OATHS OF OFFICE

Sandra Gautreau, Town Manager/Clerk administered the Oaths of Office to Grace Losier, as Mayor, Beverley Day, Stephen Evans, Ashley Little, Diane McGowan and Brenda Murphy as Councillors for the Town of Grand Bay-Westfield.

The Town of Grand Bay-Westfield met in a regular session on Tuesday, May 25, 2004 at 7:30 p.m. with Mayor Losier presiding.

2.a CLERK’S STATEMENT RE:  OATHS OF OFFICE
I, Sandra Gautreau, Town Manager/Clerk for the Town of Grand Bay-Westfield, hereby state, for the record, that Oaths of Office as required per Provincial Statue have been administered to the following duly elected officials on this date May 25, 2004 at the Council Chambers, 609 River Valley Drive:  Grace Losier for Office of Mayor, Beverley Day, Stephen Evans, Ashley Little, Diane McGowan and Brenda Murphy for the Office of Councillor.

6.1  PRESENTATION TO JUDY SILLIPHANT
Mayor Losier presented Judy Silliphant with a plaque containing the Town of Grand Bay-Westfield’s Mission Statement, a bouquet of flowers, and a gift  in recognition of her service as an elected official for the 2001 – 2004 term of office.
 
6.2 PRESENTATIONS TO SIX GRAND BAY-WESTFIELD VOLUNTEER FIRE/RESCUE DEPARTMENT
FIREFIGHTERS RE:  ADVANCEMENT TO CLASS 3 FIREFIGHTER

Fire Chief  McCoy and Mayor Losier presented  firefighters Chris Calvin, Justin Craig, Carole Dube Roy, Chris Matheson, Chris McCarthy and Andrew White with certificates for advancement to Class 3 Firefighter.

A fifteen minute recess was taken for light refreshments.
 

6.3 PRESENTATION OF RCMP STATISTICAL REPORT FOR APRIL 2004 -
SERGEANT GREG GRANT ATTENDING

Due to a death in the family, Sergeant Grant was unable to attend.

Councillor Day moved to table item 6.3 - Presentation of RCMP Statistical Report for April 2004 to the June 14, 2004 Council Session.

Councillor Day moved to receive and file the minutes of Town Emergency Measures Organization meeting of March 16, 2004.

7.6 TELEPHONE POLL OF APRIL 26, 2004 RE:  STOCKPILE AND DISPOSAL SITES FOR THE
TOWN SANITARY SEWER EXTENSION WORK

Councillor Day moved to establish property identified as PID # 30070957 owned by the Town and located south of the former landfill property at the western end of Highland Road and property identified as PID # 30073712 owned by the Town and located at the southern end of the east side of Bayview Road as the stockpile and disposal sites for the Town Sanitary Sewer Extension Infrastructure Project.

7.7 TENDER NOTES OF MAY 21, 2004 - SANITARY SEWER EXTENSIONS CONTRACT NO 1,
PROJECT NO. 010-109

Councillor McGowan moved to receive and file the Tender Notes of May 21, 2004 - Sanitary Sewer Extensions Contract No. 1, Project No. 010-109.

Councillor Day moved to pay the Bills for Payment enbloc for a total of $66,696.39 and Bills for Ratification for a total of $16,702.91; grand total of $83,399.30.

Councillor McGowan moved to appoint Brenda Murphy as Deputy Mayor of the Town of Grand Bay-Westfield for the 2004 Term of Office.

17. TOWN MANAGER’S REPORT OF MAY 14, 2004 RE:  SIGNING OFFICERS
Councillor Day moved that the Town of Grand Bay-Westfield appoint the Bank of Nova Scotia, Grand Bay-Westfield Branch as our banker and agree to the terms set out in the Scotiabank Financial Services Agreement and further moved to appoint any two, one appointed and one elected of the following persons authorized to sign and deliver the Scotiabank Financial Services Agreement, any service requests and any other banking agreements:  Grace Losier, Mayor, Brenda Murphy, 

Deputy Mayor, Diane McGowan, Councillor, Beverley Day, Councillor, and Sandra Gautreau, Town Manager/Treasurer, Marcia Mason, Assistant Clerk-Treasurer.

18. TOWN MANAGER’S REPORT OF MAY 13, 2004
RE:  STANDING COMMITTEES/LIAISONS/COUNCIL APPOINTMENTS

Councillor McGowan moved to appoint full Council as Committee-of-the-Whole for the current term of office and further moved the following appointments:
Councillor Ashley Little as voting member/liaison to the Planning Advisory Committee for a three year term per section 12(5) of the Community Planning Act with Deputy Mayor Brenda Murphy to act as alternate with all voting rights and powers, Deputy Mayor Brenda Murphy as Liaison to the Tourism Committee, Councillor Stephen Evans to the Emergency Measures Organization per Section 9 (a) of the Emergency Measures Act, full Council as the Emergency Measures Committee, the Community Improvement Committee, and the Town Promotion Committee effective May 25, 2004, Mayor Grace Losier to the Beautification Committee, Councillor Stephen Evans, Councillor Diane McGowan, and the Town Manager to the Safety/Labour Management Committee, Deputy Mayor Brenda Murphy and Councillor  Beverley Day to the Grants Committee, Deputy Mayor Brenda Murphy to the Special Events Committee, Councillor Ashley Little as Liaison to the River Valley Chamber of Commerce, Councillor Diane McGowan as Liaison to the River Valley Senior Citizens, Mayor Grace Losier as Media Contact and Deputy Mayor  Brenda Murphy as Alternate Media Contact, Mayor Grace Losier as the Town’s representative on the Regional Facilities Commission, Councillor Beverley Day as the Employer Representative for the New Brunswick Municipal Employees Pension Plan, and Councillor Diane McGowan as the Town’s Representative to the Municipal Advisory Corporation Inc. 19. WORKS COMMISSIONER’S REPORT OF MAY 5, 2004
RE:  SNOW AND ICE CONTROL PLAN AMENDMENTS

 Deputy Mayor Murphy moved to approve the following amendments to the Snow and Ice Control Plan with the amendments to be forwarded to the snow  control contractor:

 Appendix “J”
 Add:  London Lane, the equipment operator shall ensure a minimum application rate for sand/salt mix  to be applied;

 Appendix “I”
 Add:  end of Brooker Lane
 Add:  end of Shannon Road;

 Appendix “K”, Plan Revisions
 Add:  2.  Council Motion of May 25, 2004.

RE: SANITARY SEWER SYSTEM EXTENSION, GRAND BAY-WESTFIELD, NB INFRASTRUCTURE PROJECT NO. 63 37 05 431 02, PROJECT NOS. 010-091, 010-102, 010-103, 010-104, & 010-109

 Councillor Day moved to approve Detailed Claim # 5 in the amount of $35,181.17 Re: Sanitary Sewer System Extension Grand Bay-Westfield, NB Infrastructure Project No. 63 37 05 431 02, Project Nos. 010-091, 010-102, 010-103, 010-104, & 010-109 and authorize relevant payments to Godfrey Associates Ltd.

21. LETTER OF MAY 14, 2004 FROM FEDERATION OF CANADIAN MUNICIPALITIES
RE:  INTERNATIONAL POLICY REVIEW (IPR)

Councillor Day moved to receive and file letter of May 14, 2004 from Federation of Canadian Municipalities Re:  International Policy Review (IPR).

22. MEMORANDUM OF MAY 4, 2004 FROM PLANNING ADVISORY COMMITTEE
RE:  APPLICATION FOR SUBDIVISION APPROVAL HAROLD & LORI SNODGRASS - HIGHLAND ROAD/DEVELOPMENT OFFICER’S REPORT OF MAY 6, 2004

Councillor McGowan moved to  accept $184.44 (cash, money order or certified cheque) as Money in Lieu of Land for Public Purposes, for the approval of 2 new residential building lots to be created on Highland Road as shown on Tentative Subdivision Plan, Harold & Lori Snodgrass Subdivision, Lot 2004-1 & Lot 2004-2 as prepared by DeSaulniers Surveys Inc., dated April 16, 2004, subject to:

a) final Subdivision Plan recording any utility easements required by the NB Power;
b) final Subdivision Plan including a Key Plan;
c) award of Municipal Services Contract for the construction of Sewer Services to the proposed new lots;

and subject to meeting the requirements from the Department of Health and Department of Environment and Local Government for adequate water quality and quantity, meeting the Canadian Drinking Water Quality Guidelines for the development of these lots, prior to Tentative Approval being granted by the Development Officer.

23. LETTER OF MAY 15, 2004 FROM SOLICITOR RALPH D. POLEY, GORMAN NASON
RE:  OWNERSHIP OF SHANNON ROAD

Deputy Mayor Murphy moved that the Town accept conveyance of Shannon Road, having PID number 219964 as shown on the Service New Brunswick Plan, from Beatrice Alice Shaw, the present owner, for the purchase price of $1.00 and further that the Town pay the current 2004 outstanding property taxes on the Road in the amount of $108.30, and further that the Town’s Solicitor be directed to prepare the necessary documentation and attend to the registration of the conveyance.

24. DEVELOPMENT OFFICER’S REPORT OF MAY 17, 2004
RE:  BUILDING BY-LAW VIOLATION, 20 BEVERLEY HILLS DRIVE

Councillor McGowan moved to send a letter to Mr. & Mrs. Robin Cosman of 20 Beverley Hills Drive to invite them to attend the June 14, 2004 Council meeting to respond to Building By-law and Zoning By-law violations.

27. RECREATION DIRECTOR’S REPORT OF MAY 19, 2004 RE:  STEP INTO LIFE PROJECT
Deputy Mayor Murphy moved to accept the recommendation of the Recreation Director to work with the Town of Quispamsis, Town of Rothesay, and City of Saint John to promote the Step Into Life Program for the benefit of  residents in the Grand Bay-Westfield area.

28. WORKS COMMISSIONER’S REPORT OF MAY 18, 2004
RE:  2004 INFRASTRUCTURE PROGRAM - PROCEDURES

Councillor Day moved to enact the following  operating procedure:

Draft Policy Re: Planned Road Closure Notification as per Works Commissioner’s report of May 18, 2004 for use during 2004 Infrastructure Program as follows:

New policy Planned Road Closure Notification

Importance To provide guidance and direction to staff, engineers, inspectors, and contractors by providing procedures to follow when a roadway is blocked to emergency service vehicles.

Responsibilities 
Definition For purposes of this policy a road closure is any physical impediment, which would prevent emergency vehicles from getting through the construction site to respond to an emergency call, and the impediment is known in advance.

Town’s Role To ensure that all consultants and contractors are aware of the procedure to follow if a roadway is to be closed due to a physical blockage.

Consultant’s Role Whenever a municipal project is being managed by a consultant on behalf of the Municipality, the consultant must ensure that their field inspector is aware of the Town’s policy and follows the steps listed below whenever a blockage is scheduled.

Contractor’s Role The contractor shall notify the consultant 24 hours before any planned construction, which will physically block a roadway and prevent the passage of emergency vehicles. The contractor shall also provide a time estimate for the blockage and in no situation shall the roadway remain blocked at the end of that workday.

SPECIAL NOTE 

In the event that emergency vehicles need to cross the blockage, the contractor shall immediately remove/restore the physical blockage to allow the passage of emergency vehicles.

Notification procedures Once a blockage is scheduled the following steps must be taken by the Contractor:

Step Action

(1) Inform the engineer in charge of the project on behalf of the Municipality.

(2) Engineer/Consultant shall contact the following agencies and advise them of the blockage, location,
     duration and provide a cellular phone number for direct contact with the on-site inspector:

Volunteer Fire/Rescue Department 647-7080
Westfield Volunteer Ambulance Pager No. 631-9594
RCMP 757-1020
Works Commissioner 738-6422.

(3) Engineer/Consultant shall contact School District #8 at 658-5397 if the road to be closed is a school bus
     route, i.e. River Valley Drive, Nerepis Road, Woolastook Drive and/or Inglewood Drive and the closure
     is scheduled during normal school hours.

and further moved to enact the following operating procedure:

Draft Sewerage Lift Pump Agreement for use between residents below grade and the Town of Grand Bay-Westfield as attached to the Works Commissioner’s report of May 18, 2004 for use during the 2004 Infrastructure Program.

29. LETTER OF MAY 21, 2004 FROM GODFREY ASSOCIATES LIMITED
RE: RECOMMENDATION FOR AWARD OF CONTRACT FOR SANITARY SEWER EXTENSIONS CONTRACT NO. 1, PROJECT NO. 010-109

Councillor Day moved to concur with the recommendation of Godfrey Associates Ltd. and award the contract for Sanitary Sewer Extensions - Contract No. 1, Project No. 010-109 to Galbraith Construction Ltd. for  $1,289,955, being low tender.

 Seconded by Deputy Mayor Murphy.  Carried.

29.a RESCHEDULING OF REGULAR COUNCIL SESSION OF JUNE  28, 2004  DUE TO THE FEDERAL ELECTION

 Councillor McGowan moved to reschedule the Regular Council Session of June 28, 2004 to Tuesday, June 29, 2004  due to the Federal Election.

 Seconded by Councillor Day.  Carried.
