  LETTER OF MARCH 7, 2003 FROM LARRY BENNETT, 
DIRECTOR POLICE, FIRE & EMERGENCY SERVICES RE:  INCREASED COSTS FOR POLICING SERVICES

Councillor Silliphant moved to receive and file letter of March 7, 2003 from Larry Bennett, Director Police, Fire & Emergency Services Re:  Increased Costs for Policing Services.

Seconded by Councillor Murphy.  Carried.
 

18.  LETTER OF MARCH 12, 2003 FROM FUNDY REGION SOLID WASTE COMMISSION
RE:  FINANCIAL STATEMENTS FOR THE YEAR ENDED DECEMBER 31, 2002

Deputy Mayor McGowan moved to receive and file letter of March 12, 2003 from Fundy Region Solid Waste Commission Re:  Financial Statements for the year ended December 31, 2002.

Seconded by Councillor Murphy.  Carried.
 

19.  LETTER OF MARCH 18, 2003 FROM BARRY OGDEN RE:  PLANTING OF MARIGOLDS
Councillor Day moved to receive and file letter of March 18, 2003 from Barry Ogden Re:  Planting of Marigolds.

Seconded by Councillor Silliphant.  Carried.

Letter of March 18, 2003 from Barry Ogden Re:  Planting of Marigolds will be forwarded to the Beautification Committee.
 

20.  WORKS COMMISSIONER’S REPORT OF MARCH 18, 2003
  RE:  MUNICIPAL KILOMETRAGE MAINTENANCE RESPONSIBILITIES 2003

Deputy Mayor McGowan moved to table the Municipal Kilometrage Maintenance Responsibilities 2003 Agreement until the meeting with the Department of Transportation on Wednesday, March 26, 2003.

Seconded by Councillor Day.  Carried.
 

21.  LETTER OF MARCH 18, 2003 FROM ANNE DRISCOLL,
INFORMATION COORDINATOR, HUMAN DEVELOPMENT COUNCIL RE:  “211” FEASIBILITY

Councillor Silliphant moved to receive and file letter of March 18, 2003 from Anne Driscoll Information Coordinator, Human Development Council Re:  “211” Feasibility.

Seconded by Deputy Mayor McGowan.  Carried.
 

22.  CORRESPONDENCE OF MARCH 14, 2003 FROM RICHARD & CO. ARCHITECTURE INC. 
RE:  RCA PROJECT NO. 22277

Councillor Day moved to pay Richard & Co. Architecture Inc. $68,024.35 Re:  RCA Project No. 22277, Client Project No. 02BR-09, Renovations to the Municipal Administration Offices, Town of Grand Bay-Westfield Community Centrum and also pay ICR General Contractors Ltd. $275.00 plus HST Re:  Change Order No. 15.
 

Seconded by Councillor Murphy.  Carried.
 

23.  WORKS COMMISSIONER’S REPORT OF MARCH 18, 2003
RE:  REVISION FILL DISPOSAL POLICY
 
Councillor Silliphant moved to concur with the recommendation of the Works Commissioner in his report of March 18, 2003 in that Policy D001, Fill, Section 5.01 to 5.03 be revised by deleting section 5.01 to 5.03 and replacing it with section 5.01 to 5.03 below:

Fill Disposal

5.01.. The following sites are designated for disposal of fill from municipal construction projects:

a. approved locations where fill is required elsewhere in the same contract;

b. ditches along designated highway (Route #177) where fill is required;

c. any other site mutually agreed to by the Project Engineer and the Works Commissioner, during a Municipal Capital Works Project, deemed advisable to save the Town money under the terms of the contract;

d. any other site so designated by Council as a site for excavated material not suitable for reuse;

e. locations at the discretion of the contractor for Municipal Capital Projects, subject to the contractor complying with all relevant laws and regulations concerning safe, environmentally acceptable disposal methods and further subject to the contractor signing a warranty and indemnity to the Town that such laws and regulations have been complied with to the fullest extent;

f. various locations throughout the Town on municipal property or road right-of-ways only, per Town Works Department.
 

5.02
 
Only one contractor shall be permitted per disposal site for the duration of active construction.
 
5.03 A disposal option must be specified in each tender document for each contract. 
If option 5.01.e. is specified, the warranty and indemnity referred to herein must be signed by the successful bidder prior to construction

and further that the Town solicitor prepare the appropriate fill disposal agreement for insertion in Capital Project tenders.

Seconded by Councillor Murphy.  Carried.
